从一些金融衍生交易较发达的国家的场外金融衍生品监管理论和实践来看,对于场外衍生品的监管,呈现以场外衍生品监管方式场内化为主,并伴随着场外与场内监管方式融合为辅的发展趋势。场外金融衍生品监管场内化趋势又以场内化的中央对手方结算为主,兼采提高场外衍生品合约的标准化和交易的透明度来降低场外衍生品交易风险的监管目的。

Ethical and Regulatory Challenges in Psychophysiology and Neuroscience-Based Technology for Determining Behavior

In the past three decades, there has been an explosion in research to understand the mechanisms of brain function. Recent advances in psychophysiology and neuroscience, while still limited, have sparked great interest in developing technologies that could peer into the brain and be used to identify or indicate certain behaviors. The polygraph (lie detector) represents an old technology used for discerning clues to the human brain; functional magnetic resonance imaging (fMRI) represents one of the newest efforts. The use of these technologies in intelligence and counterintelligence in the field without validation represents a major concern about its usefulness. Both research on this new technology and subsequent use on public raise ethical challenges. This article will address the overall ethical issues associated with these new technologies. The report identifies the ethical and cultural challenges in conducting research on these new tools, explores the possibility of using current U.S. regulatory requirements regarding drugs and devices as a model for regulating these new technologies, and suggests approaches for the future.

经典辨伪学"辑佚"的方法论"范式",本身即不无问题。孙志祖于此未察,转而将此法用之于《孔子家语》的辨伪,将先秦、两汉古书之间常见的"互见"现象认定为造作之迹,既昧于古书体例,也反映了经典辨伪学"范式"扩大化的弊病。先秦、两汉古书之间的"互见"乃古书之常例,故每每溢出辨伪学的惯常逻辑,这既昭示经典辨伪学的"限度"问题,也凸显目下古书体例及古书成书研究对于经典辨伪学方法论革新之重要意义。     

对教师虐童行为刑法规制的思考

立法对于教师虐童行为存在界定模糊与刑法缺位的不足。将未造成轻伤的教师虐童等虐待行为入罪可以选择扩大虐待罪的主体与对象的方式,列举虐待儿童的行为,将虐待儿童构罪设为公诉罪名。对于教师虐童行为的有效防控,刑法的规制存在有限性,必须通过改变观念、增强权利意识、加强师资与民间组织的建设、严格执行相关部门法等综合治理的方式来进行。     

从全媒体发展困境看陕西报业的新闻改革--以陕西主要党报和都市报为例

在网络日益兴盛、影响力和受众急剧膨胀的新媒体时代,传统报纸的生存空间被一再压缩,受到了前所未有的冲击。本文对这一媒介环境下陕西五大报纸全媒体发展的困境进行了调查研究,指出盲目的从众、依赖新媒体并非报纸媒体发展的神丹妙药;并提出报业发展的未来趋势核心在于提升新闻品质,进行新闻改革,以内容立足,打破藩篱,赢得发展。报纸在新媒体时代应该做优秀的"信源",在与新媒体的竞争和融合中走出真正的持续发展之路。     

媒介演进中的价值观引导：历史嬗变与当代审思

价值观的形成与发展离不开具体的媒介环境。文章从媒介的演进考察各时期价值观引导的特征,并认为,由媒介的变革引发了价值观引导的变迁,其积极的影响表现为公共媒介的公共文化传播、从媒介主体到自我主体的证验和从面对媒介到面对人的回归,其消极的影响表现为持久与扩张的错位、去中心化以及价值观的“看”僭越了价值观的“读”。由此,文章认为,在当代媒介环境下价值观的引导应当加强媒介素养教育和媒介规制,培养读与思、听与说的书面、口语传统习惯。     

Emotion in strategic management: A review and future research agenda

Emotion in strategic management has attracted increasing scholarly interest during the past twenty-five years. Researchers have demonstrated the nature and significance of emotion in strategic management from a broad range of perspectives across different levels of analysis. Given the expanding research on the topic, the time is ripe to synthesize this diverse and multifaceted body of knowledge. In a thematic synthesis of the literature, we address the following questions: how does emotion influence strategic management, and how can the field be further developed? We review emotion constructs used in the extant literature and identify three themes related to how emotions influence strategic management: the nonconscious influence of emotions, emotion regulation, and collective emotions. Based on these themes and our analysis, we propose three areas of future research to inspire the field to develop further: (1) scope conditions of emotion research in strategic management; (2) capturing emotion in strategic management; and (3) the ethics, power and politics of emotions in strategic management.     

基于多种污染物损害视角的地方政府间环境规制合作策略研究

考虑多种(非累积性和累积性)污染物对环境造成不同损害的前提下,首先基于Stackelberg博弈分析占主导的地方政府和跟随的工业企业各自的动态决策过程,确定工业企业的最优污染物排放量;随后运用最优控制理论构建两个相邻地区在非合作和合作博弈下关于跨界污染最优控制的博弈模型,分析地方政府的环境治理策略,包括最优的环境保护税、污染治理投资,探讨污染物存量的动态变化情况,并对此两种博弈结构进行了比较分析。理论及仿真分析表明：无论地区间是非合作还是合作博弈,工业企业的最优污染物排放量与其污染物减排比例的相关性不确定;每个地区的最优环境保护税与污染物减排比例呈正相关。但合作博弈下,每个地区均会考虑其非累积性污染物排放对其相邻地区造成的损害;每个地区均会增加污染治理投资;所有地区的总收益高于非合作博弈下,且高出部分(合作剩余)受累积性污染物的损害以及非累积性污染物对相邻地区损害的影响,但是与非累积性污染物对本地区的损害无关。
