论我国对外连带保证案件的法律适用问题——以诉讼时效为例

关于对外连带保证案件的法律适用,我国审判实践尚无统一的做法。本文以诉讼时效的法律适用为例,认为如果涉案保证经过审批的,其法律适用应尊重当事人的意思自治,未经审批的,则应以直接适用法为由适用我国内地法处理,而且,此种区分将导致在诉讼时效问题上法律适用的不同。     

Toward a valid approach to nonprofit efficiency measurement

Past literature in nonprofit management uses the overhead ratio of nonprofits as a measure of efficiency. Although the overhead ratio might measure top‐heaviness, we argue that it does not measure nonprofit efficiency. To investigate this, we use financial and operational data to rank the efficiency of Habitat for Humanity affiliates with the overhead and administrative ratio, as well as data envelopment analysis (DEA) and stochastic frontier analysis (SFA), two of the most popular efficiency measures. While the DEA and SFA rankings are statistically correlated, overhead ratio rankings are negatively correlated with both SFA and DEA rankings. We argue that nonprofit scholars, managers, and donors should move away from concepts and measures of efficiency based on financial ratios, and toward ones that embrace maximizing what nonprofits are able to make and do.

试论行政指导的程序规制

行政指导是一种新型行政行为,实体法难以规范,程序规制则具有多方面的优点。对于抽象行政指导,要完善听证制度、保证透明度;对于具体行政指导,应当在保障意见听取、禁止不利对待、体现行政公开、完善救济途径等方面加以规范,使我国正在制定的《行政程序法》对行政指导的规定更加完善。

行政诉讼不应附带民事诉讼

在行政诉讼中并不具有附带诉讼的基础,即附带诉讼的效率性和关联性.有学者主张行政诉讼可以附带民事诉讼是由于把司法解释中规定的并案审理视为行政附带民事诉讼.事实上,并案审理并不是行政附带民事诉讼.行政赔偿诉讼不是附带诉讼;行政裁判诉讼和行政处罚诉讼也不是行政附带民事诉讼.因此,行政诉讼不应附带民事诉讼.

文章从一种模糊认识切入 ,集中论述了政府如何提高行政效率问题。文章论述了职能转变与提高行政效率的关系 ,强调了依据职能制订测评行政效率标准的重要性 ,并从科学界定政府的职能、加大政府机构改革的力度、建设高素质公务员队伍等方面论述了提高地方政府行政效率的主要措施 ,其中对政府职能转变、政府经济职能的具体内容的概述颇有新意。     

法院调解制度：检讨与重构

法院调解制度是我国民事诉讼的一项重要制度,在民事审判中发挥着重要作用。但随着市场经济的不断发展,法院调解制度的弊端日渐凸现,本文主张肯定法院调解制度的存在价值,并对其加以改造,同时就如何完善提出建议。     

Interorganizational influences on the founding of african american organizations, 1955–1985

This paper examines the relationship between traditions of social action and patterns of organizational development, using data on the formation of national African American protest, advocacy, and service organizations between 1955 and 1985. Following research in organizational ecology, Poisson regression is used to examine the association between organizational density and organizational formation across strategic forms. The results provide some support for the idea that interorganizational influences are important in shaping the contours of the African American social movement industry. Outside funding, internal organizational capacities and protest levels also play a significant role.An earlier version of this paper was presented at the 1992 annual meeting of the Eastern Sociological Society.
