中国人口再分布的社会经济合理性及其“多中心集聚”分析

文章通过人口、经济不均衡性及重心变动分析,充分揭示了当前我国人口分布的空间格局及其变化状况。结果表明,中国人口区域偏集依然严重,且还有加剧的趋势,同时“人口一经济”间的契合度也不高,甚至还出现人口重心移动与投资重心移动相背离的情况,这对近期人口空间格局的发展非常不利。为此,研究认为,在当前的中国人口、经济形势下,构建以“多中心集聚”为导向、“人的城镇化”为内涵的新型城镇化体系,是未来进行人口合理再分布的必由之举。     

The Self-determination of Indigenous Peoples and the Limits of United Nations Advocacy in Guerrero,Mexico (1998-2000)

This essay examines the visit to Mexico in February 2000 by Erica-Irene Daes, then chairperson of the United Nations Working Group on Indigenous Populations. I use the occasion of this visit to analyze the relationship between a regional indigenous organization in the state of Guerrero, the Mexican national state, and the United Nations within the larger context of the development of international law. I argue that the persistence today of a centuries-old bias in international law that privileges the "nation-state" and a related individualistic bias in the conception of human rights make UN support for indigenous self-determination highly equivocal. I begin with an examination of the Consejo Guerrerense and how its experience helps to illustrate the issues confronted by the indigenous rights movement in Mexico today. Then I provide background to place this movement and the United Nations in the context of the development of international and human rights law. The discourse of international human rights and the ways in which these rights are defined and advocated by the UN has serious limitations for Indians in Mexico. This is a cautionary tale about the real possibilities for social change in our global world.     

A. B. and C. versus Ireland

This article analyses some possible political implications of the case and the decision in A. B. and C. v. Ireland at the European Court of Human Rights. This case was heard in a public hearing on 9 December 2009; the judgment was provided in December 2010. I argue that the three applicants in this case employed a novel strategy, not previously considered, to access legal abortion in the Republic of Ireland. By highlighting the varied circumstances of unintended pregnancy in more than a single instance, the applicants utilized an offensive manoeuvre to which the government is unlikely to respond consistently over time. They exposed Irish governments' use of clandestine political negotiations in relation to European treaties, the questionable exertion of governments' authority to uphold political and moral agendas and racialized constructions of Irishness and national interests. The applicants also raised serious questions about state practices in the Republic of Ireland in relation to its legal obligation to uphold human rights under the European Convention. However, I argue that it is unlikely that this novel strategy and legal decision and their political implications are enough to adequately address the lack of access to legal abortion in the Republic of Ireland.     

The learning camera: A personalized learning model for online pedagogy in human services education

Abstract

This article describes the development of a personalized learning approach to human services online education that utilizes a “learning camera” as a metaphorical tool for undergraduate students’ development of knowledge, skills, and dispositions required for successful transition to professional practice. By highlighting students’ ongoing development as knowledge builders and constructivist learners, the online curriculum is enacted within each student’s area of interest and in their home communities. This “learning camera” model of online pedagogy for human services education is intended to serve as a resource for other institutions interested in praxis-oriented approaches to personalized online teaching and learning.

Unethical Research and the C.I.A. Inspector General Report of 2004: Observations Implicit in Terms of the Common Rule

Declassification of documents has given rise to the allegation that the Central Intelligence Agency may have conducted unethical research targeting detainee subjects. That allegation is examined using document analysis and the development of research goals and roles as defined in the Common Rule. This article sets aside issues as to whether enhanced interrogation techniques described in the declassified documents rise to legal definitions of torture. Instead, it presents a post hoc ethics review raising questions addressed by Institutional Review Boards recommending the filing of a for-cause noncompliance complaint with the Office for Human Research Protection against the Central Intelligence Agency.

利益相关者理论评析及其对国有企业改革的启示

本文在对利益相关者理论评价的基础上 ,认为只有那些“长期缔约者”和“纯粹风险承担者”才有必要或有可能介入企业治理结构。并且指出 ,实践中要承认人力资本产权的存在 ,但要加以区别对待 ,只有那些特殊人力资本所有者才有可能作为“长期缔约者” ,而对于一般人力资本所有者而言 ,即便是现实中赋予其部分剩余索取权和剩余控制权 ,也均应纳入对人力资本的激励约束范畴来考虑。最后依据本文所述 ,对国有企业改革实践提出了若干建议。
