高校学生纪律处分行为的法律规制研究

根据我国法律规定,学校享有处分学生的权利.但是,高校处分学生行为的性质应当如何界定,处分学生应遵循什么样的原则,受处分学生不服处分决定时应怎样寻求救济,<教育法>没有做出明确规定.法律规定存在缺失,具体操作中也存在混乱,学生与学校之间的法律纠纷逐渐增多.此外,我国学界对高校学生受教育权问题的探究起步较晚,其中涉及到处分学生的问题较少.探讨高校学生纪律处分行为的法律规制问题能促进高等教育法治体制的完善.

19世纪以来,随着信用经济的兴起,所有权保留制度得到了广泛的应用。所有权保留的性质如何,直接影响当事人之间的权利与义务。关于所有权保留的性质,学术界主要有部分所有权移转说、担保权说和双重所有权说等几种观点。本文认为,所有权保留是一种附停止条件的民事法律行为。最后,本文基于对所有权保留是一种附停止条件的民事法律行为的认识,提出了所有权保留的制度设计。     

Privacy,data protection and emerging sciences and technologies: towards a common framework

Privacy is an important fundamental human right. It underpins human dignity and other values such as freedom of association and freedom of speech. However, privacy is being challenged in the networked society. The use of new technologies undermines this right because it facilitates the collection, storage, processing and combination of personal data by security agencies and businesses. This research note presents the background and agenda of the recently-commenced research project PRESCIENT, which aims at reconceptualizing the concept of privacy and developing means for the assessment of privacy impacts.

Is it All About Money? – Affective Commitment and the Difference Between Family and Non‐family Sellers in Buyouts

In this paper we investigate private equity firm perceptions of sellers’ affective deal commitment in buyout transactions. Using a sample of 174 buyouts, we test trust, goal congruence and private equity reputation as potential antecedents of perceived deal commitment. We also examine whether and how different types of sellers, family versus non‐family firms, moderate sources of perceived affective deal commitment. In sum, we find evidence that non‐financial factors play a role in buyouts, particularly for family firm sellers.     

‘We need to get together and make ourselves heard’: everyday online spaces as incubators of political action

This article examines to what extent, and how, people engaging in political talk within ‘non-political’ discussion forums – online lifestyle communities – leads to political (or personal) action or calls-to-action. The analysis is framed in the context of wider questions of citizenship, civic engagement and political mobilization. To capture everyday political talk amongst citizens requires us to move beyond the now widely analysed online spaces of formal politics. Instead, we focus on online third spaces concerning lifestyle issues such as parenting, personal finance and popular culture. Drawing on a content analysis of three popular UK-based discussion forums over the course of five years (2010–2014), we found that (for two of the three cases) such spaces were more than just talking shops. Rather they were spaces where political actions not only emerged, but where they seemed to be cultivated. Discussions embedded in the personal lives of participants often developed – through talk – into political actions aimed at government (or other) authorities. The article sheds light on the contributing factors and processes that (potentially) trigger and foster action emerging from political talk and provides insight into the mobilization potential of third spaces.     

Reevaluating the Concrete–Explanatory Animation Creation as a Digital Catalyst for Cross-Modal Cognition

This article explores the relationship between abstract and concrete as categories of knowledge and Wilensky’s (1991) theory that all ideas are abstract until they become concrete. Dewey (1910/1997) made a similar claim by suggesting that ideas are initially beyond our comprehension until they have become consolidated. This article documents the evolving mental models of 11- and 12-year-old children as they designed and made explanatory animations for the sake of their own learning. The conclusion from this research is that transferring ideas from thought to word, word to image, or transmediation of any kind, is a semiotic tool for cross-modal cognition.
