A model of impacts of research partnerships in health and social services

Alliances have long been an important strategy for health promotion and community development. They are now becoming an important approach to generating research that is thought to have real-world relevance and easy applicability because of the involvement of community members. A comprehensive, dynamic model of community impacts of research partnerships in social or health services is presented. This process-oriented, systems model outlines three major domains of mid-term impact (Enhanced Knowledge, Enhanced Research Skills, and Use of Information) that correspond to the core functions of collaborative research partnerships discussed in the literature (i.e. knowledge generation, research education and training, and knowledge sharing). The model will assist research partners, intended recipients, and funders to understand and evaluate the real-world impacts of community–university research partnerships. The model provides research partnerships with a tool to demonstrate their accountability and to improve their operations and impacts, and evaluators with a tool to guide planning and evaluation efforts.

诉讼上抵销的性质研究,在我国大陆一直没有得到较多的重视,特别是在从诉讼上抵销性质的角度,来探讨民法上抵销的形成权性质和民法上抵销制度行使方式方面,更显得不足。文章正是从诉讼上抵销的实体法和程序法二重性的关系上,探讨了诉讼上抵销的民法意义。     

夏尔巴人的历史与现状调查

夏尔巴人,中尼边境地区的一个民族。北宋末年,蒙古铁骑驰骋在茫茫草原。金戈铁马荡平了大宋王朝,北方的西夏王朝也消失在历史的云烟深处,空渺无迹,不知去向,给后人留下了一个个悬念。然而尼泊尔的素伦昆布和我国西藏樟木小镇及其下属的立新和雪布岗村落,可能就是神秘的党项人后裔的归宿。从夏尔巴人的族源、风俗习惯、语言艺术、宗教信仰等方面来看,与我国的藏族极为相似,渊源于藏文化或喜马拉雅文化带民族。研究夏尔巴人不仅是对我国民族学研究的补充,更重要的是对于西部边陲的巩固稳定和中尼政治、经济、文化的交流有积极的意义。     

Altruism, ideological entrepreneurs and the non-profit firm

Ideology and altruism are central to understanding the non-profit charitable sector. This paper addresses three questions. Why do people make charitable gifts? Why do they usually give to non-profit organisations? When can non-profits run by committed ideologues compete with profit-oriented entrepreneurs in the provision of services? the altruistic motives of individuals and the ideological commitments of entrepreneurs come together to support charitable organisations. The non-profit form provides a weak guarantee that gifts are not being syphoned off as profits. Furthermore, independent non-profits can often better reflect donors' desires than public agencies constrained by majoritarian claims, and ideological entrepreneurs can use the non-profit form to reify their beliefs without being accountable to profit-seeking investors. A non-profit organisation can only survive, however, if it can attract money and customers. Sometimes its ideological character will facilitate both tasks. Non-ideological customers may, nevertheless, patronise an ideological non-profit if the entrepreneur's commitment helps to guarantee high quality.     

CASE-DELETION DIAGNOSTICS FOR TEST STATISTICS IN MULTIVARIATE REGRESSION

Influence measures in multivariate regression analysis have been widely developed, especially through use of the case-deletion approach. However, there seem to be few accounts of the influence of observations on test statistics in hypothesis testing. This paper examines four common multivariate tests, namely the Wilks' ratio, Lawley-Hotelling trace, Pillai's trace and Roy's greatest root for testing a general linear hypothesis of the regression coefficients in multivariate regression. The influence of observations is measured using the case-deletion approach. The proposed diagnostic measures, except that of Roy's greatest root, can be expressed in terms of statistics without involving the actual deletion of observations. An illustrative example is given with satisfactory results.     

合作社终止时对债权人社会责任的立法完善

公司社会责任的落实最宜采取"总则性社会责任条款"与"分则性社会责任条款"双管齐下的规制方式。但是,合作社特有的价值和原则以及合作社与政府的密切关系,不仅降低了对"总则性社会责任条款"的依赖,而且要求对"总则性社会责任条款"进行隐性技术处理,这也更突显了合作社终止时对债权人"分则性社会责任条款"的重要性。因此,应当研究社员惠顾债权和土地承包经营权出资等特别情形,探寻《农民专业合作社法》的遗漏,加快合作社破产与解散时对债权人"分则性社会责任条款"的立法完善。     

低碳经济下生态效率的困境与出路

发展低碳经济是党和国家抓住经济发展机遇和促进社会文明转型的战略选择,其实质是对生态效率的价值追求。生态效率是经济效益与环境效益的双赢,在低碳经济发展过程中既具有工具价值,又具有道德价值。生态效率不仅影响到能源效率、环境效率、资本效率和劳动生产率的发挥,还决定了经济发展的最终成败,生态效率的实现符合人类的长远利益。我国当前低碳经济下生态效率的实现还面临着思想认识偏差、公众参与缺位、技术创新瓶颈和制度供给不足等诸多困境。着力促进价值理念更新、公众参与、低碳技术创新和法律制度完善对促进生态效率的实现具有重要意义。     

新《保险法》对海上保险合同法律制度的影响

关于《海商法》和《保险法》对海上保险合同纠纷的适用,原则上应适用该法第184条解决,但本条规定的原则在对具体纠纷的适用中仍时常产生争议。文章在比较2009年修订的《保险法》的若干规定与海上保险合同相关法律制度关系的基础上,讨论了其对海上保险合同纠纷产生的影响,认为保险人以违反《海商法》规定的告知义务拒赔应以有效行使解除权为条件,《海商法》中海上航次保险合同被保险人在保险责任开始后不得解除合同的规定对保险人不适用,以及《海商法》应在《保险法》基础上补充规定第三方受害人对海上责任保险人直接请求权的限制条件。
