沉默权制度应予确立

沉默权是无罪推定的核心内容,是保障犯罪嫌疑人、被告人的正当权利,实现司法公正的重要体现。根据沉默权的起源、发展的历程,借鉴国际社会采用沉默权制度的经验,分析法学界对沉默权的不同观点和态度,结合我国的国情和司法实践,所得结论是应当在我国确立沉默权制度,以推进我国的法治建设,体现人权保障和人文关怀。同时,对沉默权制度不可照抄照搬,盲目采用,而应充分考虑我国的国情和司法实践,创立有中国特色的沉默权制度,从而构建社会主义和谐社会。     

Inferences for a Partially Varying Coefficient Model With Endogenous Regressors

In this article, we propose a new class of semiparametric instrumental variable models with partially varying coefficients, in which the structural function has a partially linear form and the impact of endogenous structural variables can vary over different levels of some exogenous variables. We propose a three-step estimation procedure to estimate both functional and constant coefficients. The consistency and asymptotic normality of these proposed estimators are established. Moreover, a generalized F-test is developed to test whether the functional coefficients are of particular parametric forms with some underlying economic intuitions, and furthermore, the limiting distribution of the proposed generalized F-test statistic under the null hypothesis is established. Finally, we illustrate the finite sample performance of our approach with simulations and two real data examples in economics.     

Functional and emotional traits of corporate social media message strategies: Behavioral insights from S&P 500 Facebook data

Drawing from literature regarding public engagement, the Elaboration Likelihood Model (ELM), computer-mediated communication research, and emotion psychology, this study examines the effects of companies’ social media communication strategies on public engagement behaviors as indexed by post likes, shares, and comments. Specifically, it investigates how corporate Facebook posts’ functional traits (functional interactivity and vividness) and emotional traits (emotion presence, valence, and strength) impact public engagement online. Through data mining and computer-assisted sentiment analysis of 33,379 posts from 106 Standard & Poor 500 companies’ Facebook accounts, this study finds a negative effect of functional interactivity but a positive effect of vividness on engagement. It also shows that emotional traits overall yield stronger public engagement outcomes. Two-way interactions between emotional and functional features are also detected. Theoretical and practical implications are discussed.

中国传统诚信思想及其对构建和谐社会的启示

中国传统诚信思想丰富多彩,既蕴涵着超越时空、具有现实价值的优秀成分,又含有受到历史局限性制约的糟粕。客观评析中国传统诚信思想的得与失,并对其进行创造性的合理转换,对于我们坚持批判继承的原则,取其精华,去其糟粕,构建社会主义和谐社会具有重要的理论价值。     

现行高校分类模式:局限与超越

在对目前高校分类进行考察的基础上,指出现行高校分类模式存在着层次与类型混淆、科研与教学对立、重点与类型匹配、学制与类型挂钩等弊端。提出了高校类型划分的社会功能视角,将高等学校划分为:学术型高校、行业型高校和职业型高校。     

面子理论及其局限性新探 ——基于盎格鲁中心主义思想的研究

布朗和列文森的面子理论一直被视为研究礼貌现象的经典理论,在语言学界影响极大;但面子理论的提出是基于英语语料,研究的也仅仅是英语文化的礼貌现象,因此该理论深受盎格鲁文化价值影响,带有浓厚的盎格鲁中心主义思想,不能全面解释其他文化中的礼貌现象。回顾了面子理论的精髓思想及其贡献,在学术界对该理论的批判性研究基础上,从跨文化交际及盎格鲁中心主义的角度,进一步探讨面子理论的局限性,并为该理论研究的发展思路和方向提出诸多新的思考。     

建立我国经济诉讼特别程序的思考

经济法律规范缺乏可诉性已是法学界公认的事实,单对现有制度的修修补补已无法解决这一问题.因此,应参照国外的成熟制度,在现有的制度上创新,建立我国的经济诉讼特别程序.为保证该程序发挥应有的作用,必须合理设计具体的操作方案并防止诉权的滥用.     

Uniform in bandwidth consistency for various kernel estimators involving functional data

The paper investigates various nonparametric models including regression, conditional distribution, conditional density and conditional hazard function, when the covariates are infinite dimensional. The main contribution is to prove uniform in bandwidth asymptotic results for kernel estimators of these functional operators. Then, the application issues, involving data-driven bandwidth selection, are discussed.
