对网络交际的思考

网络交际现今已经成为很多人生活的一部分,通过网络空间人们交流更加便捷,更加丰富。网络交际对我们的现实社会文化和人际交流有着深刻的影响和冲击。网络交际弱化了文化因素对交际主体角色的制约和影响;网络交际的开放性使不同文化的人更容易交流和相互认同,弱化了本土文化对人际交往的影响;网络交际形成的特殊文化,引起了文化的碰撞和交融;网络交际的不真实性加剧了人与人的信任危机;网络交际信息与真实信息的差异,及网络上对他人隐私的侵害给日常生活交际带来了不利的影响。     

Electronic monitoring,an alternative way of preventing aggression and helping social rehabilitation

Abstract

It has been said that Criminal Law is violence not only because of what it punishes, but also because of the way it does it. Violence is present in all human relationships, and as such, it is consubstantial to every system of social control. Despite this, the failure of imprisonment has not been its severity, but its inefficiency regarding social rehabilitation. This lack of efficiency can be palliated through the use of alternative systems of electronic monitoring in the penitentiary context. These alternative systems will not only enable an effective solution to the problem of overcrowded prisons, but will also mitigate the harmful effects of prison. Moreover, these alternative systems represent a good method to prevent future aggressions as well as to facilitate the offender's social rehabilitation. From this point of view, we will first explain the programs of electronic monitoring in Spain and second we will evaluate them in terms of social rehabilitation, cost-benefit analysis, human rights restrictions, privatization and overcrowding in prisons.     

论基因权

随着基因技术的飞速发展,基因权将成为人类21世纪的一项新型权利,这项权利包括两大方面的内容,即关于基因资源权和基因技术知识产权。关于基因资源权的保护,应该针对我国的国情,通过修改宪法有关资源所有权的条款、确立新的资源所有权机制、制定专门的基因资源保护法等来实现。关于基因技术知识产权的保护,应采取综合保护战略,实现全方面的保护,特别是对农民群体的有关权利的保护。此外还有基因隐私权的保护,基因产品消费、使用过程中的安全权的保护问题。     

The reliance on recognition and majority vote heuristics over privacy concerns when selecting smartphone apps among German and US consumers

The smartphone app market is a prime example of a digital market where consumers are tasked with selecting one option among a plethora of alternatives, at times indistinguishable from one another. Building upon findings on information processing and decision-making, we postulate that consumers follow simple (rather than complex) heuristic rules to navigate the app market. In particular, we focus on two such strategies: the recognition heuristic and the majority vote heuristic. App privacy information was also considered as a potentially salient cue in the decision-making process, given the personal data stored on smartphones. Results of a mixed-method design (behavioral analysis and think-aloud protocols) study with German (N?=?18) and US (N?=?25) students find a dominance of the recognition heuristic. Decisions are further supported by majority vote heuristics. Privacy information is largely disregarded, particularly by US participants. Implications for app market design and engagement are discussed.     

互联网征信中个人信息权益保护探析

互联网金融带来了征信业务需求的与日俱增,也带来了大数据背景下互联网金融个人征信行业的兴起与发展。我国现有征信行业的法律监管体制一方面滞后于时代发展,无法适应个人征信的互联网模式,另一方面存在信息主体权益保护的法律监管不到位的问题,故而亟待加快完善和构建出全新的互联网金融个人征信的法律监管体系,健全法律监管体制下信息主体的合法权益保护制度。     

SEXUAL PRIVACY AND EARLY SEXUAL DEBUT IN NAIROBI INFORMAL SETTLEMENTS1

The purpose of this paper is to examine sexual privacy as a factor that may influence the relatively earlier sexual debut among the urban poor in Nairobi. 40 focus group discussions were held with people aged 13–17, 18–24, 25–49 and 50+ years, community leaders and service providers in four informal settlements of Nairobi. Lack of sexual privacy was identified as a major problem. Although adults were reported to use various means to acquire some measure of privacy, such as waiting for children to fall asleep, switching off the lights and separating the sleeping areas using curtains, these measures were found inadequate. The participants therefore associated young people's early initiation of sexual activity with lack of sexual privacy. Sexual privacy has not received adequate research attention as a dimension of poverty that influences young people's sexuality. More studies are called for to unravel the specific association between sexual privacy among adults and young people's sexual behaviour. The living conditions of the urban poor should also be addressed to mitigate the effects of lack of sexual privacy.

针对目前频繁出现的公众人物状告媒体的官司,笔者就媒体与明星隐私权的问题进行了浅析.分别从明星隐私权是否应该受到保护、明星与媒体之间的官司缘何不断以及如何避免官司出现三个方面加以分析,试图提出解决问题的办法.

自媒体环境下隐私信息的公开化及其治理

自媒体环境下隐私信息具有公开化的趋势,表现为隐私信息传播的去边缘化,隐私所有人成为主导者,隐私公开成常态。阴私、身份、财富和观念是公开化的主要隐私类型。传播隐私信息对抗伦理道德可以轻易引起社会关注和自媒体把关权弱化,传播自由度增大是隐私信息公开化的主要原因。隐私信息公开化过度放大了娱乐信息,导致严肃信息失语;强调了传播的自主性,忽略了对"他"者的影响。促进自媒体的发展和媒介生态的净化,需要媒介监管者对信息进行分级,自媒体经营者履行"把关权"职责并适当地引导用户,自媒体用户提高自身媒介素养。     

论刑事诉讼中私人违法取证的排除问题

目前我国的非法证据排除规则是否适用于私人违法取证尚不明确,导致司法实践中对这一问题的处理无法可依。通过结合域外的经验以及我国司法实践中辩方在取证举证上仍处于弱势地位的现实状况,对于私人以违法方式取得的证据以不排除为原则可能更为合理。在这一原则下应兼顾公民隐私权的保护和被告人的权利保护。这样的做法不但可以与新《刑事诉讼法》的内容协调一致,还顾及了我国目前私人取证的极大需求和弱势地位,同时也不致一味采纳所有违法取得的证据而造成更大的侵权。此外,一些相关的制度措施也必须完善,以期在明确易行地解决私人违法取证问题的同时,也能够预防未来的私人违法取证现象。
