关于中国现代史分期问题的思考

目前,史学界对于中国现代史的分期看法不一,形成不同的主张：或以重大政治历史事件为标准,或依据《关于建国以来党的若干历史问题的决议》,或以经济社会发展目标模式为分期标准。这些标准都不符合中国通史的学科分期要求。中国现代史作为通史,其分期应当以社会形态的变迁为标准,应根据社会主义的不同发展模式,将其划分为新民主主义时期或社会主义的准备时期、苏联模式社会主义时期或传统社会主义时期、中国特色社会主义时期或现代社会主义时期。     

《庄子·天下》与中国古代学术史

《庄子·天下》在中国古代学术史上的意义久被学者们所认识,但诸如:《庄子.天下》对道术体性的真正期望何在?其在论列旧法世传之史、邹鲁六经及百家之学时,其背后的学术内涵是什么?其对百家之学究竟是肯定还是否定?原因何在?所有这一切最终对中国古代学术文化有何等影响?这些问题至今似仍罕为学者所尽数参透,因而有必要再予诠衡论析,考订评量。但其中最为重要的是,中国古代政教制度实践对社会文化的辐射、影响之大,必须予以充分关注。

《制度空间与基层权威生成》一书是对我国基层社会治理核心问题的一次检阅,其对自治的思索、历史的梳理、制度的考量、权威的评判都是深入而细腻的,其间虽有理论追索的困惑与纠结,但是其对制度影响下的权威的现实勾勒依然因为真实而生动。     

试论中国避讳学史的历史分期

避讳学是一门研究避讳现象发生发展的一般规律及其应用的边缘学科,历史悠久、文献丰富、成就巨大是我国避讳学研究的最显著特点。伴随一部避讳史,也有一部中国避讳学史。中国避讳学史可分为四个时期:一是避讳史料学时期——先秦至明代,二是避讳学的萌芽期——清代,三是避讳学的形成期——近代,四是避讳学的发展期——现代。     

A Social and Historical Perspective of the San Francisco Gay Men's Chorus

ABSTRACT

This study sought to understand the various roles music played for gay men who were members of the San Francisco Gay Men's Chorus, the world's first gay men's chorus. Specifically, it answers the following questions: What is the demographic profile of the chorus members? How has the chorus shaped or reflected social issues; how has the chorus shaped or reflected political issues; how has the music evolved over time?; How was the chorus impacted by the HIV/AIDS epidemic? Historical information for this study was gathered through eight interviews of original and long-time choral members as well as the current artistic director. Interviews were conducted in San Francisco at the San Francisco Gay Men's Chorus office, and additional data were derived from programs of previous choral concerts, two questionnaires (Internalized Homophobia Scale and Gay Chorus Questionnaire), and observations of choral rehearsals and concerts. As a follow-up to a previous study documenting the formation of the chorus in 1978–1982, this study historically documents the chorus's evolution from 1983 through 2003, emphasizing the chorus's impact on social and political issues, the musicality of the chorus, and the impact of HIV/AIDS on the chorus.     

Was Abraham Lincoln Gay?

Scholars and historians are blind to Lincoln's same-sex inclinations in part because of a personal aversion to male homosexuality, but more importantly because they fail to perceive the vast differences between the sexual culture of antebellum America and that of our own time, especially in regard to male-male physical and emotional intimacy. This article brings those differences to light and sets Lincoln's life in the context of the sexual culture of his own time. This enables one to see that Lincoln's same-sex sexuality was not only unproblematic, but commonplace, if not typical, in his day. Revising the Myth of Lincoln in regard to his same-sex inclinations will have a positive effect on contemporary culture, especially on the education and socialization of young boys.

我国环境刑罚轻缓化探析

毋庸置疑,在整个国际社会对环境犯罪处以轻缓刑罚的背景下,我国亦应该对环境刑罚采用轻缓化的原则。诚然,我国的环境刑罚制度与其他国家相比还有许多亟待完善的地方,但这并不妨碍我们在借鉴其他国家先进的立法经验的基础上构建适合我国具体国情的环境刑罚制度。在环境刑罚中要突出自由刑的适用,扩大并完善财产刑的适用,明确财产刑中过于模糊的规定,逐步改善环境犯罪的刑事处罚措施过于单一的缺点和功能上的不足,同时提高对辅助刑罚措施的关注。在环境犯罪方面,在适用传统刑罚措施惩治的基础上配合适用辅助刑罚措施,使我国环境刑罚轻缓化实践不至于成为一纸空谈。

雷锋精神能够走进中国历史,成为社会主义先进文化的一面旗帜,在于它充分彰显了特定时代的核心价值,是时代发展的客观要求;有效传承了民族传统文化精髓,具有切合民族心理的文化基因;真正获得了广大人民群众的推崇奉行,是人民群众的自觉选择。     

美国BIT范本的环境政策考量与变迁及其对中国的启示

美国从1981年启用第一个BIT范本,之后历经数次修订,形成不同版本。其中的环境保护条款从无到有、从简到繁,2012年版本对环境保护又有大力强化。虽然环境例外条款具有法律形态,但因其为缔约方保留环境规制的空间,没有消极影响,其他环境条款尤其专门环境条款则只具有政策形态,对缔约方只有倡导和督促作用,因而也不具有负面意义。基于此,对于中美BIT谈判,中国应该持有像实践WTO规则一样的心态,研究它、接受它,为投身国际实践走出第一步,为将来参与更大范围的规则制定做好准备。
