Good Passages, Bad Passages

This chapter explores the relation between subjectivities, materialities (including technological arrangements) and bodily competencies. Starting from the assumption that all material and bodily arrangements are specific, it considers some of those specificities, and the 'passages' through which these specific arrangements are fitted together for a particular person, Liv, who is physically disabled. It explores the character of some of Liv's 'passages'—some are 'good', some 'bad', some public, and some discrediting—and the ways in which they are shaped to produce personal and biographical continuity and relative autonomy for her—an autonomy and capacity discretionary decision making which she highly values. The paper thus uses some of the tools developed in the actor-network approach, but also in feminism, to interpret the material and corporeal relations involved in the formation of contemporary subjectivities.     

Residual plots for linear regression models with censored outcome data: A refined method for visualizing residual uncertainty

Residual plots are a standard tool for assessing model fit. When some outcome data are censored, standard residual plots become less appropriate. Here, we develop a new procedure for producing residual plots for linear regression models where some or all of the outcome data are censored. We implement two approaches for incorporating parameter uncertainty. We illustrate our methodology by examining the model fit for an analysis of bacterial load data from a trial for chronic obstructive pulmonary disease. Simulated datasets show that the method can be used when the outcome data consist of a variety of types of censoring.

中小学校、中小学教师应当就其过失行为引起的损害对遭受损害的中小学生承担侵权损害赔偿责任,即便导致中小学生遭受损害的侵权行为是由中小学生、中小学校教职员工以外的社会公众进入中小学校实施的,中小学校、中小学教师也应当对遭受损害的中小学生承担侵权损害赔偿责任,只要中小学校、中小学教师在保护其中小学生的人身安全方面存在过失;中小学校、中小学教师承担的此种侵权损害赔偿责任不得在中小学校、中小学教师同实施侵权行为的社会公众之间进行分配并因此让中小学校、中小学教师承担所谓的补充责任.     

职业分层的方法论及其功能

职业分层不仅在理论上而且在实证上与社会分层之间具有原生与派生的逻辑关系。当代国际社会分层研究对其基本研究单元一职业分层的研究可以分为两种基本理论构架和方法路径:理论分类分析和经验分级分析。分类与分级实质上是分层领域的理论核心问题和矛盾的难题。上述两种分层理论和分析路径的综合将有助于对职业分层和社会分层的全面研究。     

对高校学习考试与道德诚信建设问题的思考

课程学习和考试的目的是促进学生完成学习任务。考试的主要作用是衡量学生掌握知识的程度。高校考试存在着作弊问题,作弊的实质是学生道德诚信的缺失或失落。解决考试作弊问题必须从道德诚信建设和法制建设的结合上着手,并以道德诚信建设为主去进行。     

论域名与商标的冲突与协调

随着域名的市场价值逐步为社会所认同,带来了域名与其他权利之间的冲突,其中,域名和商标的联系及区别导致两者间的冲突越发严峻。目前可以将域名归入知识产权的范畴进行立法规范,赋予其独立的法律地位,以解决域名与商标的冲突问题。     

The influence of individual,marital, and family therapy on high utilizers of health care

Research has shown that people reduce their use of health care after individual, marital, and family therapy, which is known as the "offset effect." However, little research has been done to learn if high utilizers of health care reduce health care usage after therapy. Medical records of research participants (n = 65) from a health maintenance organization (HMO) were randomly selected and examined for 6 months before, during, and after therapy. Persons who received individual, marital, or family therapy all reduced their health care use after therapy, with the largest reductions coming from those participants who had some form of conjoint therapy.

Textualism,structuralism and originalism： the art of the NPC Standing Committee＇s interpretations of the Basic Law

本文分析了香港回归以来全国人大常委会对香港基本法三次解释中所采用的法律解释方法,包括文本解释、结构解释和立法原意解释等。文章强调“人大释法”在娴熟地采用这些法律解释方法时对法理学说的运用。文章指出,在居港权案中,特区终审法院与人大释法在法律解释方法上的分歧主要在于确定体现立法原意的权威本文的过程中,究竟是采取程序主义的形式审查,还是实质主义的意图推定,这不仅是法律解释方法的不同,而且是法理学说和政治立场的不同。在此基础上,文章批评了立法者不适宜解释法律的流行偏见,呼吁将基本法纳入列国家宪政体制中来理解。     

Exploration of the Factorial Structure of the Revised Personal Functions of the Volunteerism Scale for Chinese Adolescents

Participation in volunteer services can be regarded as an indicator of quality of life among adolescents. The Volunteer Functions Inventory (VFI) has long been used to assess the underlying motives of volunteers. Owing to conceptual, methodological and empirical limitations, the VFI could not be fully endorsed to understand Chinese adolescent volunteerism. Another scale was devised, called the Revised Personal Functions of the Volunteerism Scale (R-PFVS). This study focused on the exploration of the factorial structure of the R-PFVS. The R-PFVS was administered to a large sample of Chinese adolescents (N = 5, 946). Data were split into two halves: one for exploratory factor analysis and the other for confirmatory factor analysis. The scale showed good factorial validity. Seven factors were revealed, namely, well-being, learning, socializing, pro-social competence, altruistic concern, future plan, and civic responsibility functions. The factors were highly correlated with each other. A second-order factor model was established, and all seven factors were loaded on this higher-order abstract factor. The R-PFVS subscales and the overall scale demonstrated good internal consistency. The findings were compared with the VFI. The R-PFVS can be used in assessing the underlying motives behind volunteerism among Chinese adolescents and in studies on the quality of life.
