论我国物权制度在房屋双重买卖中对买受人的保护

不动产物权变动的两个环节之间存在“时间差”,为房屋双重买卖的产生提供了可能。在房屋双重买卖中,三方当事人形成的法律关系十分复杂。从交易环节来看,我国房屋双重买卖大致可划分为三种情形。基于“公示要件主义”的物权公示制度是解决此类纠纷,平衡各买受人间利益的根本法律手段。因此,一是有必要澄清来自“公示对抗主义”的曲解,承认“物权行为”并吸收“分离原则”,充实我国的“物权公示”制度。二是通过比较“不动产契约公证”制度和“预告登记”制度的优劣,在不动产登记制度中设立“预告登记”制度。     

Income and Life Satisfaction After Marital Disruption in Germany

Divorce in Germany and in many other countries is often instigated by the wife, even though marital disruption has much more negative economic consequences for women than for men. Both observations, however, are not necessarily a contradiction. Women may gain something that makes up for the economic loss. On the one hand, using data on income and (general) life satisfaction from the German Socio‐Economic Panel Study, this article shows that negative economic changes, as measured by data on household income, are real in the sense that they are reflected in subjective assessments of economic well‐being. On the other hand, these changes are relative because other aspects of life improve after marriage dissolution, and this is especially true for women.     

Sharing roles,sharing custody? Couples’ characteristics and children's living arrangements at separation

This article examines children's living arrangements when parents separate, during a period of rapid increase in shared physical custody in the 1990s. With prospective data from the National Longitudinal Survey of Children and Youth (N= 758 families) and a sample of families experiencing parental separation between successive survey cycles, we use multinomial logistic regression techniques to explore how characteristics of parents in intact families (mother's employment, income, and so on) influence physical custody outcomes at separation. Findings indicate that although the way couples share roles while living together has a strong influence on how they divide responsibilities when they separate, other factors also have important roles to play.

基于不同人性的县级电力辅业员工激励机制研究

文章基于以美国管理心理学家Edgar H.Schein为代表的复杂人假设,对我国部分县级电力辅业进行了调查研究,首先分析了我国县级电力辅业员工结构水平及管理方式中存在的问题。继而在分层次激励、制定新型的薪酬机制、使低层次追求的员工向高层次转变、营造上下级关系等四个方面提出了一些建立我国县级电力辅业员工激励机制的建议。

针对食品生物化学课的实际情况,提出了开设综合设计性实验的思路,初步给出了木瓜蛋白酶分离纯化实验的内容,旨在为今后的实验提供理论指导.     

藏词格探析

藏词是汉魏时代才出现的一种修辞格。从语义的如何表示上看 ,藏词分为三类 :一、取用部分表示隐藏部分的意义 ,二、取用部分表示整个语句的原来意义 ,三、取用部分表示整个语句的推演意义或相关意义。藏词格与借代格不同 :借代格甲、乙两方必然有其内在联系 ,是逻辑理念的表现 ;而藏词格甲、乙两方没有内在联系 ,是文字技巧的表现。藏词格所取用的部分多半只是悖语义或悖语法的音节组合。     

Network contact changes in early and later postseparation years

This study explains changes in contact frequency in relationships of the preseparation personal network in the early and later years after partners separate. The explanation includes general and separation-related characteristics of the network relationship and the individual. Personal interviews were conducted in three waves of a 12-year longitudinal study with 40 men and 64 women who separated in 1987 or 1988. Multilevel analyses on 1639 network ties showed that multiplex and kin relationships remained over the long term. Contact changes depended on network relationship characteristics, structural conditions, perceived restrictions, and alternative network relationships. Separation-related characteristics were more important in the early years, general characteristics in the later years after the separation.     

司法能动主义的语境和语义考察——基于美国司法史的梳理

司法能动主义发源自美国,肇端于违宪审查,它是普通法制度背景下的一种司法理念和司法形态。纵观美国两百多年司法史,司法能动主义与司法克制主义此消彼长,交替发展。美国（及西方类似国家）的政治体制和司法制度是讨论司法能动主义不可脱离的固有语境。忽视或脱离这个语境,肯定会或多或少地偏离它的本意。同时,司法能动主义不仅是一个可以多角度认识、多层面解读的多义性概念,而且表现出动态发展和不断丰富的开放性特质。     

对深化教育职称改革的思考

教育职称是目前我国教育人力资源配置过程中的主要识别标志,但由于职称评定过程中的诸多不合理因素,影响了评价的客观性和科学性,因而有必要进行大刀阔斧的改革,包括取消指标限制,实行评聘分离,建立动态的职称管理制度等。
