对完善我国商业秘密保护立法的思考

随着商业秘密在市场竞争中的作用日趋凸显,各国对商业秘密保护的程度越来越高,范围也越来越广。为此我国应尽快出台《商业秘密保护法》,以弥补现有法律对商业秘密保护的不足,并提出了其方法中应重点解决的若干问题。     

AMTI雷达平台运动补偿

AMTI 雷达中,由于平台运动,地面固定杂波平均多普勒频率平移及杂波谱展宽,造成两相邻脉冲回波间产生一相位超前。本文对这种平台运动效应进行了分析,提出了一种采用自适应方法产生校正信号,对回波平台运动效应进行了补偿。这种补偿不局限于每次两个脉冲之间,而可适用于多个脉冲,从而为 MTI 处理提供了方便。还获得了有、无补偿的一次对消处理结果。     

精神损害赔偿制度应对未成年人及胎儿有更加细化、完善的保护

以最高法院的司法解释为基础 ,我国精神损害赔偿制度已经基本确立。这标志着我国法律体系的一大进步。但这一制度仍需完善和补充 ,尤其是对未成人和胎儿的保护还需加强 ,应和监护制度相协调衔接     

刑事被害人国家补偿制度之理论探微

作为刑事被害人国家补偿制度的传统理论依据,“国家责任论”具有合理成分但有失偏颇;“社会福利论”符合现实要求但有失公平;“命运论”符合客观规律但有悖情理。在均衡保障人权理念日益彰显的当今时代,有必要将其导入刑事被害人国家补偿制度理论体系,使刑事被害人之人权保障不再成为“被遗忘的角落”。     

虚假陈述证券民事赔偿中的因果关系

“市场欺诈理论”是虚假陈述证券民事赔偿因果关系认定的理论基础。在虚假陈述与投资损失之间因果关系的认定问题上 ,采用”市场欺诈理论”和“推定信赖原则”可以减轻原告的举证责任。但如果不考虑在虚假陈述揭露日或更正日之前卖出证券所导致的投资损失与虚假陈述之间的因果关系 ,也不考虑诱空虚假陈述与投资损失之间的因果关系 ,将使部分实际受到损失的投资者得不到法律救济。     

野生动物致害的国家补偿及其法制完善

我国现行野生动物致害补偿的法律制度存在严重的缺陷和不足,既不利于弥补受害人的损失,也不利于对野生动物的保护。因此,必须尽快完善相关的法律制度,促进野生动物的有效保护以及人与动物的和谐相处。     

Graphical solutions for structural regression assist errors-in-variables modelling

Structural regression attempts to reveal an underlying relationship by compensating for errors in the variables. Ordinary least-squares regression has an entirely different purpose and provides a relationship between error-included variables. Structural model solutions, also known as the errors-in-variables and measurement-error solutions, use various inputs such as the error-variance ratio and x-error variance. This paper proposes that more accurate structural line gradient (coefficient) solutions will result from using the several solutions together as a system of equations. The known data scatter, as measured by the correlation coefficient, should always be used in choosing legitimate combinations of x- and y-error terms. However, this is difficult using equations. Chart solutions are presented to assist users to understand the structural regression process, to observe the correlation coefficient constraint, to assess the impact of their error estimates and, therefore, to provide better quality estimates of the structural regression gradient.

Negotiated Compensation for Solid-Waste Disposal Facility Siting: An Analysis of the Wisconsin Experience

Since enacting a unique facility siting law in 1981, Wisconsin has had unusual success in siting solid-waste management facilities. The law mandates a state-level technical review and licensing process and a local-level negotiation/arbitration process that deals with host community impacts and concerns. Data from the negotiated compensation agreements, a survey of facility proposers, and secondary data for the host communities are analyzed in relation to compensation levels. Concerns with community image and health risks and with facility management and equity issues are found to significantly and substantially increase negotiated compensation levels. In contrast, a focus on logistics and transportation concerns is associated with lower levels of compensation. Compensation increases with facility capacity but at a less than proportional rate. Higher levels of compensation are obtained by communities that accept compensation "in kind" in the form of free or reduced fees for host community waste disposal.
