Fearing yellow,imagining white: media analysis of the Chinese Exclusion Act of 1882

The Chinese Exclusion Act of 1882 was a watershed event in the context of race, nation, and the law because it denied Chinese immigration into the USA for over 80 years. This paper analyses the media coverage of the Chinese in the San Francisco Chronicle during the year of the Act's passage. The theoretical framework of ‘Purity and Danger’ provides a starting point in analyzing how whiteness and nation are constructed as ‘pure’, while Chinese immigration is constructed as a ‘danger’ within a symbolic, racial and political manner. Discourse analysis was applied to the data for an intersectional investigation of race, class, gender, and nation, to determine how the discourse is organized thematically, as well as uncover ideological meanings in relation to how ‘fearing yellow’ also reflected ‘imaging white’ in media discourse.     

Consumer Debt Repayment Behavior as a Precursor to Bankruptcy

The passage of the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) of 2005 culminated years of debate over the escalating number of bankruptcy filings and whether or not consumers were abusing the bankruptcy system. Our study focuses on the extent to which households seek bankruptcy protection without first attempting to restructure their debt or experiencing indicators of financial distress. Through multivariate regression analyses of longitudinal data from the Panel Study of Income Dynamics (PSID), we find a significant relationship between having prior financial problems and filing for bankruptcy. Our results also indicate that households that obtained consolidation loans were equally likely to file for bankruptcy as those that did not. We conclude that early interventions with financially distressed consumers may provide opportunities to reduce bankruptcy filings.

Did PRWORA's mandatory school attendance policy increase attendance among targeted teenage girls?

The purpose of this paper was to examine if the school-attendance requirement of the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) significantly increased attendance among the teenage girls that the policy targeted. This study applied difference-in-difference and difference-in-difference-in-difference methods to 12 years of cross-sectional data from the October Supplement of the Current Population Survey while isolating the effects of PRWORA from the effects of other factors that might have influenced the target population's school attendance. The findings indicated that PRWORA, overall, did not have significant positive impacts on school attendance; rather, the policy was associated with a small but significant reduction in school attendance of U.S.-born disadvantaged teenage girls between 1996 through 1999 and essentially no effects on the target population thereafter.

适应金融国际化和防范金融风险的需要,我国的金融体制应继续进行改革。借鉴他国的成功经验,结合我国实际,国有商业银行从分业经营走向混业经营不可避免。经营范围的变化并不代表经营机制的转换。只有转换经营机制,进行产权制度的彻底改革,方能达到改革目标。     

美国《双语教育法》颁布的社会背景研究——基于霍姆斯的四模式分析框架

在美国的中小学校除英语之外讲各种语言的学生,或者说那些不会讲英语的学生,他们的教育需求长期得不到妥善的解决。1968年颁布的《双语教育法》表明,美国联邦政府承认了美国学校体制中长期存在的只能使用英语教学的单语教学问题,如何使教学语言多样性是一个亟待解决的核心问题。以霍姆斯的四模式为分析框架,把颁布《双语教育法》时纷繁复杂的社会背景置于规范模式、组织制度模式、精神状态模式和自然环境模式中进行分析,结果显示:(1)移民人口剧增并逐步扩展到新的区域,给美国公立学校造成了巨大压力;(2)司法判例对所实施的隔离但平等原则的彻底否定催生了新的希望;(3)少数族裔群体谴责主流社会的不公平,他们要求身份认同和获得更多权利的呼声愈来愈大;(4)联邦政府对保障国防安全、消除贫困现象等多重利益的考量,促成了《双语教育法》的颁布。     

日本《低碳投资促进法》述评

日本参议院于5月18日通过了《低碳投资促进法》,该法是日本建设低碳社会的最新立法,规定了对从事适合能源环境的制品开发与制造的特定事业者提供筹资支持,需求开拓支援法人承保租赁合同等措施,对我国的相关立法有一定的借鉴意义。     

论《清洁能源与安全法案》及其对我国气候变化立法的启示

《清洁能源与安全法案》是美国最具革命性和影响力的气候变化法案。该法案共分为五大部分:清洁能源、能源效率、减缓全球变暖污染、转向清洁能源经济以及农业和森林所涉及的抵销。该法案遵循"命令——控制"模式和市场调控模式相结合的立法思路,以气候衍生品作为调节影响气候变化行为的主导工具。我国应当制定《气候变化应对法》,构建碳排放交易体系,以市场机制促进国内碳减排和增加碳汇。我国的气候立法应当减缓与适应并重,分领域有重点地进行气候治理。
