Abstract Using legal rulings on gay marriages from two periods in the U.S., I analyze the ability of dominant approaches to legal decision‐making to explain the rulings, their content, and changes from one period to the next. I show that no single dominant approach can address all three concerns. Instead, an approach that blends existing “attitudinal” and new institutionalist models within a structuration framework is developed and defended. In addition to contributing to a specific debate about legal decision‐making, the paper compares the power of cross‐sectional models to more temporally sensitive approaches and develops on Sewell's (1992 ) structuration theory.  相似文献

Women with a disability continue to experience social oppression and domestic violence as a consequence of gender and disability dimensions. Current explanations of domestic violence and disability inadequately explain several features that lead women who have a disability to experience violent situations. This article incorporates both disability and material feminist theory as an alternative explanation to the dominant approaches (psychological and sociological traditions) of conceptualising domestic violence. This paper is informed by a study which was concerned with examining the nature and perceptions of violence against women with a physical impairment. The emerging analytical framework integrating material feminist interpretations and disability theory provided a basis for exploring gender and disability dimensions. Insight was also provided by the women who identified as having a disability in the study and who explained domestic violence in terms of a gendered and disabling experience. The article argues that material feminist interpretations and disability theory, with their emphasis on gender relations, disablism and poverty, should be used as an alternative tool for exploring the nature and consequences of violence against women with a disability.  相似文献

This article examines the implications of part‐time working for mothers, particularly with regards to their occupational mobility and acquisition of skills, in UK service sector organizations following the implementation of the Part‐time Workers’ Directive in 2000. Through qualitative interviews with women and their managers in five hospitality workplaces, this article explores whether part‐time workers are potentially the ‘losers’ in the ‘winner‐takes‐all’ approach to career development. Discussions focus upon the extent to which part‐time workers can access career paths or, alternatively, whether part‐time management positions are the reserve of highly skilled women who are able to negotiate reduced hours after obtaining a management position full time. In conclusion, this article distinguishes between two forms of working‐time flexibility, which are named optimal and restrictive. The implications of these alternative types of flexibility, in terms of access to skill acquisition and occupational mobility, are then addressed.  相似文献

This study reports the findings from 68 interviews with parents of disabled children who are users of seven key worker schemes in England and Wales. The interviews which lasted for one hour each, were tape‐recorded, transcribed and analysed according to both a priori and emerging themes. The findings from this study have implications for policy and practice, for example, the necessity of protected time for key workers, the necessity of conveying clear information about the key worker's role, the importance of access to training and information for the key worker, the need for key workers to be proactive, and for their involvement in care plan and review meetings. Using in‐depth interviews with 20 probation youth (60% female; 35% White; 30% Hispanic; mean age: 15 years, range = 13–17), their caregivers (100% female; mean age: 44 years, range = 34–71), and 12 female probation officers (100% White; mean age: 46 years, range = 34–57), we explored how family and probation systems exacerbate or mitigate sexual risk. We conducted thematic analyses of interviews, comparing narratives of families of sexually risky (n = 9) versus nonsexually risky (n = 11) youth. Family functioning differed by youth sexual risk behavior around quality of relationships, communication, and limit setting and monitoring. The involvement of families of sexually risky youth in probation positively influenced family functioning. Data suggest that these families are amenable to intervention and may benefit from family‐based HIV/STI interventions delivered in tandem with probation.  相似文献

In recent decades, resilience research has striven to atone for the Eurocentric nature of research conducted with Canada's Aboriginal populations. It has been cautioned, however, that if resilience research fails to account for Aboriginal population's diversity, it risks culturalized images and pan-Aboriginalism. Definitions of resilience should be framed within community-specific models, recognizing dynamic subjects interacting in multiple social worlds. In partnership with six Saskatchewan First Nations communities, our work seeks to understand what resilience means to youth who live on-reserve. We draw on findings from two community-based projects developed with the Battleford Agency Tribal Chiefs First Nations. These projects used arts-based and mixed-methods to identify community strengths and barriers surrounding youth resilience. Although study findings show the influence of family, programming, and culture, our model is emended to show the importance of youth's own definitions of resilience, even when these may appear antithetical to conventional norms. Drawing on the youth's artistic pieces, evolving themes focus on hip-hop culture and Thug Life; showing youth creating a place to belong when they are experiencing a lack of belonging. Within the framework of listening to youth-driven resilience, we put forward an alternative model of reaching youth using positive elements of Thug Life and hip-hop.  相似文献

The experience of managers of Social and Community Services(SACS) based in rural locations is the topic of this paper.Prompted by Richard Pugh’s article (2003, pp. 67–85),the paper identifies some of the features of managing socialwork services that are specific to rural contexts. Based onpostgraduate research, the paper briefly describes the contextof these services and the methodological approach used to collectin-depth, or thick, data. The issues of role, relationships,isolation, access to resources and training are discussed, asthese were the themes that emerged from the data. The findingsof the study suggest that rural managers’ experiencesdiffer in significant ways from those of their urban-based colleagues.These differences are relevant to understanding the nature ofmanagement in rural contexts, and the education and supportneeded by these managers.  相似文献

This article focuses upon the ways in which Deaf and hard of hearing people are excluded from participation in society. In particular, the focus is upon the ordinary expectations that members of society have in terms of participating as citizens and performing socially sanctioned, adult roles. The roles of 'citizen', 'employee', 'parent' and 'patient' are discussed. The data illustrate how the organisation and delivery of services can undermine, rather than facilitate, the performance of these roles. Despite policy emphasis on social inclusion, current services and legislation fail to provide a firm basis for the full participation of Deaf and hard of hearing people in British society.  相似文献
