要在企业并购中使劳动者的劳动权得到实质保护,在企业并购过程中对劳动者劳动权的全而综合保护体系。权保护的程度和范围,规制并购中用人单位的基本行为,必须强化国家权力,从立法、行政、司法三个层面构建翻家通过法律法规的制定,确定在企业并购过程中劳动对留用劳动者与并购后的新企业之间的权利义务作出相应规定。发挥政府在企业并购过程中保护劳动莆劳动权的行政职能,加大对企业并购过程中违规企业的处罚力度,健全和完善在食业并购过程中以保障劳动者劳动权为核心的市场规则和公共政策。劳动者在企业并购过程进行权利救济的司法实践中面临程序复杂、维权成奉高、案件执行难等问题,需要通过建立劳动法庭或劳动法院等途径予以解决,同时赋予法院监督审查权。 相似文献

Ethics is a central area for professional education in social work. The main educational strategies for the ethics component in social work programmes are often a combination of explicit attention to principles and implicit grounding in practice examples (such as ‘case study’ vignettes). These approaches equip students to recognise and respond to the complexities of ethics in practice. However, they may also encourage students to understand ethics as ‘rules of conduct’, in which there are ‘correct answers’ that can be learned and applied. This paper advances the view that it is more helpful to consider ethics as a ‘framework for thinking’ about the means/ends relationship in practice. It is argued that, as a consequence, the goal of ethics education should be to enable student social workers to grasp the inherently moral nature of practice and the ambiguities that follow from this. Such a position points to the paradox of social work education, that it involves teaching about things that cannot ‘exist’ separately from their being created in action. To explore this paradox in teaching ethics, the paper considers inductive approaches in learning as a way of responding to the ambiguities that are inherent not only in the subject but also in the experience of professional education. 相似文献

Transnational protests often involve a cross‐cultural encounter between “foreign” protesters and the local media and public, whose repertoires of contentious practices and discourses may differ. Examining how transnational and local actors interact in these events is one way to understand the significance and impact of transnational activism. At the same time, local media coverage of transnational protests can also be analyzed as such a cross‐cultural encounter. Following these premises, this article examines Hong Kong media coverage of the transnational protests during the World Trade Organization's 6th Ministerial Conference, which was held in the city in December 2005. The analysis focuses particularly on how this non‐routine news event provided the conditions for a more reflective interactive dynamics between the protesters and journalists, which contributed to emergence of media discourses negotiating and redefining the existing cultural understanding of protest actions. However, the case study also shows the limits regarding how far the redefinition and negotiation can go. Theoretical implications of the analysis are discussed. 相似文献

Abstract. The asymptotic behaviour of several goodness-of-fit statistics for copula families is obtained under contiguous alternatives. Many comparisons between a Cramér–von Mises functional of the empirical copula process and new moment-based goodness-of-fit statistics are made by considering their associated asymptotic local power curves. It is shown that the choice of the estimator for the unknown parameter can have a significant influence on the power of the Cramér–von Mises test and that some of the moment-based statistics can provide simple and efficient goodness-of-fit methods. 相似文献

This paper discusses the geography of parental choice in a rural locale and shows how a group of parents negotiated their way through the process of primary school choice. Using ethnographic data collected through interviews and observations with parents and staff from three rural primary schools in England, the research utilises Bourdieu's concepts of capital, habitus and field to show how the resources and values the parents held affected the school choices they made. The paper demonstrates that the longer-term resident local parents were influenced not only by their cultural capital but also by familial ties and an emotional commitment to the rural locale and these parents were therefore more inclined to support their local school. In contrast, the more recent newcomer parents used their cultural capital and spatial power to shop around to find what they believed to be the ‘right’ school. The paper argues that the newcomer parents had less allegiance to place and hence to the symbolic position that the school holds within the rural community within which they lived. 相似文献
