“Mostly we are White and Alone”: Identity,Anxiety and the Past in Some White Zimbabwean Memoirs

Using the space created by the land invasions, over the last ten years or so there has been a proliferation of exile memoirs written by white Zimbabweans living in the diaspora, which foreground colonial nostalgia and postcolonial anxiety. This article profiles elements of this latest wave of “white (female) writing”, arguing that writers such as Alexandra Fuller construct their own personal narratives based on an extremely teleological and narrow interpretation of the history of Zimbabwe. It is argued that memoirs are used as a mechanism to uphold an idealised (i.e. powerful) white identity, because whites' current “destabilised” identity has resulted in them clinging to a seemingly utopian version of both what it meant to be white and the past. The article also examines some aspects of whiteness studies, utilising Peter McLaren's framework to argue that these memoirs are beset by a whiteness of social amnesia.

Beyond Heroes and Victims: Filipina Contract Migrants,Economic Activism and Class Transformations

This article employs anti-essentialist Marxist analysis to shed light on the diverse economic activities that Filipina contract migrants are engaged in at home and overseas. We point to the limitations of dominant representations of these women as 'heroes' of national development or 'victims' of a global capitalist economy, which tend to foreclose a discussion of multiple class processes engendered by transnational labour migration. In drawing on a fluid theory of class, we investigate how contract domestic workers are involved in multiple class processes that allow them to produce, appropriate and distribute surplus labour in innovative ways. We also discuss the activities of the Asian Migrant Centre, a non-governmental organization working with domestic workers in Hong Kong, whose efforts to inspire the entrepreneurial aspirations of these women reflect the importance of recognizing migrant workers' multiple economic identities. This analysis has implications for how we imagine the agency of contract workers, as well as the performativity of research and advocacy work.

构建和谐社会离不开草根阶层的介入,但草根群体又因其先天性的缺陷,影响了自身的发展。思想政治教育的任务,就是直面社会现实,穿越社会底层,打通影响广泛的民间生活常识的屏障,找到一个切实可行的教育内容与方法,使草根阶层得到全社会的呵护,受到教育,看清前途,使他们各有所安,各得其所,安身立命,以建设成为一个厚重的基层底盘,促进和谐社会的发展。     

经验抑或逻辑:对知识产权客体与对象之争的反思

"客体"与"对象"在词义上存在混用,法学中的"客体"与"对象"应参照哲学认识论作同义理解。刑法的客体理论基础存在逻辑上的失恰性,刑法客体与对象之分作为知识产权客体与对象之争的论据并不充分。民法中的权利客体结构实为一种双重构造体系,"平面"罗列式扭曲的权利客体难堪重任。从知识产权权能构造层面来看,知识产权客体也是一种双重构造体系,包括知识产权的支配、使用客体(信息)和知识产权的处分客体——知识产权(利益)。知识产权"客体"与"对象"之争实际上演变成形式逻辑与历史(经验)逻辑之争的命题。     

杜绝死刑冤假错案十论

近年来在我国司法实践中,有关死刑的冤假错案频频发生,这一现象引起了众多专家学者的关注和思考。针对目前司法实践中存在的问题,我们必须树立"以人为本"、"生命至上"的理念,在司法工作中切实贯彻落实科学发展观;切实做好入罪的甄别工作,防止以"假事实"掩盖"真事实"而按"假事实"对行为人定罪,严禁以所谓的高科技手段进行所谓的心理测试;坚定地执行"疑罪从无"的原则,赋予犯罪嫌疑人以沉默权;应当不断提高侦查讯问程序的透明度,强化对侦查讯问活动有效的内部监督和有力的外部监督,坚决排除刑讯所取得的嫌疑人供述,减少冤假错案发生的几率;切实推行错案追究和"行政问责"制度,对于酿成错案的有关人员给予严厉制裁,加大对司法腐败的惩治力度。     

论违约责任的替代

承担违约责任的方式可概括为实际履行和损害赔偿,二者之间具有可替代性。即当一种违约责任不能由违约人承担时,由其承担另一种违约责任,违约责任的替代需具备一定的条件。本文研究各国法律的不同规定,结合我国《合同法》就违约责任能否替代及何种条件下可以替代的问题进行了深入的探讨。     

Social Bookmarking–Repository–Networking: Possibilities for Support of Teaching and Learning in Higher Education

Social bookmarking, repositories, networking, and other Web 2.0 technologies have the capacity to engage enormous numbers of ordinary people in networking, sharing, and working with digital resources. The Faculty of Education at The University of Hong Kong has been pioneering new educational applications. Through grants from the University we have developed a social bookmarking and repository system based on Web 2.0 ideas. RISAL—Repository of Interactive Social Assets for Learning has an unrealized potential to support teaching and learning at the University level. It is designed to facilitate and encourage sharing and collaboration of teachers and students with similar interests or learning foci across levels and programs. This form of learning support builds on and encourages the Web 2.0 culture of social networking and contribution of the individual to the community. In addition, the system is designed to incorporate compliance with Hong Kong's Copyright Ordinance (Creative Commons). The authors discuss the RISAL and describe its features and benefits that this system can offer to teaching and learning.
