高校自主权若干问题的法律思考

近年来 ,因高校拒绝颁发毕业证、学位证而引起的法律争端越来越多 ,基于现代行政法理论 ,首先对高校自主权的性质进行了论述 ,认为高校自主权属于行政权力 ,高校与学生之间存在的法律关系是行政法律关系而非民事法律关系 ,探讨了高校自主权接受司法审查的范围 ,提出了高校自主权法治化需采取的对策     

MBO后我国上市公司治理绩效四效应的实证研究

本文提出了我国上市公司实施MBO后影响公司治理绩效的四个效应假设:(1)金字塔型股权结构下管理层的现金流权和控制权的两权分离效应;(2)上市公司增加现金股利分配效应;(3)管理层的挖壕自守效应;(4)管理层的掘隧输送利益效应。通过对样本公司的实证数据检验,本文肯定了两权分离效应、挖壕自守效应、掘隧输送利益效应的存在,否定了增加现金股利分配效应的存在。     

从失语的物体到讲述的主体——论莫里森小说中黑人女性话语权的获得

法国哲学家福柯的权力—话语理论为我们研究莫里森作品提供了一个新的视角。《最蓝的眼睛》《宠儿》《爱》中莫里森所采用的叙述视角与叙述话语以及其中的人物话语,为黑人女性争取了话语权力,使她们由失语的物体一跃成为讲述的主体。话语权是黑人女性确立其主体地位的有力武器。

本文从金融衍生品的风险出发,主要介绍了金融衍生品风险的定义、分类,包括市场风险、流动性风险、操作风险、法律风险,信用风险,结合新会计准则,阐述了金融衍生品新的特点,如金融衍生品核算办法的改变,金融衍生工具使用难度较大、金融衍生品披露的改变,并在建立及时有效的信息披露制度、加强内部控制和风险管理、完善我国金融衍生品市场建设、提高投资者素质等方面提出了一些关于如何更好地进行金融衍生品风险管理的建议。     

农民土地财产权的“权衡”与启示

农民土地财产权是指作为农村集体经济组织成员的农民对农村集体土地所依法享有的各种财产利益的自由和资格。农民土地财产权是以宪法为基本依据的民事财产权。农民土地财产权的权利主体"农民"应当是指农村集体经济组织成员,作为权利主体具有多维性的特质。农民土地财产权是以农村集体土地为基本客体的不动产财产权,农村集体土地具有资源性、资产性、空间性和层次性的特征。农民土地财产权是农民在农村集体土地上应当拥有各种财产利益的权利,包括以土地归属为财产利益的权利、以土地利用为财产利益的权利、以土地流转为财产利益的权利和以预期利益为财产利益的权利。

农村宅基地产权法律表达的70 年变迁(1949—2019)

受苏联宪法影响,1954 年《中华人民共和国宪法》首次引入“生活资料/ 生产资料”概念。 在法律层面上,农民房屋从公民私有财产被改造为生活资料。 1962 年的《农村人民公社工作条例(修正草案)》则把性质上属于生活资料的农村宅基地归入生产资料,变成了集体所有、农民使用。 通过房屋“生活资料化”和宅基地“生产资料化”,农民原先的宅基地所有权被弱化为一个事实上的居住权。 改革开放以来,在立法上恢复了房屋的财产本质,确认并通过改革不断实现宅基地使用权的用益物权性质。 宅基地的财产属性逐渐得到恢复。 70 年宅基地产权法律表达变迁的历史说明,应在坚持集体所有前提下不断推进宅基地财产化,赋予农民更多财产性权利,这是真正实现乡村振兴的必由之路。     

Inference for a Linear Functional of Cumulative Hazard Function Via Empirical Likelihood

This article discusses sampling plans, that is, the allocation of sampling units, for computing tolerance limits in a balanced one--way random-effects model. The expected width of the tolerance interval is derived and used as the basis for comparing different sampling plans. A well-known cost function and examples are used to facilitate the discussion.     

Estimation Bias in Complete-Case Analysis in Crossover Studies with Missing Data

Crossover designs are used often in clinical trials. It is not uncommon that subjects discontinue before completing all treatment periods in a crossover study. Despite availability of statistical methodologies utilizing all available data and software for obtaining valid inferences under the assumption of missing at random (MAR), naïve approaches, such as the complete case (CC) analysis, which is only valid with a strong assumption of missing completely at random are still widely used in practice. In this article, we obtain the analytical form of the estimation bias of treatment effects with CC for linear mixed models. We use simulation studies to examine the inflation of Type I error and efficiency loss in the inferences with CC under MAR. Invalidity and inefficiency of two other commonly used approaches for defining analyzed data in the presence of missing data, including data from at least two periods in three period crossover and available cases for a specific comparison of interest, are also demonstrated through simulation studies.     

Goodness-of-Fit Test and Parameter Estimation for a Proportional Odds Model of Random Censorship

Censored data arise naturally in a number of fields, particularly in problems of reliability and survival analysis. There are several types of censoring, in this article, we will confine ourselves to the right randomly censoring type. Recently, Ahmadi et al. (2010 Ahmadi , J. , Doostparast , M. , Parsian , A. ( 2010 ). Bayes estimation based on random censored data for some life time models under symmetric and asymmetric loss functions . Communcations in Statistics-Theory and Methods , 39 : 3058 – 3071 .[Taylor & Francis Online], [Web of Science ®] , [Google Scholar]) considered the problem of estimating unknown parameters in a general framework based on the right randomly censored data. They assumed that the survival function of the censoring time is free of the unknown parameter. This assumption is sometimes inappropriate. In such cases, a proportional odds (PO) model may be more appropriate (Lam and Leung, 2001 Lam , K. F. , Leung , T. L. ( 2001 ). Under this model, in this article, point and interval estimations for the unknown parameters are obtained. A Monte Carlo simulation study is conducted to carry out the behavior of the estimators obtained.
