Double hierarchical generalized linear models (with discussion)

Summary.  We propose a class of double hierarchical generalized linear models in which random effects can be specified for both the mean and dispersion. Heteroscedasticity between clusters can be modelled by introducing random effects in the dispersion model, as is heterogeneity between clusters in the mean model. This class will, among other things, enable models with heavy-tailed distributions to be explored, providing robust estimation against outliers. The h -likelihood provides a unified framework for this new class of models and gives a single algorithm for fitting all members of the class. This algorithm does not require quadrature or prior probabilities.

论我国民间对日索赔的困境与对策

自1995年中国花冈劳工诉日本鹿岛株式会社发端,中国民间对日索赔诉讼已历经18个春秋,诉讼案达31件,除4例和解外,终审无一胜诉。日本法院晚近判决中,驳回我国民间索赔的主要理由有二：一是据《中日联合声明》中国政府已放弃民间索赔;二是已过诉讼时效。据国际法理对上述理由剖析与审定,一方面可知以上二者均背离了国际法原则,进而可助益民间对日索赔走出困境。另一方面对维护我国受害者及其遗族的合法权益,彻底解决二战赔偿问题,根本矫正日本军国主义传统,亦具重大现实意义。     

The Role of Joint Attention in Later Development Among Preterm Children: Linkages Between Early and Middle Childhood

Joint attention is a hallmark of human cognition. It refers to the capacity to coordinate attention to objects and events with attention to other people. Infants display considerable individual differences in this capacity. This longitudinal study of 13‐month‐old preterms was conducted to examine the hypothesis that two different types of joint‐attention skills assessed in an infant–tester paradigm are related to verbal and nonverbal IQ measures through middle childhood. Data are reported separately for the children's tendency to initiate such skills and to respond to an experimenter's offers to share in such behaviours. The results provide support for the hypothesis that the initiation of joint attention makes a unique contribution to later nonverbal IQ apart from variance associated with biomedical risk status and infant development. The results of this study have implications for the conceptualisation of joint‐attention skills, as well as for understanding the relation between joint attention and later cognition.

ON PUBLIC AND PRIVATE IN J. M. COETZEE

This essay reads J. M. Coetzee's Diary of a Bad Year in its historical context (the moment of the US war in Iraq, Abu Graib, Guantanamo and the apparent triumph of neoliberalism), while also probing the problems at stake in the practice of contextual reading and of taking the work as staging the opinions of the biographical Coetzee. The essay teases out not only the question of whether Coetzee should be seen as a public intellectual (the short but not entirely satisfactory answer is ‘no’), but also how the terms ‘public’ and ‘private’ play out in his oeuvre and are helpful in pondering Coetzee's approach to questions of genre, censorship and authorship.

美国对台军售应对策略的国际法分析

中美正式建交33年来,美国政府严重违背了其在“八·一七公报”中对中国的承诺,不断地对台湾出售武器,并且出售武器的性能和数量不断增加。从国际法角度分析美国对台军售：第一,美国对台军售严重违反了国际条约法的基本原则;第二,美国对台军售严重侵犯了中国的国家主权;第三,美国对台军售严重违反了不干涉内政的国际法基本原则。在此基础上,中国应该积极从国内层面和国际层面寻求国际法对策,从而敦促美国停止对台军售,促使中美关系良性发展。     

由“强制引产胎儿”事件引发的法学思考

结合陕西安康发生的"强制引产胎儿"事件,对"引产"进行了法理分析。认为:"强制引产"应属行政违法和行政侵权行为。强制引产行为的产生既有执法者主观方面的原因,如政治意识、法律观念、道德观念欠缺等,又有客观方面的原因,如一定社会环境中法制、经济状况的影响等。其中,执法者的"傲慢"和"偏见"是重要原因。就此提出了完善立法、依法行政、严格责任、体现以人为本的理念等建议,以解决计划生育行政执法难题。
