交付是特殊动产的物权变动的要件,登记只是取得对抗善意第三人效力的条件.在特殊动产物权变动中,只有登记并不产生物权变动,因登记而取得对善意第三人的对抗效力是建立在已经因交付取得物权的基础之上的,没有物权基础的登记并不产生对抗效力.《买卖合同司法解释》第10条第4项并非确立了“交付优先于登记”规则,而是对物权优先于债权一般法理的重申,登记而未受领交付特殊动产者只享有债权,不得对抗未登记的物权. 相似文献

This paper critically examines the ways in which global–local flows interpenetrate each other and mesh, simultaneously undermining and empowering the forces of local resistance, using the Niger Delta as a case study. It explores the response of local resistance groups to ‘globalization from below’, by appropriating global structures and tapping into transnational networks to empower their identity, rights, and claims in the oil-rich, but impoverished Niger Delta. Space is conceptualized as the transnational multiscalar social terrain of power, which is critical both as a site of struggle and as expression of the global logic of oil capital. Applied to an explanation of the globalization of extraction and resistance in the oil-rich Niger Delta, this article posits that a lot will depend on the balance of power between the social forces in the region, the oil multinationals, and the Nigerian state, and the capacity of the forces of resistance to tap into and creatively use existing transnational space(s) and discourses to push an agenda of social emancipation and grassroots democracy. Este artículo examina las maneras como los flujos locales y globales se interpenetran entre sí y engranan, debilitando y fortaleciendo simultáneamente a las fuerzas de la resistencia local, usando el Delta del Níger como estudio de caso. El mismo explora la respuesta a la resistencia de los grupos locales a la ‘globalización desde abajo’, mediante la apropiación de estructuras globales y sacando provecho de las redes transnacionales para fortalecer sus identidad, derechos y demandas en el Delta del Níger, rico en petróleo, pero empobrecido. El espacio se ha conceptualizado como un terreno de poder social trasnacional y multiescalar que es crítico para ambos sitios de conflicto y como expresión de la lógica global del capital del petróleo. Este artículo hace referencia a una explicación de la globalización en la extracción y la resistencia del Delta del Níger, rico en petróleo y postula que mucho depende del equilibrio del poder entre las fuerzas sociales de la región, las multinacionales del petróleo y el estado de Nigeria, y la capacidad de las fuerzas de resistencia de beneficiarse y creativamente usar el(los) espacio(s) y tratados para promover la agenda de emancipación social y democracia de base. 相似文献

AbstractThis article examines the French portrayal of Haudenosaunee culture and politics in the historiographic tradition established by the Jesuit writers in seventeenth-century New France. My aim in this paper is to expose a misrepresentation of Jean-Luc Nancy’s ideas on community in the secondary literature. I argue that discussions of Nancy’s work have failed to recognize a transformation that has occurred in his later thought, which distances him from Jacques Derrida. I propose that Nancy’s later work points the way beyond the “persistence of unhappy consciousness” in deconstruction through allowing for the possibility of the creation of a world alternative to globalization. Recognition of this transformation is suggestive for how Nancy’s theoretical framework might be employed in analyses of recent resistance movements. 相似文献

The immediate future of human services and information technology is examined in terms of their unifying principles and potentials. Effects on human relationships are used as a departure point to forecast changes in professional training and work and changes in the problems people experience. Professional training will incorporate high skill levels in the use and application of information technology. Changes in professional work may include more home based work and more automation of professional tasks. Changes in the problems people experience are addressed in four areas: (1) near consequences of life in an intellect intensive society; (2) human services subject to dramatic improvement; (3) information technology as a "male" technology; and (4) the growth in social support networks. Abstract This article is a short response to Chen's critique of our article ‘Asianing Australia: notes toward a critical transnationalism in cultural studies’. It is argued that Chen's attack on our article is misdirected. Furthermore, we are in substantial agreement with Chen on many issues, most importantly that the nation-state should not be the uninterrogated site for the development of a ‘local’ cultural studies. However, we find Chen's politics, and his use of a reductionist Marxist theory, overly simplistic. Moreover, the core/periphery binary which he uses is not adequate to express the complexities of a global capitalist world order in which the sites of power are becoming increasingly decentred. Similarly, the politics of resistance are also more complex than Chen suggests; resistance must be understood in relation to local situations and local tactics, as well as the imperatives of global capitalism. Finally, a properly localized and left-politicized cultural studies must reflexively interrogate the politics of theory, including Marxism, considering its specific ‘western’ history and recognizing the necessary partiality of theory in a post-colonial world of differentiated modernities. 相似文献

‘Being while black’ is ultimately an ‘everyday revolution’, Despite the fact that people manage their selves by their own choosing, especially as their desires are being shaped (Foucault, 1977), their selves remains the basic revolutionary unit. Foucault's oeuvre on power and concept of dressage is utilized to explain racial profiling of blacks of what I call ‘racial dressage’, intended primarily to discipline the ‘black body’ (el-Khoury, 2009). In this paper, I argue that despite this false sense of presence of power and internalized social-control, blacks actively construct their day-to-day activities as a discursive object of resistance. Critical awareness to racial oppression is in itself is a form of opposition to it (Collins, 1990). I argue that social control and resistance are coproduced. Using discursive analysis of interviews I identified the following modes of resistance: disposition to steadiness (constituting an ethical self, sustaining an internal dialogue, and emotional management), rejecting criminalizing identities, discursive consciousness, refusing the spatial power, and lastly disbelief in the system. Ultimately, blacks live against ‘themselves’ and this is because the soul that has become the prison of the body, is being dismantled (Luxon, 2008). 相似文献

This article discusses a unique groups of young ‘1.5 generation’ Jewish immigrant religious priests (kessoch) who were born in Ethiopia and immigrated to Israel, who cope with marginality and absence of legitimization by the religious establishment and by society. The article demonstrates that a complex cultural identity and behaviour pattern of syncretism is created among the religious priests, through selectively choosing aspects of identity which are meaningful for them. Their educated use of ‘fragments of identity’ and different tactics of resistance expresses a way for leaders of a minority group to cope with the reality they experience, and to find their place in the absorbing society. 相似文献
