董仲舒王道论浅析

董仲舒将王道之依据上溯于天,认为是圣人承天意以从事的结果,并将人间的统治者确定为天之子,由此论证了现实政权的合法性;同时,他又通过"天立王以为民也"的设定,将人间统治者的统治置于以天道为依据的王道的规制之下。在此基础之上,他结合现实,对儒家视域中与王道相对的霸道,进行了论述,认为王霸皆本于仁,将儒法结合,并在治道层面主张德主刑辅,大德小刑,从而把儒法结合后的政治行动力契入儒家,使其主张具有非常强烈的现实感和可操作性。由此,中国近千年的霸王道杂之的治道模式在一定程度上得以确立。     

《儿女英雄传》中的副词“都”及其语法化

《儿女英雄传》是《红楼梦》通向现代北京话的中途站,通过它可以了解汉语在19世纪中期的基本面貌。当时,副词“都”已具备表示范围和表示语气等用法,其语气副词用法中有一类兼表已然义。根据《儿女英雄传》中反映的语言事实和语法化的一般规律,副词“都”的语法化路径应该为“范围副词→语气副词→兼表已然义的语气副词”。

社会主义法治理念是检察文化建设的根本指针,检察文化是社会主义法治理念的有效载体,两者互为依存,相互促进。社会主义法治理念在检察工作中深化与拓展的最终归宿是:符合社会主义法治理念核心要求的检察文化的形成。社会主义法治理念在检察工作中深化与拓展的基本路径是通过检察文化建设实现司法理念从宏观层面向微观层面的转化,即打击犯罪与保障人权相统一、程序正义与实体正义相统一、协作与监督相统一、法律效果与社会效果相统一、案件数量与案件质量相统一。     

Crying for Food: The Mexican Myths of ‘La Llorona’ and ‘The Hungry Woman’ in Cherríe L. Moraga

The Mexican legend of ‘La Llorona’ (‘The Weeping Woman’), who drowned her children out of revenge for being abandoned by her lover, and the Aztec creation myth of ‘The Hungry Woman’ — crying constantly for food, with mouths all around her body — have inspired Chicana writers in the symbolic representation of their own yearning, be it sexual, identity-building, or anti-patriarchal. This essay seeks to lay the mythical groundwork within this topic, as well as to illustrate with some particular examples the different reappropriations of these myths in Cherríe L. Moraga, mainly in her play The Hungry Woman: A Mexican Medea (2001). With a view to opening up a past ‘that can provide a kind of road map to our future’ (: ix), these examples of transgressive women will be deprived of the feminine colonial passivity imbued by the dominant male discourse, and analysed as a complex, active, polyvalent mythological female corpus that integrates both life and death, womb and grave. This hybrid approach is inherent to the Aztec mythology on which Moraga relies in order to transcend Manichaeistic resolutions and probe the social, political, and gender reasons leading a hungry mother to commit infanticide.     

‘Recuperando la dignidad humana [Recovering human dignity]’: Shuar mothers speak out on intercultural bilingual education

This paper presents findings from interviews conducted in December 2011, with seven Shuar mothers of children in an intercultural bilingual school in the southern Amazon region of Ecuador. This study had two objectives: (1) to foreground the perspectives of Shuar parents towards intercultural bilingual education (IBE) as implemented in the Shuar pedagogical institute, and (2) to collaborate as an intercultural research team (North American-Shuar) to ensure linguistic and cultural authenticity of data collection, and analysis. As a Shuar mother herself, the co-author shares the same language and culture as the participants, which led to a deeper level of trust and openness in the interviews. Current studies claim that IBE is losing ground, partly because parents want their children schooled in Spanish – the language of power – and see the IBE system as inferior. However, these Shuar mothers expressed a different concern: IBE has been too intertwined with Salesian missions and must become decolonized in order to reflect authentic Shuar cultural values and educational practices.     

Continuity of Mental Health Care Across Military Transitions

Multiple deployments, a prominent characteristic of operations Enduring Freedom, Iraqi Freedom, and New Dawn, have been linked to increased risk for various mental health conditions. It is also well known that military transitions, such as a change of duty station or discharge, are an inevitable part of military life. While military transitions can be stressful for any service member or veteran, those with mental health conditions face additional challenges. Transition stress can exacerbate a mental health condition that in turn hinders ability to manage the transition, resulting in a cycle of stress. As a result, those receiving mental health care while transitioning often experience difficulty continuing treatment post-transition. This article describes a unique and innovative transition coaching program designed to address this emerging issue.     

日本明治后期《支那语学》月刊传播北京官话的历史意义

《支那语学》创刊于1907年6月,是当时世界范围内推广北京官话、传播中国文化最为重要的学术月刊之一。该杂志栏目设置很有创意:从教学角度安排北京官话语言基本知识学习内容;从培养语言学习能力角度安排汉日译解、翻译、写作、阅读基本能力训练内容;强调中国文化导入,加深读者对北京官话的整体性理解;以月刊为手段,迅捷传播中国信息,引发读者兴趣;内容选择强调趣味性、生动性、口语性、通俗性、学术性;版式设计新颖灵活,不拘一格,在对日北京官话教育史、汉语史、清末中日两国关系、文化交流等方面具有较高研究价值。《支那语学》应用现代传媒手段,拓展了北京官话的教学空间,标志着实体学校之外期刊杂志取得了传播北京官话的话语权;学校教学和杂志教学有机结合,直接把北京官话教学延伸到了社会,开放性强;实现了日本"国家语言政策"的目标;对后来北京官话教学期刊发展影响至深,对今天中国"国别"对外汉语教学机构和期刊结合教学、国家推广汉语战略政策的制订都具有较强的启发意义。     

变性手术法律标准研究

变性手术具有高度伦理性、高侵袭性、高风险性及后果的不可逆性,国家法律必须对其进行规制。"变性人法律与就业政策国际联合会"制定的《变性人医疗法律标准》和"世界变性人健康专业协会"制定的《哈利.班杰民性别焦虑国际协会性别识别障碍医疗标准》(第六版)在变性手术标准方面具有很高的借鉴价值。我国卫生部《变性手术技术管理规范(试行)》存在一些限制患者权利的条款,建议删除患者应提交无罪证明、性取向不能为同性、患者未在婚姻状态等条款。     

投保人信赖利益保护问题

就如何维护投保人的信赖利益这一问题,理论上存在三种方案,即扩大合同成立的可能性、认定存在先合同义务以及扩大保险人的侵权责任范围.通过合同法或侵权法的一般原则来保护投保人的信赖利益均有可能侵蚀合同自由原则.相对而言,先合同义务理论实际上是一种理性平衡裁判术,在类型化的限制之下,既可维护合同自由,又可实现个案正义.
