Participatory action research and researcher’s responsibilities: an experience with an Indigenous community

This paper seeks to explore the relational participatory action research (PAR) frameworks that have been developed to allow non-Indigenous researchers, along with Indigenous co-researcher participants, to learn and honour Indigenous stories. Specifically, in the context of PAR research in the Chittagong Hill Tracts of Bangladesh, we outline: (a) potential challenges between Indigenous research paradigms and Western research paradigms, (b) the situation of the non-Indigenous researcher in relation to the Indigenous community, (c) challenges associated with the non-Indigenous researcher’s selection of a research site, (d) collaboration throughout the research process and (e) the processes of developing and maintaining responsibilities. The aim is not to offer simple answers to such challenges, but to highlight the manner in which such processes can be addressed. This research may provide practical insight for future non-Indigenous researchers working with Indigenous communities through a participatory sharing process with Indigenous co-researcher participants, Elders, leaders, knowledge-holders and youths.     

我国农村环境问题的法治根源及对策——基于权力与权利因素的思考

目前我国农村环境形势严重,这一问题产生的主要原因在于农村环境管理权力和农民环境权利失衡。在权力方面,主要体现在责任不够明确,环境信息不公开和权力受到的制约较少;而在权利方面,主要体现在农民的环境意识、环境维权能力不强和维权渠道不通畅。为此,应加强对农村环境管理权力的制约,强调其应有的责任,保证农民的环境救济权并加强对生产过程的指导。     

采矿业环境信息披露实证研究

基于社会责任的相关理论,从利益相关方、企业基本特征和治理结构三个方面对影响我国采矿业上市企业环境信息披露的因素进行实证研究,并评估了这些企业环境信息的披露水平。实证数据来源于企业发布的2010年CSR报告和年报。实证研究发现:采矿企业的环境信息披露水平很低,大企业倾向于披露更多环境信息,CSR报告对环境信息披露水平有显著的提升作用,企业治理结构、股东、债权人、外部审计机构并没有在企业环境信息披露方面发挥显著作用。最后,本文还根据研究结论提出相关的政策建议。

司法实践中，许多犯罪行为本身就是严重的侵权行为，于是产生刑事责任与民事责任竞合的问题。随着社会的进步和法律的进化，刑事责任与民事责任经历了一体到分立再到交错的历把发展轨迹。随着恢复性司法的倡导，被害人实益的关注和刑罚谦抑性的提出，刑事责任与民事责任出现交融的格局。如何实现刑事责任与民事责任的衔接与协调，已成为刑法学者与民法学者面临的共同课题。本文以损害赔偿为视角，从功能、次序、程序等方面对此问题作初步性的探讨。     

论政府的道德责任

现代社会对政府提出的挑战与政府的道德责任问题相关。政府在其进行决策和采取行动时尽管有多种多样的理由,但必需承担相应的道德责任。政府之所以应该承担道德责任,是由建立良好社会秩序、促进社会发展与规范政府行为的需要所决定的。政府只应该承担适度的道德责任。这种适度的道德责任主要包括实现个人权利、提供公共物品与推动社会发展。为了实现这些责任,政府就需要健全制度、经营实体与合理行使权力。     

Absence Because of Family Responsibilities: An Examination of Explanatory Factors

This article presents findings from the first comprehensive study of the determinants of absence from work caused by family responsibilities. Two types of absence—absence to care for ill family members and absence for other family reasons—are considered. Data from a sample of 2,642 Australian employees are used to test six hypotheses. Results suggest that absence caused by family illness varies by sex, that job satisfaction is related to men's but not women's absence for family illness, that workplace flexibility is related to women's but not men's family-related absence, that child care arrangements are associated with the probability of absence for family illness for parents of preschoolers, and that the presence of dependent children is strongly related to absence for family reasons.
