多元法律文化互动的多元透视

传统的比较法研究仅仅注重对不同法律文化的比较 ,而未能关注不同法律文化的互动问题。在当今世界 ,多元法律文化的互动是一个正在改变世界法律文化格局、影响各国法律发展走向的基本现象。从功能论的角度透视 ,多元法律文化的互动表现为功能上的比较和竞争。互动法则是优胜劣汰 ,即功能好者、强者得势 ,功能差者、弱者淘汰。从解释学的角度透视 ,多元法律文化的互动表现为不同法律文化意义系统的互相解释、互相渗透、互相融合。互动的结果不是一方取代另一方 ,而是双方都被对方所改变 ,渐次达到互相融合。从冲突论的角度透视 ,法律文化的冲突不过是不同社会群体、阶级或阶层之间的社会冲突的一方面。一种法律文化在冲突中处于何种地位 ,取决于法律文化的倡导者在整个社会的冲突中处于何种地位     

Assessing NGO Empowerment in Housing Development Frameworks: Discourse and Practice in the Philippines

Amid the rise of democratization movements since the 1980s, many governments in developing countries have proactively introduced the ideas of decentralization and devolution into the policy arena. In the pursuit of democratic planning processes where civil society is encouraged to be a part of the formal decision-making system, articles advocating the empowerment of non-governmental organizations (NGOs) have been included into a series of legislations. This shift was soon reflected in housing development frameworks for the poor, leading to the formulation of a new approach called "enablement." The Philippines' experience for the last two decades follows this line of development. Filipino NGOs are now prescribed as a catalyst to add further dynamism to the improvement of substandard living environments. Empirical findings of this study exemplify that NGO empowerment has been increasingly accelerated by the combination of NGOs' self-endeavors and governments' initiatives. By utilizing the paradigm shift under the enablement approach, NGOs are engaged in the attempt of alliance-formation and network-building to expand their influence. Contrary to ideals, however, NGO empowerment may reveal some adverse effects such as excessive dependency on NGOs and distorted representation by NGOs. Moreover, the professionalization of NGOs is an additional factor which generates hierarchization at the grass-roots level. This study suggests that further research analyze the depth and width to which NGO empowerment has been penetrated in order to precisely capture the processes and consequences resulting in disempowerment.

法谚:法律生活道理与经验的民间形态——汉语谚语的法文化分析

法谚是生成并通行于大众中的有关法律的民间用语形态,属于俗文化范畴。在文化或观念的传承上,法谚比同属俗语的歇后语、惯用语要深入或深刻,比雅语的成语要细微。法谚之民间形态的根基,是大众法律生活道理与经验的总结和传授的需要。法谚所反映的法律生活的范围是比较宽广而全面的,囊括了当时社会法律生活的基本领域和主要的法律现象。法谚与法律的关系密切。它们基本上渊源于法律的规定、原则和精神,至少是与其密切相关。法谚与其他谚语关联甚紧,后者对其起支撑、加固或强化作用;法谚有时也衍化为外围谚语,进一步表达一种日常生活道理或经验。从法学、语言学、文化学、历史学的学科交叉角度,对法谚进行研究是有重要意义的。     

大学的文化和大学的管理

该文分析了中国大学的基本特征,认为中国现代意义的大学起步晚,发育先天不足,教育模式是多国教育模式的混合型,至今还未能形成稳定的教育传统和教育模式,中国大学的特色是“学校加社区”结构,具有办学机构和社区管理的双重属性。从此出发,文章探讨了我们需要构建什么样的大学精神和需要什么样的大学管理体制,指出以先进的办学理念、科学的制度规范、鲜明的传统特色作为评价大学文化建设水平的重要标准,正是中国大学现代化努力追求的目标。

潮汕地区位于广东省东部，是中国著名的侨乡。东南亚潮人在东南亚经济和潮汕地区发展中发挥越来越大的影响。总结和分析东南亚潮人的文化特点，使不同的文化传统和经济利益变成经济文化上的合作，对推动东南亚及潮汕地区的经济发展具有重大意义。

Fragments of Modernization: Domestic Spaces Indicating Traditional Dialects in a Modern Speech

This article examines the change in Turkish domestic space through modernization and, in particular, the artifact of lace, as a nonchanging object in Turkish home in its relationship with the “traditional” and the “modern” domestic settings. Thereby it investigates how traditional and modern settings are defined in Turkish society and, this leads to a further analysis of the modernization process in Turkey within the scope of Turkish house and its domestic settings. The aim of the article is to analyze lace as an agent, which is an actant of the change in domestic settings, to read the connection between the daily life of people and social lives of artifacts. Therefore, examining the dialogue of lace with traditional and modern domestic settings provides to deconstruct the network of the artifact, the house and the individual during the modernization process that Turkish society has been through. The theoretical perspective of the article relies on a material‐semiotic approach with an emphasis on Latour's Actor‐Network Theory and, the methodology of the article is based on ethnography: It includes observations and semi‐structured interviews conducted with people from different social environments focusing on the meaning and the use of lace in domestic environment.     

传统节日文化生存发展策略——写在传统节日法定化之后

当前,中国传统节日文化要得以生存与发展,有三个方面的工作是紧迫和重要的:提升对传统节日的"文化自觉",这是中国传统节日文化的生存之本,这方面媒体、学校教育、家庭、社区均有着重要的责任;重建传统节日的符号体系,在这方面,企业、商家和政府肩负着重要的使命;转换传统节日的参与模式,将封闭型的"血缘共同体参与模式"转换为适应现代生活的开放型的"业缘共同体参与模式",这对中国传统节日文化的生存与发展有着现实而又长远的意义,这方面,各类社会组织起着重要的作用.
