Explaining religiosity: towards a unified theoretical model1

The article presents a unified theoretical model, explaining differences in Christian and ‘alternative’ religiosity at individual and collective levels. The model reconstructs and integrates the most important theories explaining religiosity (deprivation, regulation, socialization, cultural production, and ethnicity) as complementary causal mechanisms in a rational‐action based framework. It is maintained that the mechanisms of the various theories are not exclusive, but complementary, and that integration into the general model is both theoretically and empirically beneficial. The model is tested on representative data from Switzerland. Substantively, I find for the Swiss case that Christian religiosity can be best explained by a religious socialization mechanism. The most important mechanisms accounting for alternative religiosity involve deprivation, gender, and age.

行政赔偿是国家赔偿的主要组成部分，行政赔偿程序的完备与否直接关系到受害人能否及时获致行政赔偿。海峡两岸对此有不同的制度安排和程序设置，本文分别就处理前置、赔偿诉讼与追偿阶段展开比较分析，期望有利于大陆国家赔偿法的完善与实施。     

对行政执法中财产权保护的思考——以《治安管理处罚法》为例

财产权是公民用以防御公共权力可能侵犯的基本权利。长期以来，由于思想观念滞后、借公共利益的名义侵害公民的合法财产、行政法律制度不健全等原因，使得财产权利缺乏全面有效的保护。财产权利的保护有利于我国民主政治的建设，有利于市场经济的发展，有利于和谐社会的构建。     

行政区域变更工作应当纳入法治的轨道

目前,我国许多地方正在进行行政区域变更工作。行政区域变更应当以三个有机统一原则为指导,特别是要注重依法办事,要增强行政区域变更工作的透明度,充分听取社会公众的意见,对于涉及公民权利的事项给予特别保护。为了进一步规范行政区域变更工作,应当充分发挥全国人大常委会和地方人大常委会通过行使重大事项决定权对行政区域变更工作的指导作用。此外,要真正将行政区域变更工作纳入法治轨道,应当适时制定和出台《中华人民共和国行政区划法》或者是《中华人民共和国行政区域变更法》,并草拟了《中华人民共和国行政区划法》专家建议稿,以此供学界进一步对此问题展开深入研究。     

论现代西方政府权力的结构变化与平衡模式完善

20世纪前 ,西方资本主义国家的政府权力结构是议会主导型。 2 0世纪后 ,随着社会的发展和行政权力的扩张 ,政府权力结构由议会主导型向行政主导型转变。与此相适应 ,权力的制约与平衡机制也由单一控权模式向多元控权模式转变。现代西方政府权力的结构变化及其平衡模式完善 ,对我国的改革和建设具有重要的启示意义     

废弃油气井的环境损害与法律责任

废弃油气井是油气勘探开发的产物，案例研究表明，废弃油气井存在着导致严重环境损害的风险。对废弃油气井的井控或封堵措施不当、人为破坏或非法开采、甚至仅仅只是自然因素的影响都可能使废弃油气井对环境造成严重损害。一旦废弃油气井损害环境事故发生，负有相关责任的油气企业及相关责任人员、政府环境行政主管部门及相关工作人员，就应承担相应的民事的、行政的、甚至刑事的法律责任。解决废弃油气井损害环境的根本办法，在于从制度和技术两方面着手，从源头上进行防治，将风险降到最低。     

Improvement of Coordination Mechanism of Intellectual Property Administrative Enforcement in Free Trade Zone ——Taking Shaanxi FTZ as an Example

Strengthening the coordination of intellectual property administrative enforcement in the FTZ is conducive to improving the efficiency of administrative enforcement and optimizing the legalized business environment in the FTZ. Based on the theory of rule of law-based government, the theory of collaborative governance and the theory of holistic governance, the connotation of the coordination of intellectual property administrative enforcement in the FTZ is defined, the status quo of the coordination of administrative enforcement in Shaanxi FTZ is investigated and analyzed. Learning from the experience of Shanghai FTZ and Fujian FTZ etc., it is proposed that the reform of the comprehensive intellectual property management system in the FTZ be deepened, the basic multilateral framework for coordination of inter-departmental intellectual property administrative enforcement be established, the mechanism of the coordination of the existing administrative enforcement be improved, the public service platform for intellectual property protection be built, and the construction of enforcement teams be strengthened, so as to improve the coordination mechanism for intellectual property administrative enforcement in the FTZ.
