强制约束是治安秩序管理中公安机关人民警察对特定相对人采用的即时强制手段,运用十分普遍。然而,由于现行法律制度不完善,实践中又多有执法不规范的现象,从而侵犯了相对人的合法权益。因此,通过对强制约束制度的认真审视以及对执法现实的反思,从法律层面及实践层面强化和完善强制约束的法律控制,对于规范强制约束行为,保证极端权力不偏离法制轨道,确保其功效得以最恰当的发挥具有重大的现实意义。  相似文献

面对中国严峻的就业形势和贫富分化,面对经济理论的局限性,我们需要发展更具操作性的理论为政府制定政策提供依据。本文引入了瓶颈与冗余的概念,并应用这一概念分析政府应该根据什么准则制定政策,特别分析了中国某些鼓励就业政策。认为应用瓶颈与冗余概念,可以制定出兼顾公平与效率并顺利解决就业问题的政策。  相似文献

This research focuses upon employment in the new economy, exploring labour protection and social protection in the digital age in China. Through an empirical survey conducted in three Chinese cities, social insurance and the labour rights of employees in the digital economic sector, such as gig employment, e-commerce, and various other forms of online employment, have been examined in-depth. This study reveals new regulatory loopholes in the digital labour market, which have substantially eroded the basis of social policy arrangements in China, “softening” participation in social insurance branches and compliance with labour regulations remarkably. Drawing upon the theoretical concepts of Polanyi on embeddedness and disembeddedness, we argue that the digital employment sector in China has been increasingly disembedded from social institutions and social control. The new configuration in the digital field of social policy requires novel conceptual models and institutional settings to cope with increasing social risks in virtual spaces.  相似文献

手机银行作为新兴的金融服务手段有着很大的发展潜力,然而现有研究对其拓展模式还没有清晰的认识.本文在2007年对以中层管理人员为主的中青年消费群体问卷调查和访谈的基础上,通过结构方程模型(SEM)的构建分析,开发了手机银行用户采纳模型(TAM).该模型为手机银行的有效拓展提供了科学的依据,通过该模型可发现拓展手机银行应该着重改善服务内容,提高用户的使用能力,加快对用户的服务速度,并消除消费者对手机银行安全方面的顾虑.  相似文献

A central problem in compressed sensing is the construction of sensing matrices. In this paper, we show how to construct sensing matrices by using semilattices, and give many examples of sensing matrices constructed from specific semilattices. Moreover, we show that the new construction for some examples with small parameters gives better sensing matrices compared with previously known constructions.  相似文献

Consider the problem of partitioning n nonnegative numbers into p parts, where part i can be assigned ni numbers with ni lying in a given range. The goal is to maximize a Schur convex function F whose ith argument is the sum of numbers assigned to part i. The shape of a partition is the vector consisting of the sizes of its parts, further, a shape (without referring to a particular partition) is a vector of nonnegative integers (n1,..., np) which sum to n. A partition is called size-consecutive if there is a ranking of the parts which is consistent with their sizes, and all elements in a higher-ranked part exceed all elements in the lower-ranked part. We demonstrate that one can restrict attention to size-consecutive partitions with shapes that are nonmajorized, we study these shapes, bound their numbers and develop algorithms to enumerate them. Our study extends the analysis of a previous paper by Hwang and Rothblum which discussed the above problem assuming the existence of a majorizing shape. 针对大型复杂企业维修任务集的多服务需求点和多样化需求特征,基于服务需求视角,定义一类多服务需求点下的MRO服务资源配置问题,建立以MRO服务提供商整体服务成本为优化目标,同时考虑资源紧张度、信任度和多服务需求点不同工期要求的问题模型;针对模型中的关键参数(即服务成本和资源紧张度)的特征进行分析,并给出相应的度量方法;在此基础上,设计改进的模拟植物生长算法实现求解,算法通过启发式获得初始可行解,并进行敏感性分析。研究结果表明, MRO服务资源配置模型和算法是可行和有效的,服务成本的波动、信任度和资源紧张度的变化对于资源配置结果均有影响,模型能够有效提高维修服务成本的估算能力,同时能够保持MRO服务提供商资源配置的稳定性。  相似文献

This study develops an analytical model to evaluate competing retail firms' sourcing strategies in the presence of supply uncertainty. We consider a common supplier that sells its uncertain supply to two downstream retail firms engaging in price competition in a horizontally differentiated product market. The focal firm has a dual‐sourcing option, while the rival firm can only source from the common supplier. We assess the system‐wide effects of supply uncertainty on the focal firm's incentive to pursue the dual‐sourcing strategy. We find that the focal firm's dual‐sourcing strategy can create a win–win situation that leads to increased retail prices and expected profits for both firms. Furthermore, under certain conditions, we show that it is beneficial for the focal firm to strategically source from the common supplier, even if its alternative supplier offers a lower wholesale price. Overall, we identify two types of incentives for adopting the dual‐sourcing strategy: the incentive of mitigating supply risk through supplier diversification and the incentive of strategic sourcing for more effective retail competition.  相似文献

We investigate strategic information sharing in two competing channels. The retailer in a channel can ex post decide whether to share private demand information with his upstream manufacturer after the content of information becomes known. We find that a retailer discloses low demand and withholds high demand to induce lower wholesale prices from his manufacturer. We show that a retailer should share less information when the retail market becomes more competitive, but should disclose more information when his capability to acquire information improves. When a decentralized supply chain competes with an integrated channel, we show that firms in the supply chain benefit from the rival channel's effort to improve information capability, that the incentive for the retailer in the supply chain to improve his information capability increases with the intensity of competition and with the rival channel's information capability, and that the retailer may not want to pursue perfect information acquisition even when doing so is costless. Extensive numerical studies demonstrate that similar results also hold for two decentralized supply chains competing with each other.  相似文献

In this study we examine the moderating effect of competitive strategy (including differentiation and cost‐leadership strategies) on the relationship between exploration and firm performance. We find that the moderating effect of differentiation strategy is positive while that of cost‐leadership strategy is negative. And, these moderating effects are stronger in a highly competitive context. This study offers an explanation for previous mixed findings on the linkage of exploration to firm performance and enriches the discipline's knowledge regarding the performance implications of exploration. Moreover, we respond directly to the appeal in research on competitive strategy to clarify the role played by competitive strategy in profiting from exploration.  相似文献
