对于知识产权侵权类案件中的商品收货地是否具备管辖权这一问题,有观点认为网购商品收货地为合同履行地,也有观点认为是侵权行为地。上述观点是对民诉法司法解释第20条中的“信息网络方式”以及民事诉讼法第28条中的“侵权行为地”存在不当理解。如果认为网购收货地法院具备管辖权,则会与《民事诉讼法》中“两便原则”之立法精神相抵牾,同时也没有充分考虑到网络销售环境中知识产权侵权的特点。应当明确网络销售收货地并非网络环境下侵犯知识产权案件的管辖连接点。同时参考比较法上的做法,通过“最低程度联系”原则以及滑动标尺法Zippo交互性测量分析的方法,来判断被诉网站是否具有交互性特点,从而确定适合的管辖地。除此之外,立法和司法实践中也可以通过确定保护性管辖原则以及强化当事双方签订管辖协议等做法,来促进对该问题的化解。 相似文献

Relatively little is known about the effects of aggregate economic conditions on first-birth timing. In this paper, we argue that aggregate economic conditions are important macrolevel forces driving the transition to parenthood. We develop and test a causal model, separately by race, in which economic conditions influence both marital status and first-birth timing. Our results indicate that economic conditions are significant predictors of both outcomes, with economic conditions for females having effects different from those for males. A particularly noteworthy finding is that favorable wage trajectories for females lead to a decreased likelihood of being married and slower birth timing (a finding opposite to that predicted on the basis of opportunity costs). For blacks, the majority of the effects of economic conditions on the transition to parenthood are direct, while for whites a significant proportion of effects are indirect through marital status. 相似文献

The authors contend that employer-initiated workplace policies should be considered as part of the patchwork that constitutes
U.S. family policy. To provide a background, historical evidence of employer-initiated policies intentionally used as family
policies is summarized. The view is then explicated that failure to take economic conditions and workplace policies into account
may lead to faulty conclusions about the reasons for major changes in family life. The current status of selected employer-initiated
workplace policies and recent trends is summarized. Next, some of the dilemmas inherent in considering connections between
government- and employer-initiated policies are identified. Finally, suggestions for future directions are offered. The article
should be considered with the following caveat in mind: the focus is exclusively on the influence of policies on families,
but families are not merely reactive.

Subset Selection in Linear Regression using Sequentially Normalized Least Squares: Asymptotic Theory
This article examines the recently proposed sequentially normalized least squares criterion for the linear regression subset selection problem. A simplified formula for computation of the criterion is presented, and an expression for its asymptotic form is derived without the assumption of normally distributed errors. Asymptotic consistency is proved in two senses: (i) in the usual sense, where the sample size tends to infinity, and (ii) in a non‐standard sense, where the sample size is fixed and the noise variance tends to zero. 相似文献

For the construction of enterprises’ soft power in minority areas, the biggest resource is the local original ecological culture, which transforms into the soft power of enterprises in minority areas, and cultivates the core competitiveness of enterprises, so as to promote the rapid growth of enterprises in these areas, to go out of these regions, and to provide new impetus for local development. Minimum factor theory tells us that in minority areas, the key to the success of soft power construction is to find the gene of enterprise culture from the original ecological culture, so as to build a unique soft power system, realize the development of enterprise clusters, and then drive the rapid progress of regional evolution. Since the implementation of market-oriented reform, the economic history in these areas shows that those enterprises not only achieve rapid development, but contribute to local economic development as the leaders in specific fields, with the transformation of original ecological culture into their own soft power. 相似文献
