论“特殊与差别待遇”条款的发展及其法理基础

根据GATT体制的"特殊与差别待遇"条款(S＆D条款),"承担义务的非互惠模式"逐步发展和确立。而在WTO体制中,此种模式被限制、淡化或转化,悄然改变为"履行义务的非互惠模式"。这是值得重视的趋向。由于发达成员与发展中成员经济实力迥异,且这一经济现实在今后相当长的历史时期将继续存在,WTO体制的S＆D条款并非权宜之计,也不宜仅表述为WTO体制非歧视待遇原则的例外。发展中国家应坚持和强调,S＆D条款的法理基础是公平互利原则。

文章聚焦于杜甫《登高》一诗的结构及意象,借鉴西方文论中的对等原则及隐喻与转喻等分析方法,分析该诗表层含义、深层结构以及意象的运用,发掘其艺术价值形成机制,从而读出该诗新的韵味.全诗呈现一种内在的展开式深层文化结构;诗作者选择富有强烈的人文意义的自然意象勾勒出一副感性很强的思国怀乡之画面,这扩大了诗意的空间,揭示出漂泊游子的心态和人生体验.     

The gift in interaction: a study of 'picking-up the bill'

This paper analyses the phenomenon of 'picking up the bill', thereby contributing to a resurgence of sociological interest in gift exchange. Drawing on ethnomethodology, it describes and locates a distinctive theoretical approach. Utilizing video recordings, the analysis considers the interactional constitution of gifts and how gift exchange is locally invoked via the norm of reciprocity. Recurrent practices are described, through which gifts are brought into being, with reciprocity invoked, by benefactor and beneficiary alike, to manage social problems of acceptance, rather than to sanction insufficient contributions. The study describes the social character of what are perhaps the preeminent gifts exchanged in modern societies; where one person pays for another's consumption.

移民村庄的社会资本培育与金融互助社发展

以一个阶段性组合式移民村庄为例,分析移民村庄社会资本与金融互助社治理之间关系。研究发现,丰富的社区社会资本是金融互助社治理有效的社会基础。阶段性组合式移民村庄的社会资本处于不断的发育过程中,社区社会资本存量较低;社会资本的不足影响了村庄互惠网络的形态,形成了连通性较差的小世界网络;这种互惠网络使得金融互助社的间接互惠机制和直接互惠机制难以有效发挥作用,使得金融互助社陷入逾期不归还货款的治理困境。因此,移民村庄的金融互助社要实现有效治理,应注重社区社会资本的培育。     

The dynamics of support over time in the intentional support networks of nine people with intellectual disability

This paper describes the dynamics of support observed in the networks of nine adults with intellectual disability, developed by families who had committed to achieving a ‘good life’ for this person. Network members, including the person with a disability, participated in this longitudinal ethnographic study. Three principles that underpinned their work were positive and respectful relationships, mentorship and providing opportunities and expectations. Participants worked actively with other network members to develop higher levels of autonomy and social participation.     

农村土地承包法修改中农民朴素公平观及其制度回应

我国农民朴素公平观包含生存第一、权责统一和多数人决等基本内涵。全国7县84村田野调查发现,农村土地承包法律与农民朴素公平观存有背离现象：“生不增,死不减”导致部分集体成员的生存无法保障;权责不统一,发包方与承包方的权利义务存在失衡现象;多数人决困局,即涉及土地承包事宜存在有事不能议、议而不能决、决而不能行的问题。在《农村土地承包法》修改中：应尊重农民“生存第一”的要求,坚持土地均分原则并稳定农户承包权;坚持权责统一原则,实现发包方与承包方之间的权利义务对等;赋予集体成员多数人决的正当性和可执行性。     

废旧家电回收逆向物流差异化激励机制研究——基于生产商选择性理性分析

传统的基于委托代理的激励机制研究主要以理性经济人的假设为前提。通过建立以“互惠性”假设为基础的委托代理激励模型,分析家电生产商的企业行为,由于受到社会因素和企业文化价值等因素的影响,存在着选择性理性的差异性;应该针对其差异性设计相应的经济性与非经济性激励机制,强调非经济性激励对于建立长期有效的家电回收体系的重要性。     

Mutual Influence in Psychodynamic Supervision

This article examines three hypotheses: (1) supervisory process is reciprocal, (2) supervisors as well as supervisees benefit, and (3) supervisors and supervisees benefit personally as well as professionally. The article begins with a comparison of three relationally oriented approaches to the “teach-or-treat” controversy and continues by briefly summarizing the psychoanalytic literature on mutual transformation. Two case summaries illustrate mutual change: the first describes how supervising an MSW student early in my career affected my professional and personal development, whereas the second illustrates bidirectional supervisory action in case consultations with an experienced therapist.

人类生活充满了隐喻活动,最具创造性的隐喻无疑来自诗歌这一特殊文体。现代诗语的重要＂纽带＂：隐喻与转喻的蓬勃展开、长盛不衰,得益于结构主义能指/所指、选择/组合的原理。以台湾中生代诗人简政珍为取证,确信隐喻建立在相似性、类比性基础之上,与其孪生关系的转喻则建立在相邻性、接近性基础之上,两者遵循＂对等原则＂,在互换、互渗、互化中共同参与了一切诗语活动。在现代诗语的部落里,诗人正是通过张力这一充满＂血缘＂的纽带,凝聚了家族与非家族的所有成员。
