关于法规至上的思考

学报责任编辑这一编辑职位有两个属性:一是权力,二是责任,责任是其本质属性。坚持法规至上,是责任编辑承担编辑责任,依法从事编辑活动的底线。法规至上包括两个层次:一是要认真遵守各种出版法规,包括法律、行政法规、地方法规、国务院部门规章和地方政府规章,在具体工作中落实学报禁载内容、保守秘密、载转稿件必须符实、防止侵权、规范用字等规定;二是要在管理上形成一套按法规运行的机制。     

论经济发展中的金融效率

金融是现代市场经济的核心,金融运行的效率状况对经济社会的健康发展,具有十分重要的意义。当前,我国的金融效率还不十分理想。借鉴西方金融效率理论,通过深化金融体制改革,提高金融机构和金融市场的运行效率,高效合理地配置和使用有限的金融资源,以最大限度地发挥金融对经济的促进作用是我们在实践中迫切需要解决的问题。     

第三人侵害债权制度研究——兼评《侵权责任法（草案）》学者建议稿

我国现行合同法坚持相对性原理,没有对第三人侵害债权进行相应规定,对债权人保护不足。侵权责任法立法中是否应当对此进行相应规定？如何进行规定？等等问题亟待解决。通过对德国和我国台湾地区等相关立法和实践进行考察,不难发现通过侵权责任法保护债权既有必要也有可能。民法学者应当在行为自由和权益保护之间进行衡平考量,并进行类型化研究,从而构建我国的第三人侵害债权制度。     

价格传导问题综述及量化分析

本文通过对国际市场价格变动向我国市场价格传导②、我国上游产品价格变动向下游产品价格传导的定量与定性分析,描述了国际市场价格向我国市场价格传导,以及我国上游行业价格向下游行业价格传导的规律,并据此对“上下游产品价格传导阻滞”问题进行了解释③。通过分析,得出初步结论：当前我国上游产品价格上涨向下游产品价格的传导已充分显现,并不存在阻滞问题,上下游产品市场竞争格局不同是导致其价格传导变动幅度不一致的主要原因。     

专利法不正当行为原则的功效及正当性研究

作为一种司法创制原则,美国专利法不正当行为原则在规制不正当专利申请、提升专利申请授权质量方面发挥着积极作用。但对该制度进行本土化的前提是需要充分论证该制度下的信息披露义务以及专利不可执行性的正当性。专利契约论下的对价和正义原则能够对这两方面给予充分证实：专利契约论下的实质对价要求专利申请人的信息披露义务应延伸至专利申请人所知悉的与专利申请的可专利性相关的所有信息;在正义原则之下,专利权人对其通过不正当行为而获取的专利权的主张行为使其不正当行为延伸至司法程序,法院拒绝向其提供司法救济是正义原则的应有之义。     

Best Practice to Order Authors in Multi/Interdisciplinary Health Sciences Research Publications

Misunderstanding and disputes about authorship are commonplace among members of multi/interdisciplinary health research teams. If left unmanaged and unresolved, these conflicts can undermine knowledge sharing and collaboration, obscure accountability for research, and contribute to the incorrect attribution of credit. To mitigate these issues, certain researchers suggest quantitative authorship distributions schemes (e.g., point systems), while others wish to replace or minimize the importance of authorship by using “contributorship”—a system based on authors’ self-reporting contributions. While both methods have advantages, we argue that authorship and contributorship will most likely continue to coexist for multiple ethical and practical reasons. In this article, we develop a five-step “best practice” that incorporates the distribution of both contributorship and authorship for multi/interdisciplinary research. This procedure involves continuous dialogue and the use of a detailed contributorship taxonomy ending with a declaration explaining contributorship, which is used to justify authorship order. Institutions can introduce this approach in responsible conduct of research training as it promotes greater fairness, trust, and collegiality among team members and ultimately reduces confusion and facilitates resolution of time-consuming disagreements.     

Love is Not All You Need: A Revolutionary Approach to Parental Abuse

This case story is a composite of similar family situations where the parents were at risk of harm from their teenage children and commonly the father/step‐father has moved out of home leaving the mother to parent the children on her own. Several of these cases involved physical threats to the lives of the parents. These referrals occurred in a Child, Adolescent and Family Mental Health Service and a Family Therapy NGO between 1985 and 2005. This approach is offered as a complement to the widely published ‘non‐violent resistance’ approach of Haim Omer and his colleagues. We hope it goes some way to address what Lavi‐Lavavi et al ( 2013 , Journal of Systemic Therapies, 32(4), 79–93). describe as ‘the mother's plight’:

The plight of the mother continues to present a major challenge… We are also seeking ways to allow the mother more breathing space, help her to disengage from abrasive conflicts, acknowledge her contribution and sacrifice, and provide her with vantage points that may help her recognize and enhance small improvements. Hopefully, these measures will enable women to evolve from unacknowledged victims to pillars of the family’ (p. 92).

     

What are Social Work Students’ Perceptions of the Community Practice Method?

Summary. A unique aspect of the social work profession is the combination of intervention on the personal, community, and societal levels and their interaction. The purpose of this research is to determine students’ perceptions of community practice. Qualitative research was conducted among Israeli social work students before gaining any practical experience in community practice. Findings. The results demonstrated a change in students’ perceptions of the importance of community practice to the profession, and the factors that contributed to this change. Applications. Recommendations that may contribute to changing students’ perceptions of community practice are offered to educators.     

Trans-ideological business values in international codes of conduct

Traditionally, scholars of international business have been unconcerned with ethics and values, in part due to the widely-held belief that standards vary across cultures and ideologies. Recently, however, business ethicists have considered whether there are some business-related values that are shared across cultures. Through an analysis of the codes of conduct for multinational enterprises of four international organizations, five trans-ideological business values are discovered. They are national sovereignty, social equity, human rights, market integrity and organizational autonomy. The consensus in values is critically important for both scholarship and management.An earlier version of this paper was presented at the Second Annual Meeting of the International Association of Business and Society (March 1991).
