从章公祖师佛像跨国追索诉讼主体资格问题切入,分析佛像的法律性质,探讨涉案物权准据法的确定及适用问题。该案原告应由阳春村全体村民担任。涉案佛像属于文物,建议村民在荷兰法院提起原物返还之诉。受案法院应当适用物权冲突法确定准据法,即可能适用中国内地、中国香港或荷兰法律。被告在购买时应当对涉案佛像来源产生合理怀疑,因此不构成“善意”;原告应尽可能搜集证据证明《荷兰民法典》规定的20年消灭时效因起诉而中断。依据《香港货品售卖条例》和中国内地物权法理论与实践,被告均不能取得系争佛像的所有权。  相似文献

This paper addresses no-wait or no-idle flow shop scheduling problems with deteriorating jobs, i.e., jobs whose processing times are an increasing function of their starting time. A simple linear deterioration function is assumed and some dominating relationships between machines can be satisfied. It is shown that for the problems to minimize makespan or weighted sum of completion time, polynomial algorithms still exist, although these problems are more complicated than the classical ones. When the objective is to minimize maximum lateness or maximum tardiness, the solutions of a classical version may not hold.  相似文献

Project control has been a research topic since decades that attracts both academics and practitioners. Project control systems indicate the direction of change in preliminary planning variables compared with actual performance. In case their current project performance deviates from the planned performance, a warning is indicated by the system in order to take corrective actions.Earned value management/earned schedule (EVM/ES) systems have played a central role in project control, and provide straightforward key performance metrics that measure the deviations between planned and actual performance in terms of time and cost. In this paper, a new statistical project control procedure sets tolerance limits to improve the discriminative power between progress situations that are either statistically likely or less likely to occur under the project baseline schedule. In this research, the tolerance limits are derived from subjective estimates for the activity durations of the project. Using the existing and commonly known EVM/ES metrics, the resulting project control charts will have an improved ability to trigger actions when variation in a project׳s progress exceeds certain predefined thresholdsA computational experiment has been set up to test the ability of these statistical project control charts to discriminate between variations that are either acceptable or unacceptable in the duration of the individual activities. The computational experiments compare the use of statistical tolerance limits with traditional earned value management thresholds and validate their power to report warning signals when projects tend to deviate significantly from the baseline schedule.  相似文献

In this paper, a simulation experiment has been developed to examine the combined influence of the design, inventory and environmental factors on the cost performance of a rolling horizon master production schedule. Specifically, a 2 5 factorial design was used to examine the effects associated with three rolling schedule design policies, one inventory policy and one environmental condition of forecast error on MPS cost performance. The study was based on actual data from a paint company. Results suggest that the choice of appropriate lot-size and inventory policies have a significant influence on MPS costs and that there are indeed important interactions between these policies and other design factors of a rolling schedule.  相似文献

This paper provides an excursion into various scheduling problems arising in the manufacturing environment and possible approaches that can be taken to solve them. It reviews the research in production scheduling from the perspective of designing and operating a production system and examines the research strategies adopted to find the solution of the practical problems. This review is in the form of the paradigms that evolved during the twentieth century and shows the transition in theory and practice of each paradigm. It covers the fundamental frameworks of scheduling theory, outlining various approaches that can be taken to solve (optimally or approximately) such problems, and the difficulties arising in their practical use. Subsequently, an iterative scheduling process is suggested as an extension of existing paradigms to solve practical production scheduling problems and to bridge the gap between theory and practice in production scheduling and control.  相似文献

A two-phase approach is used to examine the impact of job scheduling rules and tool selection policies for a dynamic job shop system in a tool-shared, flexible manufacturing environment. The first phase develops a generalized simulation model and analyses 'simple' job scheduling rules and tool selection policies under various operating scenarios. The results from this investigation are then used to develop and analyse various bi-criteria rules in the second phase of this study. The results show that the scheduling rules have the most significant impact on system performance, particularly at high shop load levels. Tool selection policies affect some of the performance measures, most notably, proportion of tardy jobs, to a lesser degree. Higher machine utilizations can be obtained at higher tool duplication levels but at the expense of increased tooling costs and lower tool utilization. The results also show that using different processing time distributions may have a significant impact on shop performance.  相似文献
