环境侵权的微观与宏观——以《侵权责任法》为样本

<侵权责任法>关于环境污染责任的规定体现了环境时代法律的"绿化"需求,但并非完美,除了未将生态破坏行为纳入到环境侵权外,还存在着未区分环境侵权精神损害赔偿应适用何种归责原则、不承担责任和减轻责任的情形规定过于粗放以及数人环境侵权责任划分不明确等问题.因应环境议题的特殊性,制定专门的<环境侵害救济法>,全面规定环境侵害的民事救济、社会化救济、行政救济以及纠纷解决机制尤为亟需.     

The asymptotic covariance matrix of the QMLE in ARMA models

A compact analytical representation of the asymptotic covariance matrix, in terms of model parameters directly, of the quasi maximum likelihood estimator (QMLE) is derived in autoregressive moving average (ARMA) models with possible nonzero means and non-Gaussian error terms. For model parameters excluding the error variance, it is found that the Huber (1967 Huber, P. J. (1967). The behavior of maximum likelihood estimates under nonstandard conditions. Proceedings of the Fifth Berkeley Symposium on Mathematical Statistics and Probability, Volume 1, pp. 221–233. [Google Scholar]) sandwich form for the asymptotic covariance matrix degenerates into the inverse of the associated information matrix. In comparison to the existing result that involves the second moments of some auxiliary variables for the case of zero-mean ARMA models, the analytical asymptotic covariance in this article has an advantage in that it can be conveniently estimated by plugging in the estimated model parameters directly.     

《汉语大字典》专名号标注识误

《汉语大字典》引证丰富,由于编者对引用古书不熟,文意理解出现偏颇,直接导致在标点方面出现严重问题。经过十年修订,《汉语大字典》第二版对原版标点错误有所纠正,但标点问题仍然不少。现将《汉语大字典》第二版存在的专名号标注问题分作十类,列举35例进行了讨论。     

A governance network perspective on environmental conflicts in China: findings from the Dalian paraxylene conflict

Employing the Governance Network framework, this article presents an in-depth case study of the conflict that evolved from 2003 onwards over the construction and operation of a paraxylene plant in Dalian, China. The study explores the usefulness of this framework as an empirical tool to describe and make sense of policy processes and governance in multi-actor situations in China. The analysis shows the lack of anticipation and deliberation by Chinese governments, resulting in the buildup of citizens’ concerns, mediated by social media beyond government control. This results in an outbreak of protest followed by uncoordinated governmental responses, with high costs for all parties. It is argued that, because of the underlying institutional causes, the challenges are even greater for Chinese governments to come to grips with the increasing need for internal coordination, deal with new social media, and balance economic and environmental values.     

Are Overall Journal Rankings a Good Mapping for Article Quality in Specialty Fields?

Overall journal rankings, which are generated with sample articles in different research fields, are commonly used to measure the research productivity of academic economists. In this article, we investigate a growing concern in the profession that the use of the overall journal rankings to evaluate scholars’ relative research productivity may exhibit a downward bias toward researchers in some specialty fields if their respective field journals are under-ranked in the overall journals rankings. To address this concern, we constructed new journal rankings based on the intellectual influence of research in 8 specialty fields using a sample consisting of 26,401 articles published across 60 economics journals from 1998 to 2007. We made various comparisons between the newly constructed journal rankings in specialty fields and the traditional overall journal ranking. Our results show that the overall journal ranking provides a considerably good mapping for the article quality in specialty fields.
