论民族自治机关立法的“变通”权——对《立法法》第66条第2款的理解

西方历史法学派代表人物萨维尼就提到法律随民族而成长民族自治地方立法变通权是自治权中的重要内容,是民族自治法规立法的灵魂。本文正是建立在这样的一个立论上重新考虑和评析了《立法法》第66条第2款,通过从民事的和刑事的两个方面的案例来洞见出这款但书背后的实践窘境,反复考量这样的立法例究竟是否属于形式上的合宪还是实质上的违宪。

欧盟共同金融政策的发展与调整

欧盟共同金融政策成型于1986年开始的欧共体单一市场计划,其目标是建立高效、富于竞争性的共同体单一金融市场,促进区域经济增长.其发展经历了区域内金融开放以及金融服务行动计划下的规则和谐化两个阶段,推动了欧盟金融一体化程度的提高,金融服务业市场竞争与效率的改善.但是,欧盟单一金融市场建设中还存在一体化程度不均衡等诸多问题,欧盟当局将在金融服务行动计划的基础上,推动金融部门欧盟内的动态重组进程,调整金融监管思路,以全球性视野处理内部金融问题,实现既定的金融发展目标.     

Measuring the effects of oil price and Euro-area shocks on CEECs business cycles

Assessing the cyclical alignment of national business cycles with the Euro-area one is of great importance in order to guide policy decisions concerning the enlargement of the Euro area. To this end, in this paper we aim to measure the effects of external macroeconomic shocks on business cycles of Central and Eastern European Countries, not yet Euro-area members. Using quarterly data from 1999 to 2015 and the structural near-VAR methodology, we focus on the effects of Euro-area monetary policy and global oil price shocks on prices and output of the analyzed countries. Results show that business cycle fluctuations are mainly explained by domestic shocks in the short run, while monetary policy and oil price shocks play an increasing role in the medium run. Adding domestic fiscal shocks, the overall picture does not change significantly, since fiscal policy turns out to be a minor driver of business cycle fluctuations in CEECs. In the whole, our findings do not support an Euro-area enlargement at short horizons.     

Likelihood-based panel cointegration test in the presence of a linear time trend and cross-sectional dependence

This article proposes a new likelihood-based panel cointegration rank test which extends the test of Örsal and Droge (2014 Örsal, D. D. K., Droge, B. (2014). Panel cointegration testing in the presence of a time trend. Computational Statistics and Data Analysis 76:377–390.[Crossref], [Web of Science ®] , [Google Scholar]) (henceforth panel SL test) to dependent panels. The dependence is modelled by unobserved common factors which affect the variables in each cross-section through heterogeneous loadings. The data are defactored following the panel analysis of nonstationarity in idiosyncratic and common components (PANIC) approach of Bai and Ng (2004 Bai, J., Ng, S. (2004). A PANIC attack on unit roots and cointegration. Econometrica 72(4):1127–1177.[Crossref], [Web of Science ®] , [Google Scholar]) and the cointegrating rank of the defactored data is then tested by the panel SL test. A Monte Carlo study demonstrates that the proposed testing procedure has reasonable size and power properties in finite samples.

面对不同专业背景的师范生,以被压迫者剧场理论、建构主义理论和心流理论为基础,开展表演构建的创新探索有利于提升教学资源的生成性、多元性和包容性,符合师范生教育政策导向、教师专业发展诉求和课程优化需要。表演构建的组织实施包含6个步骤,"如坐针毡"是其中的关键环节。历时7个学期,覆盖16个专业1 160名师范生的研究实践证明：师范生教育学公共课开展表演构建对于提升课程的师生参与度和师范生的逻辑思辨能力有显著的正向作用,创新教学形式的同时也体现出一定的研究品质,值得在师范教育阶段推广。     

论情教思想与对佛教的态度——从冯梦龙的《醒世恒言》说起

将情视为天地间一切生命的本源,以情为伦理道德是冯梦龙情教思想的核心。他企图以情为基础构建完美的社会道德体系,却在"三言"中表现出种种背离自己的情教思想本意的言行。文章从《醒世恒言》对佛教既抨击又推崇的矛盾态度进行论述,认为作品对佛教的态度与情教思想相背离,主要是时代与个人因素造成的。
