农村家庭合法财产的分割包括“分家”和对“遗产”的处理两种形式。“分家”是农村生活中一种源远流长的活动,有其独特的规则和模式,历史地形成了一种具有普遍效力的乡俗民约。同时,“分家”的含义往往扩大化,涵盖了“遗产分割”的概念和形式。本文从社会学法学的角度,运用访谈和参与实例的方法,以山西省平遥县段村镇段村为对象,对其家庭财产的分割规则、类型、仪式、程序、信条等进行了实证调查,以期理解“分家”这种乡俗民约的内涵,透视“现实中的法律”所反映的伦理、秩序和文化。

Multiple objective policy analysis: A factor analysis and tradeoff approach applied to the agricultural sector of the Dominican Republic

The technique of factor analysis is applied to a situation in which result data from multiple objective policy analysis need to be reduced to a subset of information for policy makers. Use of factor analysis in this context is developed in some detail, and the process is applied to results of pricing policy simulations from a model of the agricultural sector of the Dominican Republic. It is concluded that factor analysis can be a useful first step for the analyst to determine the relationships among groups of variables. The technique also aids the process of data reduction to allow graphical presentation of tradeoffs.     

Care of Empowerment? A Disability Rights Perspective

This paper challenges the notion of "care", arguing that people who need support in their daily lives have been constructed as "dependent people". Instead, the author argues, if we want to empower people we must learn from the Independent Living Movement, from the people who struggled against segregation and insisted that access to personal assistance over which they have control is a civil rights issue. The paper takes issue with Clare Ungerson's perspective on the new direct payments legislation. This legislation is an important stage in the achievements of a civil rights movement and social researchers have a moral responsibility to collaborate with this movement in any work which they develop on issues which are not of mere academic interest but which concern people's rights to choice and control in their lives.

Probability of ties and Markov property in discrete order statistics

It is well known that, in the continuous case, the probability that two consecutive order statistics are equal to zero, whereas it is not true when the distribution is discrete. It is, perhaps, for this reason that order statistics from discrete distributions has not been investigated in the literature as much as from a continuous distribution. The main purpose of this paper, therefore, is to obtain the probability of ties when the distribution is discrete. Also it is shown that, in the discrete case, the Markov property does not hold good. However, the order statistics from a geometric distribution forms a Markov chain.     

What's really new about policy modeling? An assessment on the basis of the U.S. federal government experience

This article is an attempt to look at where policy modeling is today in reality as opposed to where it is often perceived to be by those who are its proponents. To do this, an impressionistic survey is made of the state of the art, looking at such factors as model theory, structure, data, validation, and uses. Finally, some effort is made to take the results of this examination and use the conclusions reached to suggest what the future of policy modeling might be and what yet unexplored avenues remain to the model builders and users.     

关于《物权法(草案)·总则》的几点思考

本文探讨了物权法草案总则中的若干重要问题.作者认为,物权的概念中应当包括对世性,应当规定物权优先于债权的规则,违反物权法定原则的效果,区分所有权移转中的公示方法与他物权设定合同的公示方法,区分动产的善意取得和不动产的公信原则,增加实质审查的内容,进一步完善异议登记制度,对有权查阅不动产登记簿的人作出适当限制,对于法院的确权判决和裁定对物权变动的影响应当作出更明确的规定.
