学生自主性发展的个案研究

运用质的研究的方法,选取一所学校作为个案,对学生自主性发展现状进行长期实地观察和调查.得出如下结论小学生与初中生,儿童与少年,代表着自主性发展的两个不同阶段,表现在师生互动关系上,在内容和形式上也有所不同.小学阶段要加强自主意识的培养,中学阶段要为学生自主性的发展提供机会和条件.

Mobility and Privilege Within Queer Studies and University

In this essay, the author considers how classist divisions present within queer studies may well be exacerbated by the institutionalization of queer studies within university. In particular, she examines the class privilege that attends both queer theory's and university's deployment of travel metaphors. In both cases, the language of travel is the potentially empowering language of intellectual agility and social mobility. Importantly, though, both queer theorists' and university administrators' employment of travel metaphors often serves to reaffirm cultural hegemony, specifically to sustain rather than to examine and combat social oppression. This sad irony is particularly apparent when one compares university representations of commuter and residential students. Thus, the question that faces universities is how to keep queer studies critically queer so that universities can recognize and address the various forms or models of social mobility that are present on their campuses, commuter as well as residential.

Through the lens of Supreme Court simulations, this article provides educators with a viable, classroom-tested lesson plan to bring Problem-Based Learning into their classrooms. The specific aim of the lesson is to provide students with an opportunity to engage in relevant and powerful civics education.     

Preventing Elder Abuse and Neglect Through Advance Legal Planning

Recent trends in adult protective service literature and legislation reflect a growing interest in advance planning to prevent elder abuse and neglect. This article provides basic planning guidelines and discusses in general terms the most important legal planning documents: the living will, the durable power of attorney for health care, the durable power of attorney, and the last will and testament. It also presents in general terms potential legal, medical, and financial planning tools that may function as alternatives to guardianship. Both the benefits and limitation of these documents and tools are discussed.     

Issues in Promoting Adult Foster Care as an Option to Institutionalization

Adult foster care is a semi-institutional living arrangement that stresses the importance of providing care in a family-like environment. This article examines the concept of adult foster care and some of the issues relevant to the development of such programs. Policy issues related to the implementation of programs are also discussed. As a unique option to institutionalization, adult foster care has much to offer if certain barriers can be eliminated or minimized.     

What do lesbians do in the daytime? Recover

This paper examines a narrative taken from an ethnographic interview, for the speaker's conversational construction of lesbian and other identities along with ideologized personal history. To tell her story, Marge shifts to the discourse style used in the meetings of addiction recovery groups. She prioritizes the recovery (twelve-step) program's coherence system, structuring her life story in conformity with its terms while narrating a complexly queered identity. Four analyses are given, beginning with a Labovian formal examination and proceeding with a consideration of three types of discourse echoing: interdiscursivity, intratextuality, and manifest intertextuality. This study demonstrates the analytical linking of nonpublic linguistic discourse to social discourses; individual identity construction to social construction (and its coherence systems); and personal history to historical eras. The paper adds the concept of a metalevel complicating action to narrative theory and develops a means of examining intratextuality for critical discourse analysis. It presents a revised view of essentialism for the sociolinguistic study of gender and sexuality.     

走出“术前签字”制度的困境——从肖志军案切入

按照我国现行的法律制度，在解决肖志军案时应当适用《执业医师法》第24每。但是它在现实中却被《医疗机构管理条例》中确立的“术前签字”制度所架空。试图通过对“术前签字”制度进行革新从而走出“术前签字”的尴尬困境仍然不是一条一劳永逸的良策。只要权利保护的外部成本存在，《执业医师法》第24条就有再次被架空的可能。提高社会信任度，便是破解“术前签字”困局进而激活《执业医师法》第24条最终的钥匙。     

刑事自诉中止审理研究

2006年笔者选择了四川五个区县进行刑事自诉案件的调查，调查采取查阅档案和访谈等方式进行。通过调查，发现自诉案件立案后在遇到被告人下落不明的时候，法庭裁定中止审理的案件越来越多。但是法庭中止审理之后。自诉案件就被搁置起来，原告的权利得不到维护，附带民事诉讼事实上被终止，由纠纷带来的社会秩序的裂痕无法平复。一些基层法院变通的处理办法是劝说原告撤诉，并告之将来被告出现后可再行起诉，但是这样的变通在法律上又是行不通的。因此，要解决目前在刑事自诉案件中止审理程序中的不足之处，就有必要建立起我国的刑事缺席审判制度，从而有效的解决纠纷。保护公民的合法权利。
