论自然体权利及其保护

自然体权利能否在环境法中确认,是近几年来环境法学界一直探讨的话题。传统法学囿于人类中心主义的偏见,从权利、义务和法律关系理论否认自然体权利的存在。党的十九大报告中提出的“人与自然是生命共同体”理念从人与自然整体性视角重新解读自然体的主体性地位,为自然体权利的法律化进程提供了理论依据。针对我国自然体权利在法律规范上的缺失,借鉴国外自然体权利保护实践经验,我国应以自然互惠原则、风险预防原则为基础,以代理制度、公共信托制度、公众参与制度为实践方式,注重自然体受到损害时的补救,提倡自然法庭,构建人与自然生命共同体的自然权利观的中国方案。     

车用天然气储气技术

天然气用作汽车的代用燃料,具有储量丰富、价格便宜;辛烷值高、燃烧充分;低硫、低氮、无灰、环境污染少等优点。但是,目前的压缩天然气储气技术存在储气压力高、储气量小、续驶里程短等缺点,严重制约着天然气汽车应用领域的扩展。对5种车用天然气储气技术进行了分析讨论后,指出了吸附储存和近临界流体储存天然气技术在天然气汽车领域将有着广阔的应用前景。     

Why do participants in voluntary organizations leave? Exploring the relationship between value congruence and length of stay

Recognizing the importance of values and the specific characteristics of participants and situations in voluntary organizations, we examine how value congruence—the fit or compatibility of values between participants and the organization, or among participants—interacts with personal and situational factors to predict participants' length of stay in their organizations. Introducing the case of a voluntary organization that offers shared housing, we measure value congruence through textual similarity in the self‐introduction documents of 49 participants and the organization's mission statement. This approach differs from the self‐reported measures based on participants' perceptions or recalled interactions used in previous studies. In line with expectation‐disconfirmation theory, participants with the strongest beliefs in organizational values had shorter lengths of stay. The amount of intraorganizational communication also moderated the relationship between value congruence and length of stay. This study provides theoretical and methodological implications for nonprofit management by considering personal and situational factors and evaluating value congruence by textual similarity.     

西方平等理论从古典自然法学到新自然法学的嬗变

平等是一个非常复杂和抽象的范畴,西方法学对平等理论的热爱和追逐从未停止过,从古典自然法学追求的抽象的平等的政治理想,到新自然法学对平等的制度设计的现实关怀,平等理论随着自然法学的发展实现了其自身的嬗变,这种改变也是时代的要求、历史的必然。     

菲利普斯曲线在中国的有效性研究

从基本的菲利普斯曲线理论出发,提出了新的适应性预期模型,并以此为基础建立附加预期的菲利普斯曲线方程,进而估计出我国近年来的自然失业率水平,由此证明了菲利普斯曲线在我国的有效性,并描述了预期因素对实际通货膨胀水平的影响。最后结合实证分析结果提出解决我国通货膨胀和失业问题的建议,如保证货币政策的连贯性、加强信息披露、解决结构性失业问题等。     

Reframing Resilience: Equitable Access to Essential Services

We urgently need to put the concept of resilience into practice if we are to prepare our communities for climate change and exacerbated natural hazards. Yet, despite the extensive discussion surrounding community resilience, operationalizing the concept remains challenging. The dominant approaches for assessing resilience focus on either evaluating community characteristics or infrastructure functionality. While both remain useful, they have several limitations to their ability to provide actionable insight. More importantly, the current conceptualizations do not consider essential services or how access is impaired by hazards. We argue that people need access to services such as food, education, health care, and cultural amenities, in addition to water, power, sanitation, and communications, to get back some semblance of normal life. Providing equitable access to these types of services and quickly restoring that access following a disruption are paramount to community resilience. We propose a new conceptualization of community resilience that is based on access to essential services. This reframing of resilience facilitates a new measure of resilience that is spatially explicit and operational. Using two illustrative examples from the impacts of Hurricanes Florence and Michael, we demonstrate how decisionmakers and planners can use this framework to visualize the effect of a hazard and quantify resilience-enhancing interventions. This “equitable access to essentials” approach to community resilience integrates with spatial planning, and will enable communities not only to “bounce back” from a disruption, but to “bound forward” and improve the resilience and quality of life for all residents.     

国际资源贸易理论与政策的研究述评

近年来,国际资源贸易发展迅猛,其重要性日益凸显。国际贸易学者从理论与政策两方面对国际资源贸易进行了研究。理论研究涵盖H-O模型对国际资源贸易的解释力、不完全竞争市场下国际资源贸易的分析框架、国际资源贸易产品价格波动的原因与价格弹性估计、国际资源贸易与"资源诅咒"的关系等问题。政策研究主要包括对国际资源贸易实施的出口税、出口配额以及进口关税的经济效应分析等。目前,学术界还没有形成统一的国际资源贸易分析框架,WTO需要把国际资源贸易置于多边贸易体制的规制之下。
