Teaching Black History after Obama

This article is a reflection on the teaching of black history after the Obama presidency and at the dawn of the Trump era. It is both an analysis of the state of the academic field and a primer on how to integrate the past few decades of scholarship in black history broadly across standard K-12 curriculum. It demonstrates the importance of theorizing black history as American history rather than just including African American content in US History courses and offers specific methods that can shift the narrative in this direction even within the confines of a more traditional telling of the American past. Finally, it situates the voluminous work of historians of the black past as critical interventions in pedagogy necessary to challenge today's unrelenting attacks on public education.     

Exotic Place,White Space: Racialized Volunteer Spaces in Honduras

In every year between 2004 and 2012, more than 800,000 Americans reported volunteering internationally (Lough 2013 ). These volunteers are overwhelmingly white (McBride and Lough 2008 ) and entering a largely nonwhite and developing world. This study starts by questioning how racial status informs volunteer/volunteer tourist interactions, both with locals and with other volunteers, in a global context. In‐depth interviews with 23 missionaries, teachers, and volunteers from the United States and Canada reveal that (1) international volunteering is largely motivated by romantic and exotic understandings of the Global South and (2) in spite of a stated interest in cultural immersion, participants’ notions of their whiteness guided their perceptions of Hondurans and their actions as they sought out and retreated to white spaces protected from Honduran influence. These findings further the work of those who have argued first world travelers have homogenized spaces on reserve, by demonstrating that whiteness can be the basis for the construction and maintenance of protected spaces in predominantly nonwhite countries.

以盐城市射阳县为例，分析了乡镇工作人员中存在的各种问题，并从切实提高乡镇工作人员的自身修养和专业知识、加强日常管理、引进激励机制、改革考核机制、引进人才等方面入手，进一步改善乡镇工作人员队伍素质，提升服务水平。     

Not without them: realising the sustainable development goals for women migrant workers

ABSTRACT

Drawing on multiple data sources, including key informant interviews, participant observation and archival study, this paper provides an analysis of the civil society’s role in foregrounding the agenda of women migrants in migration and development (M&D) fora, and reflects on its role in realising the UN Sustainable Development Goals (SDGs). Yet, the dominant narrative within the state-led Global Forum on Migration and Development (GFMD) tends to be a gender-blind migration for development approach, which emphasises national-level economic growth at the centre of migration processes, while negating the subjectivities of women migrants and neglecting their contributions to the global economy; this approach diverts attention to a narrow focus on macro-economic development through forms of financial remittances. Based on an examination of the GFMD as a site for gender mainstreaming M&D, we reflect on lessons learned as we look forward to achieving the SDGs. We argue that while the SDGs include some significant provisions for women in migration, only critical civil society advocacy and activism networked within grassroots organisations can address the structural changes necessary (such as a re-articulation of the care economy to value economic contributions of women’s reproductive work) to transform and improve the lived realities of women in migration and realise the SDGs in a manner that fosters their empowerment.     

宋代湖南诗僧地域、宗派分布与存诗类型分析

通过数量统计与分析,可以从籍贯、寓寺、宗派、存诗等方面描述宋代湖南诗僧的基本态势。就地域分布而言,宋代湖南诗僧中寓湘诗僧远多于湘籍诗僧,且大多集中寓寺于潭州的长沙与衡山,籍贯与寓寺分布都极不平衡;在宗派方面,几乎所有可考诗僧皆为禅僧,且绝大多数属于临济宗;在诗歌类型方面,所存诗歌以佛门偈颂为主,真正的“文人诗”很有限,推衍至全宋,表明宋代诗僧虽有“士大夫化”倾向,但总体来说仍不离僧徒本位。     

民事诉讼行政介入的程序规制研究

规制行政介入司法尤其是民事司法,除了深化司法体制改革的体制规制路径,将行政机关意见表达纳入民事诉讼程序是其另一程序规制路径.程序规制具有公正审判权请求权、论辩式民事诉讼对话逻辑、诉权制约行政权、民事审判实质公开的“武器支撑”.“法庭之友”制度对民事诉讼行政介入具有程序规制作用,中国行政机关可以“法庭之友”身份参与民事诉讼、进行意见表达.行政机关担当“法庭之友”不会损害独立审判,相反有利于司法公正公开.行政机关担当“法庭之友”以维护公共利益为限,是新型诉讼参与人,应明确其诉讼权利义务,构建行政机关作为“法庭之友”参诉的具体程序.     

政府性基金征收的正当程序研究 ——基于民航发展基金的个案分析

政府性基金的设立,为解决改革开放初期基础设施投上发挥了政策性作用。然而,随着时代的变迁与市场经济模式的完善,作为时代产物的政府性基金,其合法性、合理性与透明度均存在着质疑。选择以民航发展基金为个案,对民航发展基金的由来与发展、征收的使用和制度规范以及设立程序进行阐述与分析不难发现,民航发展基金在前置程序、立法程序、征收标准法律依据、实施程序等方面存在着正当法律程序的偏差,致使其合法性受到质疑。因此,政府性基金的设立,应该在前置程序、程序立法、实施程序、纠纷解决正当程序诸方面做出制度性安排。     

游客高聚集场所：概念、特征、风险与研究议题

随着大众旅游时代的到来,出游人数激增,极易形成高度聚集的游客群,而高聚集的游客群难控难疏,易导致安全事故发生。加强和完善游客高聚集场所的安全管理已成为旅游管理部门一项紧迫而重要的任务。本文主要以国内外政策法规中关于人员密集场所、公共聚集场所的表述为出发点,结合已有研究成果,借鉴人员密集场所的定义,界定“游客高聚集场所”的概念,并就游客高聚集场所的特征进行了讨论;在此基础上,分析了游客高聚集场所面临的风险类型及其相关诱发因素;最后,根据现有人员密集场所的研究进展提出了游客高聚集场所的相关研究议题。     

略论中国古代法律的基本性质——兼谈中国古代无民法

关于中国古代法律,"诸法合体,民刑不分"的习惯说法并不妥当,它意味着诸法都有,没有分开而已;民法之说则似是而非,模糊了民法与刑法的区别,也模糊了古今与中西法律的基本区别.在中国古代特定的社会历史条件下,法律作为维护家天下统治秩序的工具,核心是一个"刑"字,是泛化的刑罚.它无所谓民事与刑事的区分,只有事之大小、刑之轻重,故与民法无关,也不等同于刑法,勉强可视为一种片面的刑法.实际上,中国古代社会无从产生民法,民间社会关系与纠纷概由律及礼、俗调节.
