作为宪法未列举权利的学术自由——美国最高法院的判例与法理

学术自由是否是一个法律概念、一项法定权利,历来是一个问题.在美国法上,学术自由作为大学和教师管理核心学术事务的权利,是一项由最高法院创制的宪法未列举权利.美国早期的学术自由依附于契约权利,体现了一种大学内部政策,即大学管理者在规章制度范围内通过签订契约而赋予教师的自由权.在“学术自由第一案”——Sweezy案——中,最高法院援引宪法第一修正案规定的言论自由权,将学术自由提升为一项值得宪法保护的价值,并指出其基本内涵是自主决定“谁来教、教什么、怎么教、谁被教”;在Keyishian判决中,法院迸一步明确学术自由是“第一修正案的特殊关注”,将其纳入了宪法权利话语体系之中.至Grutter判决,最高法院肯定了在高等教育领域,学术自由是一项独立的、未列举的宪法权利,并可先于其他宪法权利受到保护.相应地,对大学学术性事务的决定,法院必须在宪法规定的范围内给予尊重;尊重的程度,取决于决定是由什么样的主体做出的、需多大程度的学术技能、意识形态中立与否以及是否危害到了别的权利.     

When informal is normal… On the role of credentials and contacts for the job entry in Serbia

The paper focuses on the roles of human capital and social resources in structuring young people's entries into either the formal or the informal labour market in the Serbian transformation society. Results show that informal labour market in Serbia follows the structure of the secondary labour market and signals vulnerability on part of youths employed there. Education dropouts are largely channelled to the informal sector, whereas favourably educated Serbian graduates are less attracted to it. Job search via social networks facilitates entry to unregistered employment, but slows down entry to registered employment for job seekers. Whereas stratification of labour market entry by education largely follows patterns of primary and secondary labour market attainment in any industrialized society, the effects of contacts might exhibit traces of inefficiencies peculiar to the transformation countries. Analyses are conducted on the basis of the Serbian school-leaver survey (2006) applying event history modelling and binomial regression analysis.     

The tail behavior of the convolutions of Gamma random variables

Two sufficient conditions for comparing convolutions of heterogeneous gamma random variables in terms of star order are established. It is further shown that if the scale parameters of heterogeneous gamma random variables are more dispersed in the sense of majorization, then the convolutions are more dispersed according to the right spread order, which generalizes and strengthens the results in Diaconis and Perlman (1987), Kochar and Xu (2010) and Zhao and Balakrishnan (2009).     

京汉铁路利权的赎回及其是非得失

京汉铁路由于借款比利时而被比利时所控制。中国政府赎回京汉铁路,是20世纪初中国理性民族主义的体现,是收回路矿利权运动中最大的成果。北洋集团重要成员陈壁、梁士诒等在赎路过程中的积极努力应该给予充分肯定。清政府在经济困窘的情况下,主要通过借款的方式赎回京汉铁路是无可厚非的。京汉铁路的赎回不仅有着极大的经济利益,更为重要的是政治影响,中国终于摆脱了外国的控制,自主地经营属于自己的铁路管理了。     

李渔生活审美研究综述——以《闲情偶寄》为考察对象

从整体上看,李渔研究包括李渔生平思想和李渔作品,已经非常全面深入。但是李渔美学研究,尤其是李渔生活审美研究还需深入。李渔美学研究突出了戏剧美学,而忽略了生活审美。在李渔生活审美研究中还存在概念把握不准、重复性高、较零散肤浅等问题。     

Edge Estimation in the Population of a Binary Tree Using Node-Sampling

Suppose a finite population of several vertices, each connected to single or multiple edges. This constitutes a structure of graphical population of vertices and edges. As a special case, the graphical population like a binary tree having only two child vertices associated to parent vertex is taken into consideration. The entire binary tree is divided into two sub-graphs such as a group of left-nodes and a group of right-nodes. This paper takes into account a mixture of graph structured and population sampling theory together and presents a methodology for mean-edge-length estimation of left sub-graph using right edge sub-graph as an auxiliary source of information. A node-sampling procedure is developed for this purpose and a class of estimators is proposed containing several good estimators. Mathematical conditions for minimum bias and optimum mean squared error of the class are derived and theoretical results are numerically supported with a test of 99% confidence intervals. It is shown that suggested class has a sub-class of optimum estimators, and sample-based estimates are closer to the true value of the population parameter.     

论第三人代付保险费

保险费的交付义务可否由第三人代为履行是一个颇值得探讨的问题.笔者分别从财产保险合同与人身保险合同两方面对这一问题进行了论述.在财产保险合同中,保险费的交付在性质上与一般债务相同,所以由任意第三人代付保险费也应为事理所允许;在人身保险合同中,因其以保障被保险人的生命、安全为主要目的,为防止主观危险,应该认为其保险费的交付是具有特殊性质的债务,不得由任意第三人代付.     

左右同源:新文学史上的新写实主义

在中国新文学史上,持续存在于1920年代之后约半个世纪的新写实主义文艺思潮,不仅包括左翼无产阶级的革命现实主义、社会主义现实主义,也包括一直被忽略的右翼的三民主义写实主义。左右两种新写实主义理论,尽管服务于各自所属政治集团的意识形态竞争需要,却都是源于20年代的苏联和日本,源于相同的革命政治思维和文学工具性思维。     

辛亥革命时期的锡金军政分府述略——纪念辛亥革命100周年

辛亥革命时期,革命党人秦毓鎏领导无锡和金匮两县的光复事业,起义成功后建立的锡金军政分府,成为当时很有影响的地方政权的代表。锡金军政分府从1911年11月成立至1912年5月结束,存在半年左右时间。在此期间,军政分府组建军政领导核心、接管地方旧有政权、举办民团等,强化了对地方政权的控制;通过废除厘金、催租征税、镇压农民抗租斗争,来稳定地方的经济秩序;积极废除地方的陈旧陋习,移风易俗,注重市政建设,推进了无锡社会事业的发展。锡金军政分府的存在,对周边地区如常州、镇江等地方政权的稳固,对革命党人光复南京起了积极的作用,甚至对后来的"二次革命"也有很大的影响。
