北京律协对李天一案六位律师的处分唤起了法学界对律师庭外言论问题的探讨,全国律协的两个修订草案更是将这一问题推向风口浪尖。作为一种辩护策略,律师的庭外言论可以分为控辩对抗模式和辩审对抗模式,前者主要围绕案件的实体问题,后者更加侧重案件的程序问题。这两种模式的形成是中国司法语境的特定产物。对于控辩对抗模式,原则上应当禁止其庭外言论,通过诉讼化的方式将其纳入庭审对抗的范围,对于违规的律师通过行业自治予以处分;对于辩审对抗模式,若满足三个维度的约束,可以在一定程度上允许律师发表庭外言论寻求救济。  相似文献

This paper argues that at a time when policy guidance urged closer collaboration and joint working between health and social services, the long-established cultural and professional gaps were widening and deteriorating. Drawing on data from four research sites, the paper argues that the deterioration was rooted principally in practitioners' preoccupations with changes within their own organizations and daily work, resulting from a major period of change in both health and social services, which, ironically, was at the expense of the joint working which the "Caring for People" reforms required. As the policy environment changes again, under the Labour government, it is likely that health and social care practitioners will be working within further organizational turbulence and change. It will be crucial that those changes are managed in such a way that they avoid the very real danger of compounding the problems which our respondents identified.  相似文献

社会科学从诞生之日起,就在学科归属、方法论特征和时代性关联上面临被不同的视野加以分割的遭遇,从而也陷入了划界的困境。在经历了漫长的发展之后,一种超越分割性的划界而走向融合的趋向正在成为当代社会科学中显现出来的新特征。社会科学与自然科学一样,也在走向大科学的新时代。其中主要的方面,包括在学科归属上超越科学与人文的分裂,在方法乃至本体论特征上超越实在论与建构论的隔阂,在时代关联上超越现代性与后现代性的区划。一部社会科学的历史,正在成为超越视界的局限、超越学科的藩篱、超越划界限制的历史;而实现了这些超越境界的社会科学,无疑可以在社会发展的伟业中产生更积极的作用。  相似文献

在现代民族国家的语境下,族群建构与国家建构之间有着深刻而复杂的政治互动关系,从尼日利亚的个案中就可以认识到这一点.该国的少数族群不仅是指那些数量上居于次级地位的文化和语言群体,而且也是国家建构进程的产物,它们在国家的序列中处于边缘的地位,遭受到结构性的歧视.这种状况成为尼日利亚少数族群持续反抗的动力,在其捍卫自身权利过程中释放出巨大的能量,并以破坏性的方式反作用于国家的建构.  相似文献

This study focuses on how clients using illicit drugs are supported in managing the boundaries of their homes to avoid the risks that social relationships may have on their daily lives at home. The data consist of 14 client–worker encounters audio-recorded in 2017 in a Finnish home-based service for people using drugs. Discursive interaction analysis and geographies of home were applied to examine how boundaries of homes are negotiated in relation to social relationships and how the home is constructed as a risk environment in the interactions of the service. The results highlight that the tensions between home and social relationships can be complex in the context of illicit drug use. Managing the boundaries of the home and social relationships deserves special attention among welfare services to promote their client's right to privacy and attachment to a home environment. This is also important for preventing the risk of homelessness.  相似文献

BackgroundGestational diabetes mellitus (GDM) represents a growing challenge worldwide, with significant risks to both the mother and baby that extend beyond the duration of the pregnancy and immediate post-partum period. Women from ethnic minority groups who access GDM care in high-income settings face particular challenges. The aim of this systematic integrative review is to explore the experiences and needs of women with GDM from select ethnic groups in high-income healthcare settings.MethodsFor the purposes of this systematic integrative review, a comprehensive search strategy explored the electronic databases CINAHL, Medline, Web of Science, and Scopus were searched for primary studies that explored the needs and experiences of women with gestational diabetes from select ethnic minority groups living in high-income nations. The ethnicity of the women in the study included: East, South and Southeast Asian, Indian subcontinent, Aboriginal/First Nations, Torres Strait Islander, Pacific Islander, Māori, Middle Eastern, African, or South/Latina American. Studies were assessed with the Crowe Critical Appraisal Tool and findings were synthesised with thematic analysis.ResultsThis review included 15 qualitative studies, one mixed method, and one cross-sectional study. Six high-income nations were represented. The voices and experiences of 843 women who originated from at least one ethnic minority group are represented. Four major themes were constructed: psychological impact of GDM, GDM care and education, GDM and sociocultural impact, and GDM and lifestyle changes.Discussion and conclusionLimitations exist in the provision of culturally appropriate care to support the management of GDM in women from select ethnic groups in high-income healthcare settings. Women require care that is culturally appropriate, considering the individual needs and cultural practices of the woman. Engaging a woman’s partner and family ensures good support is provided. Culturally appropriate care needs to be co-designed with communities so that women are at the centre of their care, avoiding a one-size-fits-all approach.  相似文献

How do activists create cultural change? Scholars have investigated the development and maintenance of collective identities as one avenue for cultural change, but to understand how activists foster change beyond their own movements, we need to look at activists’ strategies for changing their targets’ mindsets and actions. Sociologists need to look at activists’ boundary work to understand both the wide‐sweeping goals and strategies that activists enact to generate broad‐based cultural changes. Using data from participant observation and interviews with animal rights activists in France and the United States, and drawing on research on ethnic boundary shifting, I show how activists used two main strategies to shift symbolic boundaries between humans and animals, as well as between companion and farm animals—(1) they blur boundaries through focusing and universalizing strategies and (2) they cross boundaries physically, discursively, and iconographically. This study contributes a new theoretical and empirical example to the cultural changes studied by scholars of social movements, and it also provides a useful counterpoint to studies of symbolic boundary construction and maintenance in the sociology of culture.  相似文献
