论土地征收制度的完善与建设用地使用权 制度改革的统筹协调

文章在对我国《物权法》中土地征收规定进行评述的基础上,指出这一制度在适用中还需要完善相关的配套法律、法规。文章从制度间相互联系和作用的视角提出完善土地征收制度须与我国建设用地使用权制度改革联系起来一并进行。文章的重点是对完善土地征收制度提出具体建议:将国家对集体土地的征收限制为公共利益目的,将现有的非公共利益的土地征收转变为由集体与土地使用者直接协商,由集体将非农建设用地使用权进行出让。     

Transforming Social Work Curricula: Institutional Supports for Promoting Sustainability

Due to the centrality of human rights and social justice in the profession, social work must collectively take a stand on ecological degradation and the climate crisis. Overall, social work education's engagement with issues of sustainability and an expanded ecological justice perspective has been peripheral and piecemeal. It is crucial that social work education expand opportunities to prepare social workers to respond to the global environmental crisis. This conceptual paper considers strategies for integrating environmental content in social work curricula and addresses the essential role of institutional supports for curricular change and professional development focused on sustainability. The role of institutional supports to advance curricular change to respond to environmental crises and promote sustainability is highlighted, along with specific examples from the authors' home institution, including (1) institutional commitment and culture, (2) curricular supports and guidelines, and (3) interdisciplinary faculty development.     

Understanding sex: the right to legal capacity to consent to sex

This article addresses the right to legal capacity to consent to sex of people with intellectual disabilities. Article 12 of the Convention on the Rights of Persons with Disabilities guarantees the right to legal capacity on an equal basis in all areas of life. This article discusses sex as an area of life in which people with intellectual disabilities are frequently not being granted legal capacity on an equal basis. The article examines current capacity to consent to sex law in Ireland, England and Wales in light of Article 12. It proposes an ‘agreement model’ as a potential alternative that would be Article 12 compliant.     

产权制度与按要素贡献分配原则

社会财富分配原则的确定是由这个社会的财产产权性质和结构状况决定的。它不仅决定了收入分配的尺度,也影响了收入分配的方式和收入差异的大小。我国正在实施的按要素分配原则是与我国社会主义市场经济条件下不断变革的产权制度相适应的,但是,要有效地贯彻这种收入分配原则,还需要进一步加强产权制度立法与产权保护。     

现代国家建构与土地制度变迁——写在《物权法》讨论通过之际

本文由近年来《物权法》中土地权属问题的热烈讨论而引起,从现代国家建构的角度分析中国的土地制度变迁。现代国家包括民族—国家和民主—国家的双重性。“土地归公”遵循的是民族—国家的逻辑,它为建构统一的主权、强大的中央权威和对乡土社会的渗透提供了基础。但是,民族—国家的持续性合法基础来自于国民认同。随着统一的民族—国家的建构,农民获得土地权益的要求愈益强烈。从家庭经营到《物权法》的“地权属民”原则,是民主—国家建构的逻辑,也是现代国家建构中民族—国家与民主—国家达到相对均衡的产物,它可以建构起农民对国家的制度化认同。     

完善我国人权保障的制度构建

人权保障是宪政的终极价值取向,2004年3月14日,"国家尊重和保障人权"载入宪法,实现了近代以来我国宪政价值追求的历史性改变,揭开了我国人权保障和发展事业的新的篇章。但价值取向的改变仅仅是我国人权保障建设的良好的起点,我们要通过完善宪法、政治制度等各方面,实现对人权的保障。     

留守儿童的救赎之路——观念与公约的碰撞

留守儿童是当前我国一个庞大而特殊的弱势群体。解决留守儿童问题,有赖于养育儿童观念的改变;遵守联合国《儿童权利公约》,确保不违背儿童父母的意愿使儿童和父母分离;给予农民工国民待遇,取消户籍差别。     

THE FUTURE OF PUBLIC MEDIA CULTURES

This paper seeks to tie in the arguments that can be connected to the development of a global media culture and concerns around cosmopolitan forms of democracy. This is done by considering arguments for: (i) a global human right initiative in respect of global media conglomerates; (ii) technological change in respect of digital cultures; and (iii) the arrival of what Castells'shas described as the culture of 'real virtuality'. These views and perspectives are assessed in terms of the contributions they are likely to make towards what I call a 'cautious cosmopolitanism'. Finally I seek to make some definite policy recommendations that might help foster conditions in which cosmopolitan democracy could flourish.     

Sociology and the European Court of Human Rights

This article offers a sociological analysis of the jurisprudence of the European Court of Human Rights (ECtHR). Adopting a sociological jurisprudence approach, the article aims to demonstrate the unique and valuable contribution that sociology can make to understanding key aspects of international human rights law. Whilst the article seeks to develop an agenda for critical sociological research on human rights law, it also aims to persuade those charged with the supervision of human rights of the value of sociological analysis. To achieve this, the article focuses on three separate but inter‐related aspects of ECtHR jurisprudence: first, it considers the ECtHR's approach to consensus in its adjudication of human rights complaints; second, it examines the social control implications of the ECtHR's decisions and judgments; and third, it assesses how conceptualizations of social identity are often foundational to the ECtHR's reasoning.     

“1·25革命”前后埃及政治转型比较

“1·25革命”后,埃及的政治转型一度为中东政治发展带来一丝曙光,但之后更剧烈的社会动荡又为民主转型带来了巨大的不确定性。事实上,在西方民主转型理论的诱导下,埃及的民主化走向误区具有必然性,西方民主转型理论注重即时性的结果,片面地将民主制度的建立及公民政治权利尤其是选举权的实现视作民主转型的终点,而忽视了民主的深刻内涵。民主某种程度上就是各种公民权利,包括基础权利、政治权利及社会权利,依次实现的漫长过程。三种权利互相支撑,构成三位一体的民主。穆巴拉克时代的民主转型缺乏基础权利和社会权利的支撑,最终导致民主的空心化。革命后的埃及尽管在民主制度建设上取得实质性进展,但公民权利的匮乏对民主的成熟构成严重制约,从选举到善治,埃及的民主转型任重而道远。
