行政行为的无效是一个具有特定内涵的范畴,它存在的理论基础是行政行为公定力的有限性,并以公民的抵抗权为其价值背景,但其在实践中功效的发挥还需要实定法上制度化的努力方能得以落实。文章在界定行政行为无效的基础上,对建立我国行政行为无效制度提出了若干构想。

加缪一向作为存在主义的荒诞文学家而被大家熟知,但透过其文本的分析可以看出,荒诞仅仅是加缪理性拷问世界的起点,其隐藏在荒诞背后的是爱、和谐、理性等核心价值观念,荒诞、非理性、差异仅仅是他理性反思的起点而已。     

高温超导薄膜微波表面电阻测试方法

介绍一种工作在12 GHz附近的高温超导薄膜微波表面电阻sR测试系统,该系统采用低损耗高介电常数的蓝宝石构成工作在TE011+δ谐振模式的介质谐振器,在77 K时,利用它对高温超导薄膜的微波表面电阻sR进行测试,提高了整个测试系统的品质因素,可成功地用于单片φ50.8 mm较大超导薄膜的无损伤测试,整个测试系统体积小、操作方便,且所需实验条件简单,测试灵敏度高,具有简便、快捷、适合于工业化生产检测的特点。     

新乡市第一人民医院儿科1997年至2008年急性感染性疾病的耐药性变迁

目的 了解新乡市第一人民医院儿科1997年1月至2008年9月急性感染性疾病主要病原菌分布及耐药情况.方法 采用全自动微生物鉴定系统及纸片扩散法(K-B法)对2 733株菌株进行药敏试验.结果 在2 733株病原菌中革兰阴性菌占59.4%,革兰阳性菌占36.4%,真菌占4.2%.对大肠埃希菌、肺炎克雷白菌、铜绿假单胞菌高度敏感抗菌药物为亚胺培南、多粘菌素.革兰阳性菌中占前三位的为金黄色葡萄球菌、凝固酶阴性葡萄球菌和肺炎链球菌,是儿童急性感染的主要菌群.耐甲氧西林凝固酶阴性葡萄球菌的比例逐年升高,2005年至2006年、2007年至2008年与2001年至2002年相比均有显著性差异(P=0.003或P=0.024).耐药率较低的抗菌药物为万古霉素、亚胺培南等.金黄色葡萄球菌多对青霉素、红霉素和阿奇霉素产生耐药性,且耐药率近年有普遍增高趋势.凝固酶阴性葡萄球菌耐药率逐年增高趋势尤其明显.肺炎链球菌对青霉素、红霉素、阿奇霉素、诺氟沙星、罗红霉素等高度耐药.结论 对儿童急性感染性疾病在用药前应尽快做细菌培养及药敏试验以指导临床合理使用抗生素,从而有利于减少耐药菌株的产生.     

Constructing Victims: The Erasure of Women's Resistance to Sexual Assault

How do the news media portray women's resistance to sexual assault? We analyze articles from a systematic sample of 16 U.S. newspapers across 1 full calendar year to assess whether and how newspapers describe women's resistance. We find that in most cases, newspaper reports reinforce the belief that women are incapable of effectively defending themselves. Most articles fail to mention women's resistance or do so only to note its failure; the longer the article, the more likely it is to follow these patterns. Headlines exaggerate these patterns, presenting virtually no evidence that the articles that follow, or that assaults themselves, contain any female resistance or agency. In only a very small minority of cases are women described as strong, competent actors with the ability to defend themselves against violence. We conclude with a discussion of the potential individual and societal consequences of these patterns.     

Cultural Studies in Black and White

Political intervention is deeply etched in the history and theory of Cultural Studies. The vehicle of intervention is typically understood as textual and the measure of success as ‘has it changed the world?’ This graphic and textual essay argues for and enacts thinking of and practising intervention more innovatively and more modestly: as equally extra-textual, and as a site for experimentation in the folds among theory, practice, and the quotidian. The author’s original black and white charcoal and pastel images are paired with text to explore the potential for an articulation of the visual and the textual to engage, convey, actualize, and produce concepts and insights of Cultural Studies. In evocative images and accessible language it enacts a new mode of engaging the theory and practice of Cultural Studies, specifically engaging concepts of articulation and assemblage, movement and things, questions of identity, the importance of affect, the power of transformation, youth cultures and resistance, The Black Lives Matter movement and matters of race, the struggles of women, the challenge of overcoming culturally engendered hatred of difference, and the difficulties of negotiating change in the precarious circumstances of contemporary culture.     

What’s on the Line?: Exploring the Significance of Gendered Everyday Resistance Within the Transnational Call Center Workplace

Abstract

Recent efforts on the part of International Political Economy (IPE) scholars to place an emphasis on the importance of everyday spaces and actors in analyses of the global political economy have largely tended to overlook the significance of gender. However, gender and other intersecting factors serve to inform everyday actions, which—as ‘everyday IPE’ scholars suggest—impact the international. Therefore I present a feminist everyday politics of the global economy (or FEPGE) approach that aims to provide a more nuanced understanding of the relationships between gender, everyday actions (in particular, resistance), and the international. Drawing on data from interviews with former transnational call center workers in Ontario, Canada, this approach is used to explore the significance of gendered everyday acts of worker resistance. I argue that along with the ‘feminization of labor’ within the industry, it may also be necessary to discuss the ‘feminization of resistance’.     

‘Behemoth Pulls the Peasant’s Plough’: Convergence and Resistance to Business Civilization in China

Abstract

It has been widely held that China’s development was forged from a unique pathway to that of Western countries. As a result, it has been assumed that China’s historical experience of modernization contains important lessons for other developing states. However, as we show, modernization in China can be seen as sharing many of the same assumptions of development as the West. Using insights from Cox’s work on civilizations—particularly the notion of ‘Business Civilization’ (adapted from Susan Strange)—our paper examines how modernization theoretic assumptions underpin both Chinese and World Bank perspectives on agricultural development not only within China but also across their engagements, policies, and practices of development throughout Africa. We argue that development constitutes a political project historically inseparable from La mission civilisatrice of Business Civilization, extending a form of intersubjectivity and materiality, power and rationality, based on a specific civilizational worldview. This process retains a number of contradictions and points of conflict and we focus on the resistances of traditional forms of civilization in contestations around the imposition of commercialized agriculture.
