论国际民事诉讼中的"不方便法院原则"

“不方便法院原则”是缓和国际民商事管辖权的一种有效手段,因此正日益得到更多国家的关注,有关的国际公约也对此作了规定。我国至今仍没有规定“不方便法院原则”,但在实践中已出现了相关的案例。为了妥善处理管辖权的国际冲突,维护司法公正,减轻当事人和法院的负担,建议我国对“不方便法院原则”予以具体规定,以更好地体现国际礼让与协作精神,为我国的对外开放服务。     

职业选择中的心理应对及其影响因素——以Ｆ大学硕士研究生样本为例

近两年来大学毕业生就业形势日趋紧张,社会上出现了一个讨论大学毕业生就业问题的热潮。虽然参与这一讨论的声音来自方方面面,但基本上,人们关注的只有一个问题,那就是为什么大学毕业生也遇到了就业困难。在中国,由于巨大的人口基数和职业教育的滞后,劳动力市场中总是积压着大量不能适应技术性工作的“原始”劳动力,这种情况不仅出现在广大农村,也出现在城市中:国有企业的转制过程中所吐出的大量劳动力,由于未曾受过系统的职业培训,或者由于技术能力老化,只能去竞争小部分职业技术含量低下、报酬微薄的工种。与此同时,几乎所有的人都明…

Intercultural education through a bilingual children’s rights project: reflections on its possibilities and challenges with young learners

Despite the growing importance of intercultural education, literature is still lacking in related research with young learners. This study reports on a yearlong university–school collaborative research project that aimed to promote students’ intercultural competence and critical bi-literacy skills through their exploration of the issue of children’s rights. Grounded in the critical perspectives of intercultural pedagogy and dynamic bi-/multilingualism, the two collaborating Grade 3 teachers engaged their students in critical inquiry of children’s rights in both English and French. Through a range of hybrid translanguage literacy practices and experiential learning activities, students came to understand what children’s rights are and appreciate the importance of solidarity, equity, and compassion. Apart from highlighting some activities developed during this project and the impact of the activities on student participants, the study also attempts to critically reflect on some of the challenges in conducting intercultural education with young learners, in particular their emergent but conflicted understanding of other cultures. Further, the study speaks to the issue of how such an important education can be practiced in a non-reductionist and non-simplistic manner yet still be accessible to young learners.     

Women's Migration for Domestic Work and Cross‐Border Marriage in East and Southeast Asia: Reproducing Domesticity,Contesting Citizenship

This article offers an integrative review of the literature on women's migration for domestic work and cross‐border marriages in East and Southeast Asia. By bringing these two bodies of literature into dialogue, we illuminate the interconnected processes that shape two key forms of women's migration that are embedded in the reproduction of women's domesticity. We highlight structural analyses of the demographic and socio‐economic shifts that propel women's migration while also attending to the affective dimension of migrant women's desires and duties and to the brokerages that mediate the migrant flow. We finally examine how migrant wives and domestic workers contest the boundary of citizenship as they claim their full personhood against divergent modes of control over their rights, bodies, and mobility. We conclude by pointing out concrete areas where the two sets of literature can enrich each other for future research on gender, labor, and migration.     

Framing competitiveness: the advocacy of migration as an essential human resources strategy in Europe

ABSTRACT

This paper examines how competitiveness has been framed rhetorically and politically by interested actors in France, Germany, and the UK. Skilled rhetorical advocacy clothes particular political demands in the language of competitiveness and purported exigencies of the global economy, thus advancing political goals more easily that might otherwise encounter significant political opposition. In theoretical terms, the paper analyses the ideational framing of policy discourses. Empirically, the emphasis rests on exploring how governments, organised business, and business think tanks have attempted to advance demands for liberalised labour migration schemes in Europe by linking them rhetorically to the prerogative of economic competitiveness. Despite an adverse political climate, sceptical public opinion, and persistent unemployment, it has thus been politically possible to liberalise the regulation of labour migration considerably.

A Sociological Analysis of the “Strong Central,Weak Local” Pattern of Trust in Government: Based on Three Stage Tracking Data after the Wenchuan Earthquake*

Individual and community social capital have had a significant impact on the gap between trust in higher-level governments and trust in local governments. A model including data from thirty villages gathered after the Wenchuan earthquake discovered that “the size of the Spring Festival (Chinese New Year) greeting network,” “the size of the official network at/ above township level,” and “trust in fellow villagers” all had a considerable negative effect on the gap between trust in higher-level and local governments. Building individual and community social capital is conducive to establishing a balance between trust in different layers of government; individuals and communities who cooperate with each other have more channels for solving their economic and livelihood issues. Social capital can lead to a significant improvement in the effectiveness of resource matching and utilization involving governments and other sectors of society as well as increasing interaction with government. This can enhance trust in local governments and narrow the gap between trust in higher-level and local governments.
