通过对传统信赖概念的分析进而划分出对信赖的两个不同层面的理解,并对该两个不同层面的信赖所蕴涵的不同性质的利益进行讨论,克服传统观念对信赖及信赖利益的过于狭隘的理解;结合对当前社会关系及其特点的理解进一步分析信赖利益与侵权行为之间的关系;对信赖利益赔偿范围中的两个问题进行简单的讨论。     

Exploring school ethos: an investigation of children’s human rights in two secondary institutions in Hong Kong

From 2009 to 2011, the authors launched the Basic Law Education Project: Education for Human Rights and the Rule of Law in Hong Kong. This article focuses on a subset of the overarching data-set and discusses the findings that resulted from a comparative analysis of two participating schools. A survey was deployed to assess the extent to which a human rights friendly ethos existed in several institutions. Randomly selected students and all teachers from both schools were invited to participate. The collected data revealed noteworthy trends in mean scores between teachers and students in areas such as equal and fair treatment; protection of and appeal for rights; and feelings of being loved, respected, and blessed. School mission and leadership style appeared to account for significant differences. Additionally, we offer recommendations for practices that may improve human rights ethos in schools.

关于完善我国少数民族地区环境法制建设的若干设想

环境问题是人类社会共同关注的一项问题,这一问题在我国尤为突出,特别是少数民族地区,由于特殊的历史、经济、文化、风俗、习惯背景,生态环境呈现出恶化趋势。加强少数民族地区环境法制建设,运用先进的法律机制保护少数民族地区的生态环境、改善环境现状、促进少数民族地区的可持续发展显得尤为迫切。     

Feasibility Study on the Use of Probabilistic Migration Modeling in Support of Exposure Assessment from Food Contact Materials

The use of probabilistic approaches in exposure assessments of contaminants migrating from food packages is of increasing interest but the lack of concentration or migration data is often referred as a limitation. Data accounting for the variability and uncertainty that can be expected in migration, for example, due to heterogeneity in the packaging system, variation of the temperature along the distribution chain, and different time of consumption of each individual package, are required for probabilistic analysis. The objective of this work was to characterize quantitatively the uncertainty and variability in estimates of migration. A Monte Carlo simulation was applied to a typical solution of the Fick's law with given variability in the input parameters. The analysis was performed based on experimental data of a model system (migration of Irgafos 168 from polyethylene into isooctane) and illustrates how important sources of variability and uncertainty can be identified in order to refine analyses. For long migration times and controlled conditions of temperature the affinity of the migrant to the food can be the major factor determining the variability in the migration values (more than 70% of variance). In situations where both the time of consumption and temperature can vary, these factors can be responsible, respectively, for more than 60% and 20% of the variance in the migration estimates. The approach presented can be used with databases from consumption surveys to yield a true probabilistic estimate of exposure.     

The Body,the Ghetto and the Penal State

This article dissects the author’s approach to ethnography, social theory, and the politics of knowledge through a dialogue retracing his intellectual trajectory and the analytic linkages between his inquiries into embodiment, comparative urban marginality and the penal state. It draws out the practical connections and epistemological rationale behind his main research projects, explicates the distinctive ways in which he deploys observational fieldwork in each of them, and examines the roles of intellectuals in advanced society in the era of hegemonic neoliberalism. Rejecting both Humean empiricism and neo-Kantian cognitivism, the author argues for the use of ethnography as an instrument of rupture and construction, the potency of carnal knowledge, the imperative of epistemic reflexivity, and the need to expand textual genres and styles so as to better capture the taste and ache of social action. In the public sphere, he proposes that social science can act as a solvent of doxa and a beacon casting light on latent properties and unnoticed trends in social transformations so as to disrupt and broaden civic debate.     

A dynamic multiple-variety choice adaption model

The choice of a product on one purchase occasion by one consumer could be multiple varieties and influenced by past usage experience of this product. To mimic the real situation, this article proposes a new dynamic multiple-variety choice (DMC) model which incorporates quantitative and qualitative dynamics into an additive utility function. This model exhibits three major features of consumer purchase behavior: more than one variety purchased, learning behavior from use experience, and forgetting with the passage of time. All these are achieved by combining a simultaneous demand model with Bayesian learning theory embedded in an exponential function. The model is tested and validated using Hong Kong television viewing data. Empirical results show that including Bayesian learning in a multiple-choice model significantly improves model performance and prediction accuracy, and consideration of the effect of forgetting when studying learning behavior renders the Bayesian learning model much more accurate in practical application.     

Linguistic competency and citizenship: Contrasting portraits of multilingualism in the South Korean popular media1

This paper examines how metapragmatic framings of multilingual competency and incompetency have become indexes of global and South Korean citizenship in the South Korean popular media. Drawing upon depictions of multilingualism in South Korean television deurama (‘drama’), comedy skits, and popular music, it examines how the locus of modernity and cosmopolitanism is moving away from the U.S.‐oriented overseas Korean (gyopo) and towards the figure of the elite transnational returnee (saldaon saram). An Exploratory Study of Gambling Operators’ Use of Social Media and the Latent Messages Conveyed

Advertisements for gambling products have historically been restricted due to their potential to normalize gambling and contribute to excessive gambling behaviours among vulnerable populations. However, social media enables gambling operators to promote products and brands with fewer constraints than in traditional forms of media. This study investigated how social media is used by gambling operators to promote gambling activities including an analysis of the latent messages that are conveyed. A representative sample of major land-based and online gambling venues and operators, including casinos, clubs, hotels, lottery and wagering operators (n = 101), was obtained. Websites and social media profiles of gambling operators were audited to investigate the types of social media used, content of promotions, and prevalence of responsible gambling messaging. The results showed that Facebook and Twitter were the dominant platforms used, most commonly by casinos and online wagering operators. A key finding was that online gambling operators included gambling content in conjunction with related news and events, as well as unrelated content, as way of normalizing gambling within a broader social context. Unlike land-based gambling promotions, responsible gambling information tended not to feature in operators’ posts and profiles. The key messages propagated in social media gambling promotions were positively framed, and tended to encourage gambling using a range of cross-promotional tactics to emphasize the winning aspect of gambling. The implications of freely accessible and pervasive gambling promotions via social media are discussed with respect to the general community as well as vulnerable populations.
