澳门土地制度改变及其影响与纱纸契合法性问题

澳门基本法第七条规定,澳门境内的土地和自然资源,除在澳门特区成立前已依法确认的私有土地外,属于国家所有。土地制度的改变、土地所有权的改变,除了涉及澳门土地所属问题,还涉及澳门特区的成立和基本法的实施对澳门原有法律制度和司法程序的影响。具代表性的案例是去年澳门特区终审法院就观音堂地段的所有权和使用权的民事诉讼案所作出的裁决:在特区成立前未获依法确认为私有的土地,特区成立后就成为国家所有,也不能通过司法裁判确认这些土地的所有权或利用权为私有,无论有关诉讼是在特区成立之前还是之后提起的。也就是说,澳门从此再也不会有新的私人业权土地了,连"和平占有"也不能了。土地制度改变所带来的影响,可从上述观音堂地段的官司反映出来,未来可能还涉及棘手的离岛土地"纱纸契"的法律地位问题。本文以终审法院的有关裁决为例,进而讨论土地制度的改变对于土地"纱纸契"问题的影响。

Studying children in armed conflict: data production,social indicators and analysis

The authors seek to give an overview of ways in which social indicators relevant to research on children affected by armed conflict can be developed, and how such research can be carried out. Technical and methodological challenges involved in this pursuit are discussed. It is argued that data production must consider issues of definition and delineation of the phenomenon of war-affected children more actively than it does currently. An analytical approach is proposed, in which children’s characteristics in different situations, or in different stages of conflict, may be used as intakes to understanding how the social processes pertaining to life histories of children in armed conflict are created and reproduced.

Sense of coherence and social support – Resources for subjective well-being and health of the aged in Finland

In this study we explored if the psychological and social resources of aged people (over 75 years) in Finland predict their subjective well-being and experienced state of health (n = 348). Data were taken from a larger Finnish survey on living conditions. Based on previous research on younger people we formed a model where morbidity, experienced quality of social support and sense of coherence together with economic resources are the predictors of both experienced state of health and subjective well-being. LISREL (8) path analysis was used to test the model. The model providing the most parsimonious explanation of the data suggested that a strong sense of coherence and high experienced quality of social relationships are strongly related to subjective well-being. Experienced state of health was associated with morbidity and subjective well-being, but there was no significant relationship between subjective well-being and morbidity.     

Good personal finances or a strong social capital—on different life conditions of importance for an active life when becoming alone in old age

Becoming alone in old age can be a decisive life event that brings major changes depending on various causes as health status, financial resources, family situation, and available welfare services. This article discusses the situation of older people in Sweden who have transitioned from a two-person to single-person household in recent years and what impact this might have on their everyday lives. Through in-depth interviews with 18 older people, age 67–90, their experiences about life conditions and opportunities were examined. Findings showed large differences between the men and women. They all tried to live as they always had done and they used the same personal life strategies that they always had. But the men could live as before on their own financial merits, while the women needed assistance from children, grandchildren and the welfare system. Transportation options were central and clearly related to both private economy and social services available. Shortcomings in the welfare state's way of caring for the elderly were clearly uncovered. The gap between social policy promises of opportunities for autonomy and independence to live an active life in old age and the everyday reality for older people still seems to be wide.

张爱玲与王安忆是中国现当代文学史上两位重要的女作家,其都市小说创作有一定的相似性。从她们对都市女性生存境遇的刻画、对市民日常生活的描写及共有的怀旧意识三方面比较她们的异同,指出王安忆的都市小说创作在一定程度上传承了张爱玲的笔法,并拓展深化了都市小说的内涵,具有深远的意义。     

Public school accountability,workplace culture,and teacher morale

Educational scholars claim that teacher morale has suffered from accountability pressures and constrained professionalism, but exactly what is most diminished by these pressures remains unclear. Drawing on recent theoretical work on public school organizational culture, we hypothesize that accountability pressures hurt teacher morale and increase the risk of turnover by undermining the professional culture of the school and by diminishing teacher cooperation and trust. We find support for this hypothesis in a national sample of teachers in 2011–12, and a follow-up survey from 2012–13. The analyses test whether a collective pedagogical teacher culture, comprised of professional culture and teacher collaboration, buffers the impact of these pressures that diminish teacher morale. Counter to past research, we find that a strong collective pedagogical teacher culture does not buffer teachers from the ill effects of negative workplace conditions in the form of accountability pressures. We also find that accountability pressures in the form of district dismissals are associated with a higher likelihood of teachers leaving their school, and this relationship is not mitigated by strong professional culture. We conclude that accountability pressures partly undermine goals of improving performance and equity in public schools by sowing seeds of teacher dissatisfaction and contributing to teacher turnover, thus thwarting student achievement in struggling schools.
