论及商标平行进口,学者普遍引用权利用尽理论探讨商标平行进口是否具有合法性。从商标与无形财产和其他知识产权的区别来看,仅依权利用尽理论解释商标平行进口是否具有合法性就会略显片面。从商标的功能、商标专用权的法律性质等多重角度出发,为商标平行进口定性应该会更全面、客观。同时,在区域贸易协定框架下对商标平行进口进行协调,权利的互惠用尽或许将会成为可行的方案。  相似文献

利用2010年8月对贵阳市1 518份60岁及以上老年人的调查数据,分析了老年人在经济支持、医疗保健、生活照料、精神慰藉、社会交往和居住安排6个方面生活需求的满足状况,并将它们作为老年人生活满意度的影响因素纳入多元回归分析模型,分析结果发现:经济支持的满足程度是影响老年人生活满意度的最强变量,居住安排没有影响,其他4个方面的影响强度依次是:生活照料、医疗保健、社会交往、精神慰藉。从城乡来看,经济支持的满足程度是影响城镇老年人生活满意度的最强变量,但影响农村老年人生活满意度最强的变量则是生活照料。  相似文献

借助精神现象学相关理论,考察当下中国老年人群体可以发现,经历了剧烈社会转型的这一群体有着独特而复杂的精神特征与心理体验,主要表现为对生命意义的惶惑、对死亡临近的恐惧、应对心理情绪的调适危机等。从哲学视角解读老年人主体性的衰落、实践性的被遮蔽、社会性的沉寂以及历史性的消解等精神现象,研究由此产生的失落感、冷漠感、孤独感与保守性等心理情绪,有利于理解老年人的行为方式与真实需求,有助于深层次探索老年人的精神世界。  相似文献

本文对当前我国农村出现的打工青年的"闪婚"与"跨省婚姻"两种婚恋模式的现状、发展、基本特征进行了比较,并从婚恋选择中的利益相关主体的角度对两种婚姻模式的发生机制进行了分析。研究发现,闪婚与跨省婚姻作为中国城市化进程中大量农民工选择的婚恋模式,有逐步增加的趋势,两者的基本特征既有差异也有共性。而从其发生机制来说,闪婚与跨省婚姻都彰显了打工青年面临的结构性婚姻选择困境,以及代际之间、性别之间对于婚姻意义中的情感性与功能性的偏重有所差异。婚姻中的情感性与功能性的权衡型塑了打工青年在"闪婚"与"跨省婚姻"之间选择的钟摆现象。当下,应当重塑婚姻本身所应该具有的情感性与功能性的双重价值意义,对打工青年进行适当的引导以减少这两种婚恋模式所带来的负面效应。  相似文献

This study explores the relationships between the levels of conflict that social workers experience when interfacing with managed care organizations and outcome variables including job satisfaction, organizational commitment, emotional exhaustion, and turnover intentions. A total of 591 social workers practicing in mental health agencies in New York State completed self-administered and anonymous questionnaire packets that included several measures: Level of conflict that workers experience when interfacing with managed care organizations (CMC), job satisfaction, organizational commitment, emotional exhaustion, and turnover intentions. Results showed that CMC had statistically significant correlations with organizational commitment and with emotional exhaustion. The author discusses the role of social work schools and agencies in offering new educational opportunities and training in order to improve workers' skills, which are necessary for communicating and negotiating with managed care organizations.  相似文献

ABSTRACT

This research investigates the impact of emotional intelligence on counterproductive work behavior through examining the mediating role of organizational climate. Data were collected from 304 administrative employees working in nine private universities in Amman, Jordan. Validity and reliability tests were conducted using factor analysis and Cronbach’s alpha. Research hypotheses were tested through multiple regression analysis and structural equation modeling methods. Outcomes of the analysis indicate that there is a significant impact on the relationship between emotional intelligence and counterproductive work behavior. The research proposes several recommendations for managers to apply specifically in private universities, and/or in any type of sector in Amman- Jordan. It also laid the groundwork for future research.  相似文献

This article presents the findings of a qualitative study in a Flemish centre for children and adolescents with emotional and behavioural disorders. The aim of this study was twofold. First, we wanted to examine how youth reflect on their own behaviour and that of their peers'. Secondly, we wanted to know what, according to the youth, are the most significant helpful elements of treatment. Analysis shows a continuum of negative behaviour, ranging from relatively ‘normal’ disruptive behaviour such as arguing, up to serious disruptive behaviour such as physical aggression. This behaviour has a negative influence on the climate of the organization. ‘Availability of staff’, ‘nearness of staff’, ‘a clear set of rules and boundaries’, and ‘some time on my own/some alone time’ are perceived as helpful elements of treatment. ‘Strictness’, ‘not listening’, and ‘inappropriate staff attitudes and interventions’ are perceived as counterproductive elements of treatment. Results are discussed and recommendations both on the orthopedagogical as well as on the scientific level are formulated.  相似文献

The need for social workers to be resilient is widely emphasised. Although enhancing resilience in social work trainees presents a challenge to educators, they are nonetheless responsible for developing professionals who are able to cope with the emotional demands of the job. This paper argues that building resilience in the future workforce should be a key element of social work education. However, as little is known about the competencies and support structures that underpin resilience or the extent to which resilience protects the wellbeing of trainees, an evidence-based approach is required to inform curriculum development.

Recent research conducted by the authors of this paper has highlighted the protective nature of resilience in social work trainees. Emotional intelligence and associated competencies, such as reflective ability, aspects of empathy and social confidence, were found to be key predictors of this important quality. The important role played by social support from various sources was also emphasised. The present paper summarises this research, and presents interventions based on the findings that have the potential to promote resilience and wellbeing in social work trainees. Also considered are ways in which the curriculum might be further enhanced to provide trainees with an internal ‘tool-box’ of strategies that will help them manage their wellbeing more effectively in their future career.  相似文献
