Dans cette communication, l'auteur s'appuie sur des documents des archives d'une association provinciale du Barreau canadien pour étudier les facteurs qui conditionnent les décisions de poursuivre ou de sanctionner les avocats pour faute professionnelle. Selon le modèle présenté, il existe des similitudes entre la façon dont les décisions sont prises par les cours criminelles et par les instances d'autoréglementation de la profession juridique. Plus précisément, l'auteur avance l'hypothèse selon laquelle la position occupée à l'intérieur de la profession, le degré d'inexpérience et l'état de l'économie influeront sur la décision de poursuivre et de discipliner un avocat. Le modèle tient compte d'autres facteurs, tels la nature de l'infraction au code de déontologie, l'existence plaintes pour faute professionnelle antérieures et le sexe de la personne. Les données étudiées tendent à confirmer les hypothèses émises et font ressortir certaines tendances communes entre le système public et le système professionel en matière de poursuites et de sanctions. Using archival data from a Canadian provincial bar association we examine contingencies that structure decisions to prosecute and sanction lawyers for professional misconduct. A model is explored which asserts similarities between criminal justice and professional self-regulatory patterns of decision-making. More specifically, we hypothesize that intra-professional position, inexperience and the economic recession will influence disciplinary decisions to prosecute and sanction lawyers. Offence characteristics, complaint histories and gender are also included in the models. Our findings offer some support for our hypotheses and for the assertion of similarities between professional and public systems of prosecution and sanctioning.  相似文献

The impact of childhood on success in adulthood has been much researched. This paper discusses how parental expectations, social class, childhood experiences and gender influenced the career success of disabled people. For respondents with congenital disabilities, disability was perceived as a primary factor influencing parental expectations, but those with acquired disabilities felt it was gender. Social class played a significant part in all respondents' childhood socialisation and parental expectations. Some experienced deprivation and trauma as children, encouraging them to master future life events. The findings highlight the importance of childhood socialisation to the career success of disabled people.  相似文献

This study of middle-class American families draws on ethnography and urban economic history, focusing on patterns of leisure time and household consumption and clutter. We trace how residential life evolved historically from cramped urban quarters into contemporary middle-class residences and examine how busy working families use house spaces. Our ethnographic sample consists of 24 Los Angeles families in which both parents work full time, have young children, and own their homes. Formal datasets include systematically timed family uses of home spaces, a large digital archive of photographs, and family-narrated video home tours. This analysis highlights a salient home-storage crisis, a marked shift in the uses of yards and garages, and the dissolution of outdoor leisure for busy working parents. Recollection bias (RB) refers to the phenomenon whereby after an adverse event people report that their risk assessment about a similar future event is presently no higher than their recollection of their pre‐event risk assessment. While previous research has outlined this theoretical construct and generated important empirical findings, there were some limitations. We design and employ a new national representative survey to address these limitations in this study. We examine the existence and persistence of RB among the general public in the context of a number of domestic and international terrorist attacks. We further examine the socioeconomic and political base of RB and the influences of RB on a wide range of citizens’ counterterrorism policy preferences. Our data analyses reveal strong evidence showing the occurrence of RB and its persistence across various forms of terrorism risk. With regard to the socioeconomic and political base, we find that females, older people, political conservatives, and Republicans are less likely to be subject to RB. For the effects of RB on public counterterrorism policy preferences, our analyses demonstrate that this bias significantly dampens public support for a wide range of preventive policy measures and government anti‐terrorism spending. Overall, our study, based on a national representative sample and an extended survey design, provides robust evidence of RB in terrorism risk assessment, and adds further evidence to support the idea that RB is likely a generalizable phenomenon. Implications and suggestions for future research are discussed in the conclusion.  相似文献

This article explores the definition of Critical Autism Studies and its inclusion in autistic scholarship. There has been critique of recent non-autistic literature for lacking autistic authorship, leading to doubts about its epistemological integrity due to misrepresentations of autistic culture and the neurodiversity movement. This article utilises the work of Arnold, Milton and O’Dell et al. to introduce an emancipatory definition to ensure the discipline is autistic led. In the process, we discuss the nature of autism studies and what constitutes critical literature. We propose Waltz’s interpretation of Critical Autism Studies as a working definition.  相似文献

This paper presents findings from a study of Instagram use and funerary practices that analysed photographs shared on public profiles tagged with ‘#funeral’. We found that the majority of images uploaded with the hashtag #funeral often communicated a person's emotional circumstances and affective context, and allowed them to reposition their funeral experience amongst wider networks of acquaintances, friends, and family. We argue that photo-sharing through Instagram echoes broader shifts in commemorative and memorialization practices, moving away from formal and institutionalized rituals to informal and personalized, vernacular practices. Finally, we consider how Instagram's ‘platform vernacular’ unfolds in relation to traditions and contexts of death, mourning, and memorialization. This research contributes to a broader understanding of how platform vernaculars are shaped through the logics of architecture and use. This research also directly contributes to the understanding of death and digital media by examining how social media is being mobilized in relation to death, the differences that different media platforms make, and the ways social media are increasingly entwined with the places, events, and rituals of mourning.  相似文献

Social listening occurs in a variety of mediated contexts, but it has yet to be clearly defined in the realm of communication and listening studies. This report explores social listening as a developing listening type extending from the existing taxonomy of listening, posits a definition of its meaning, evaluates its role in organizational and interpersonal communication, and discusses its value as an additional listening dimension. Based on a review and synthesis of literature across multiple fields of study, we describe social listening as a dimension of listening comprising a blend of purposes complementary to the existing appreciative, comprehensive, critical, discriminative, and therapeutic listening types discussed in Wolvin and Coakley’s (1993) listening taxonomy. As mediated communication continuously evolves within the communication landscape, the urgency to understand social listening will surely increase. With this in mind, we introduce and define social listening as an emerging type of listening and as a means of attaining interpersonal information and social intelligence that can empower relationships and influence the way we listen to and communicate with one another through increasingly popular mediated channels.  相似文献
