Abstract

Turkey has been experiencing a migration policy transformation in the wake of a new ruling entitled the ‘Foreigners and International Protection Law’ (FIPL). This qualitative inquiry investigates this major change process by focusing on the planned reorganisation which is a result of the legislation process, with the aim of connecting the change process to a change model. The researcher interviewed twenty-seven middle and upper-level managers and experts from the Foreigners, Border, and Asylum Department (FBAD) and Asylum and Migration Bureau (AMB) of the Turkish Ministry of the Interior. Both their implementation of the change process and perceptions on such a transformation period were investigated. The study also examined the change process of the irregular migration and asylum regime within Turkey’s bid for full European Union membership as well as implementation of the draft FIPL. This study provides an example of a policy change process by analysing how governmental practice and legislation have evolved with regard to irregular migration, asylum seekers, and refugees in Turkey. The results noticeably reveal that, instead of seeing irregular migration and asylum as merely a threat to national security or a welfare issue, Turkey has chosen a way of developing a humanitarian approach in both the legislative and administrative fields. This is the first study which attempts to analyse a particular policy change process in the migration and asylum regime in Turkey. The results could influence policy dynamics and set priorities by suggesting policy solutions.  相似文献

The article examines the rationality behind the simultaneous enhancement and restriction of mobility of various categories of migrants in the European Union. Through Foucauldian understanding of economic man as a dominant subjectivity in neoliberal risk society, the article shows how the European migration law produces two types of economic men: EU citizens and bogus asylum seekers. Whereas migration of EU citizens is considered not only rational but also moral behaviour, migration of those perceived as bogus asylum seekers is condemned as immoral and irrational. This differing approach towards EU citizens on the one hand, and asylum seekers on the other, constitutes a mode of governing migration in the EU referred in this article as technology of morality.  相似文献

ABSTRACT

This article makes a theoretical argument stemming from our study of the European Commission’s hotspot approach to the management of migrant populations. It draws on empirical research findings from field research which took place on the island of Lesbos and in the city of Athens over the course of 20 months and links these to emerging critical studies of the new EU border regime. No clear definition exists of what comprises a hotspot: instead, the European Commission describes this as an integrated ‘approach’ for the enhancement of the capacity of member states to deal with crises resulting from pressures at the Union’s external borders. Effective in its ambiguity, the ‘hotspot approach’ therefore constitutes, as we argue, an integral part of the Europeanisation and institutionalisation of border management: a powerfully ambiguous dispositif in the EU’s emerging border regime. The article unpacks the notion of the hotspot from a historical perspective and explores the ways in which the hotspot contributes toward the culmination of European integration, paving the way for the flexible governance of mobility and asylum. We situate the hotspot within the historical shift of migration and mobility control from the border to the territory as a whole and conclude by arguing that the hotspot plays the role of a territorial incubator for the liminal EU territory: a paradigmatic space for a new form of governance that further disentangles territory from rights.  相似文献

Since the mid-1990s, Ireland has become a more culturally diversesociety. To ensure equitable, culturally sensitive services,social workers need to consult with and listen to views of serviceusers. This paper reports on findings of two recent studiesby social workers in Ireland with migrants living with HIV.It highlights how many of those newly diagnosed with HIV arefrom sub-Saharan African countries and still in the asylum processand discusses barriers to accessing support and integratinginto Irish society. The paper points out that unless properlysupported, those living with HIV may find it difficult to disclosetheir HIV status and highlights the importance of tackling HIVstigma. It concludes with the need to provide training for healthcare workers to provide culturally appropriate services, andargues against immigration policies which inhibit integration.  相似文献

ProblemNational guidelines recommend repeated screening for depression and anxiety for all women in the perinatal period. Routine screening in pregnancy is limited due to service, community and individual barriers.BackgroundPerinatal depression and perinatal anxiety affect up to 20% of all women. Women of refugee background are at even greater risk for perinatal mental health conditions due to refugee experiences and resettlement stressors.AimTo evaluate the acceptability and feasibility of a perinatal mental health screening program for women of refugee background from the perspective of health professionals.MethodsA mixed methods design guided by the Normalization Process Theory was used. Data were collected at a dedicated refugee antenatal clinic in the south-eastern suburbs of Melbourne, Australia. An online survey (n = 38), focus groups (n = 2; 13 participants) and semi-structured interviews (n = 8; 11 participants) with health professionals were conducted.FindingsUnder the four constructs of the Normalization Process Theory, health professionals reported improvements in identifying and referring women with mental health issues, more open and in-depth conversations with women about mental health and valued using an evidenced-based measure. Key issues included professional development, language barriers and time constraints.DiscussionImplementing a perinatal mental health screening program has been positively received. Strategies for sustainability include professional development and the addition of audio versions of the measures.ConclusionThis perinatal mental health screening program is acceptable and a feasible option for health professionals. Health professionals value providing more holistic care and have more open discussion with women about mental health.  相似文献

This research identifies challenges and solutions for the situation of accompanied children in German refugee accommodations along the seven human security dimensions (economy, environment, food, health, personal, community and political rights). It analyses existing binding and non‐binding standards for the protection of refugee children at federal, state and municipal level, and their development since 2014. In particular, the United Nations Children's Fund's role for the development of voluntary protection standards is discussed as a role model to enhance the awareness for the protection of refugee children in Germany.  相似文献

Unaccompanied asylum‐seeking children seeking refuge in safer parts of the world have a wide range of needs. This paper discusses the main needs of unaccompanied minors drawing upon the views of service providers who work with or for unaccompanied asylum‐seeking children and young people in Scotland, as well as the perspectives of unaccompanied minors themselves. The complexity of the children's needs is explored with a framework considering their process of resettlement, looking at the present first, the future next and the past last. Immigration to Australia has long been the focus of negative political interest. In recent times, the proposal of exclusionary policies such as the Malaysia Deal in 2011 has fuelled further debate. In these debates, Federal politicians often describe asylum seekers and refugees as ‘illegal’, ‘queue jumpers’, and ‘boat people’. This article examines the political construction of asylum seekers and refugees during debates surrounding the Malaysia Deal in the Federal Parliament of Australia. Hansard parliamentary debates were analysed to identify the underlying themes and constructions that permeate political discourse about asylum seekers and refugees. We argue that asylum seekers arriving in Australia by boat were constructed as threatening to Australia's national identity and border security, and were labelled as ‘illegitimate’. A dichotomous characterisation of legitimacy pervades the discourse about asylum seekers, with this group constructed either as legitimate humanitarian refugees or as illegitimate ‘boat arrivals’. Parliamentarians apply the label of legitimacy based on implicit criteria concerning the mode of arrival of asylum seekers, their respect for the so‐called ‘queue’, and their ability to pay to travel to Australia. These constructions result in the misrepresentation of asylum seekers as illegitimate, undermining their right to protection under Australia's laws and international obligations.  相似文献
