Zusammenfassung  Der Beitrag erkl?rt einerseits die Notwendigkeit eines durch Gesetz geregelten Verfahrens zur Insolvenzabwicklung mittels betriebswirtschaftlicher Grundlagentheorien. Andererseits werden dieselben Grundlagentheorien genutzt, um die unterschiedlichen sich ver?ndernden Machtstrukturen, die oft gegens?tzlichen Interessen von Stakeholdern, die Kosten des Insolvenzprozesses sowie deren Dynamik im Rahmen des vierphasigen Insolvenzprozesses (vor Insolvenzanmeldung, nach Antragstellung, nach Er?ffnung, nach Abschluss des Verfahrens) eines Not leidenden Unternehmens besser veranschaulichen zu k?nnen. Der besondere Schwerpunkt wird hierbei auf das Verfahren in Eigenverwaltung, das hei?t mit eigenem Management, gelegt.
The bankruptcy process and the self-administration in the bankruptcy proceedings
Summary  This article explains on one hand the necessity of a legally fixed process for the bankruptcy proceedings with basic economic theories. On the other hand, the same theories are used to demonstrate the changing power structures, the often different interests of stakeholders, the costs of the bankruptcy proceedings as well as its dynamics during the four bankruptcy phases (before the filing, after the filing, after opening and after closing) of the bankruptcy process. The focus of this article lies hereby on bankruptcy proceedings in self-administration which means that the management stays on duty.

Considerations on the design of a professional education of counselorsSome of the recently published articles about supervision-professionalizing are reflecting only sociological or psychological conceptions in order to describe and analyze professionality. In this article the authors discuss some of the mostly neglected points of view out of pedagogic and microsociologic professionalization-research (professional self, researching attitude). The existing requests of competence for supervisors are examined in order to test their teaching ability. The paper introduces a new method for flexible spline fitting for copula density estimation. Spline coefficients are penalized to achieve a smooth fit. To weaken the curse of dimensionality, instead of a full tensor spline basis, a reduced tensor product based on so called sparse grids (Notes Numer. Fluid Mech. Multidiscip. Des., 31, 1991, 241‐251) is used. To achieve uniform margins of the copula density, linear constraints are placed on the spline coefficients, and quadratic programming is used to fit the model. Simulations and practical examples accompany the presentation.  相似文献

This article contributes to the debate on dependence and independence through a study of how a group of 29 cognitively healthy Swedish home-help care recipients between the ages of 77 and 93 perceive their situation. Two overall themes with regards to how the constructs of dependence and independence are understood were found. One of them concerns how being in need of help can be justified (i.e. the why of receiving help) and the other how the very situation of being in need of help and care can be regarded (i.e. the how of receiving help). The study reveals a clear distinction between receiving help and care and feeling dependent, as well as between receiving help and care and being able to remain an active agent. On the basis of these findings we argue for the fruitfulness of distinguishing between ‘being’, ‘feeling’ and ‘acting’ as aspects of dependence and independence.  相似文献

Communication skills are of central importance within daily medical life providing effective treatment. In the modern high-tech field of medicine, trustful conversations play a prominent role. In order to help students of the Heidelberg Medical Faculty to be ready for their highly responsible role as communication partner, training is carried out in the framework of HeiCuMed (short for Heidelberger Curriculum Medicinale) using specially trained simulation patients. The communication and interaction training program (referred to as Medi-KIT) enables to practice conducting conversations with challenging communication partners and grave conversational content in difficult situations. Feedback from the standardized patients, as well as from peers and tutors represents a central didactic element.In order to secure knowledge transfer into daily clinic life and as well to build a relation to cognitive knowledge transfer, all medical students are assigned, alongside Medi-KIT lessons, to a ward, and training units are coordinated in terms of content to correspond with symptom-oriented lectures and parallel POL-groups (problem-oriented learning groups). In addition, communication learning objectives are examined at the end of the semester in the form of a clinical practical exam (OSCE: Objective Structured Clinical Examination) and at patient’s bedside (Mini-CEX: Mini Clinical Examination). The goal in imparting communication skills within medical education is that the longitudinal communication curriculum be maintained and continued in subsequent medical specialization studies.  相似文献

Welfare states are constructed around values and political and economic preferences, creating social relationships between the genders. As women increase their labour market participation, new patterns of conflict within families and around policies arise. In this article, attitudes towards family and gender relations among men and women in different age groups in Germany, Italy and Sweden are analysed. The findings show that national policies seem to influence the level of attitudes among men and women. Despite the differences between the countries, an overall pattern emerges in which both age and gender influence people's understanding of women's paid work within and between the three countries. Finally, some implications of changing attitudes on welfare state policies for gender equality are discussed.  相似文献

Organisations are marked by contradictions: change and continuity, health and sickness, men and women, creativity and linearity, past and future and freedom and restriction are only a few poles in which these contradictions are made visible. Organisations try to give answers to these contradictions and give space for both: freedom and restriction. Here, systems and individuals are related in mutual challenge and in permanent negotiation. It is therefore important for management and employee to reflect on the preconditions for the chance of freedom and restriction. The organisation has to provide the possibility to legitimize the ‘Management of Paradox’ in order to generate answers which are necessary to guide change and contradiction.  相似文献
