跨国污染损害赔偿法律规则探微

国家或其管辖或控制之下的私人或实体从事国际法不加禁止的行为造成的重大跨国污染损害,国家或私人实体应当承担国际赔偿责任.现行国际和国内法律文件所确定的赔偿规则主要集中于国际法不加禁止的危险活动领域,以严格责任为主要归责原则,主要目的是为受害者提供充分和及时的赔偿,包括赔偿范围、赔偿责任主体、赔偿责任限制、赔偿责任担保和索赔诉讼等具有普适性的制度.

Testing the Martingale Difference Hypothesis

In this paper we consider testing that an economic time series follows a martingale difference process. The martingale difference hypothesis has typically been tested using information contained in the second moments of a process, that is, using test statistics based on the sample autocovariances or periodograms. Tests based on these statistics are inconsistent since they cannot detect nonlinear alternatives. In this paper we consider tests that detect linear and nonlinear alternatives. Given that the asymptotic distributions of the considered tests statistics depend on the data generating process, we propose to implement the tests using a modified wild bootstrap procedure. The paper theoretically justifies the proposed tests and examines their finite sample behavior by means of Monte Carlo experiments.

Local Gatekeeping Practices and Residential Segregation*

This article links the statistical data on residential segregation with the informal practices of individuals. Local gatekeeping practices contribute to the perpetuation of segregation and further explain the patterns of macro-level analyses. This research focuses on the community of Greenpoint, a predominantly white, working-class neighborhood in Brooklyn. The study describes the strategies used by residents of Greenpoint to accomplish residential segregation and to maintain a predominantly white non-Hispanic neighborhood. The process of informal housing networking is supported by the arrangements of local institutions.     

Machismo: Manifestations of a cultural value in the Latin American casino

Casino operations were observed in twelve Latin American countries. Owners, managers, employees, players, and government regulators in each of these countries were interviewed. The concept of machismo is described in its historical and cultural context. It is then used to illuminate casino operations and the mode of play in existence in these casinos.Research activities for this paper were supported by grants from the First Interstate Bank of Las Vegas, Nevada, through the Center for Business Leadership at the University of Nevada, Las Vegas, and from Tottenham and Associates, Gaming Consultants, London, England.     

After the highwayman: Syntax and successful placement of press releases in newspapers

This study proves once again that too many press releases are poorly written and over-written, with long sentences and paragraphs, and poor syntax as well as weak and passive construction. In their use of press releases, journalists almost always have to make them simpler, shorter, easier to read, and less passive.The authors conclude that success in writing of press releases requires brevity and simplicity, shorter paragraphs, sentences, and words, and the elimination of the passive voice.Timothy Walters is an assistant professor of communication at Stephen F. Austin State University in Nacogdoches, TX. Lynne Walters is associate professor of journalism and Douglas Starr professor of journalism, both at Texas A&M University, College Station. Lynne Walters is currently a Fulbright professor at the American Journalism Center in Budapest, where her husband Timothy is also on a one-year appointment as a visiting professor.
