亲子关系的确认是亲子法的基本问题。在传统法中,它由婚生子女的推定与否认、非婚生子女的认领与准正组成。当代亲子法以子女为本位,对子女不再作"婚生"与"非婚生"区分。未成年子女最佳利益和兼顾亲子关系真实性与稳定性,成为亲子关系确认的基本原则。统一的亲子关系确认制度由亲子关系的推定、亲子关系的否认、子女的认领构成。婚姻法司法解释应对有关子女否认和认领的实体法规则作出解释。  相似文献

Management, human resources, organization, control, leadership, etc., all seem to be just so many euphemisms for power, and this suggests a discourse of management and organization that calls things by their proper name. This paper on the contrary stresses the need to resolve the concept of ‘power’ itself into more differentiated notions, and proposes that clarification may be derived from distinctions once explicit in the vocabulary of Classical antiquity, but lost in modern European languages. It argues that nothing but confusion in thinking about organizations, management and legitimation can result from the failure to recognize that the phenomena this vocabulary identifies and distinguishes are irreducibly different.  相似文献

Is it true that either the EU will be democratised or it will disintegrate? I concur that the current policies, principles, and institutions of the EU both generate counterproductive politico-economic effects and suffer from problems of legitimation. These effects and problems, which are not confined to Europe, give rise to tendencies towards disintegration. My second point concerns the timing of the required learning and reforms. Modest policy proposals and tentative steps within the existing EU Treaty framework may be too little too late. The question is whether there is enough time for deeper transformations in Europe—and also globally.  相似文献

Multi-stakeholder initiatives (MSIs) are often referred to as the ‘gold standard’ of private governance. However, existing MSIs vary strongly in their institutional designs and the ways in which they use inclusiveness, procedural fairness and, expert-based strategies to create legitimacy for their rules. This article investigates these institutional choices. It reviews arguments about demand from legitimacy-granting audiences, isomorphic pressures, and the role played by institutional entrepreneurs, and intergroup bargaining. It explores these mechanisms in an empirical investigation of the formation of three MSIs in the field of sustainable agriculture. Its findings advance our understanding of the conditions under which MSIs adhere or depart from normative ideals of democratic governance.  相似文献

The private security industry is often represented - and typically represents itself - as an expanding business, confident of its place in the world and sure of its ability to meet a rising demand for security. But closer inspection of the ways in which industry players talk about its past, present and future suggests that this self-promotion is accompanied by unease about the industry's condition and legitimacy. In this paper, we analyse the self-understandings of those who sell security - as revealed in interviews conducted with key industry players and in a range of trade materials - in order to highlight and dissect the constitutive elements of this ambivalence. This analysis begins by describing the reputational problems that are currently thought to beset the industry and the underlying fears about its status and worth that these difficulties disclose. We then examine how security players seek to legitimate the industry using various narratives of professionalization. Four such narratives are identified - regulation, education, association and borrowing - each of which seeks to justify private security and enhance the industry's social worth. What is striking about these legitimation claims is that they tend not to justify the selling of security in market terms. In conclusion we ask why this is the case and argue that market justifications are 'closed-off' by a moral ambivalence that attaches to an industry trading in products which cannot guarantee to deliver the condition that its consumers crave.  相似文献
