作为一种就业新路,劳务派遣涉及复杂的法律关系,从而以规范传统劳动关系为基础的劳动法规无法对劳务派遣所产生的诸多法律问题予以完整的规范,致使劳动者在劳务派遣过程中权益屡受侵害。基于当前劳动合同法的起草,提出一些完善劳务派遣制度的建议,希望能促使社会各界的重视。

论刑事诉讼立案程序的功能

刑事诉讼立案程序应当具有输入功能、过滤功能、分流功能和保护功能。然而,我国刑事诉讼立案程序过于扩张了过滤功能,导致其输入功能比较差。分流功能仅仅从不追诉方向上起作用,在一定程度上与过滤功能相重合,不具备真正意义上的分流作用。因此,有必要从功能论的角度审视我国刑事诉讼立案程序。     

我国民事立案审查程序之完善 ——基于实证的功能分析

对我国沿海地区和中部地区某法院的民商事立案审查进行调研,结果显示:民事立案审查制度的实践功能与预期功能存在一定程度的背离.虽然不予受理的民商事案件在总受理的案件中所占比率较低,但以权力为中心的立案审查程序,反映了法院对审判利益的考虑超过了对当事人诉讼权利的关怀.为了平衡和制约法院的立案权力,应当立足我国现实条件,构造一个权力技术和权利技术兼容并蓄的,具有开放性的立案审查程序.     

Pushing the Boundaries of the Social Work Practicum: Rethinking Sites and Supervision Toward Radical Practice

This article challenges the profession's accreditation requirement that social work field placements must have a social worker as supervisor. The author argues that the profession's stated commitment to social and economic justice can best be served if the profession broadens the definition of what constitutes good social work practicum supervision. With support from schools of social work, people in our communities from different disciplines and backgrounds engaged in progressive justice work, can provide social work students with valuable experiences and in turn enrich the social work curriculum.

Recent changes in accreditation standards now require professors to systematically assess whether a teacher candidate actually possesses a “disposition” appropriate to the profession. This new mandate from accreditation bodies is controversial on a number of fronts. As social studies educators in particular, we like to think of ourselves as especially attentive to issues such as individual differences and rights, indoctrination, prejudice, intolerance, freedom of expression, maturation, and the worth of the individual—all of which are potentially raised by the NCATE and NCSS mandates. And as a practical matter, it places new stresses on the role of professors as both mentors and gatekeepers. In this article, two social studies teacher educators provide an overview of current theory and debate regarding dispositions, an assessment of practical problems associated with the accreditation accountability mandates, and—in spite of the persistent problems associated with defining and assessing dispositions—offer one successful model for evaluating teacher candidates’ professional dispositions that has been implemented in a social studies education program.
