香港特区政府中小企业扶持政策分析

中小企业是香港经济发展的重要支柱及动力,香港回归以来,随着经济全球化趋势的进一步加强、中国对外开放的不断拓展和知识经济的兴起,中小企业在许多层面面临困难和挑战。特区政府成立以来,在营商环境、人力资源、信息、市场拓展等方面推出了多项对中小企业的扶持措施。基于特区政府的经济哲学和政策理念,在可以预见的时间内,政府对中小企业扶持政策的力度不会有太大的加强。     

内地与香港区际私法前沿问题研究评述

“入世”后,内地与香港之间日益频繁的经济、民间交往客观上要求创新解决区际法律冲突的模式,并加强区际司法协助。本文通过比较内地与香港在合同、婚姻、继承方面的法律规定以及对内地与香港在区际司法协助领域存在问题的法律研究,在借鉴区际法律最新研究成果的基础上提出在“一国两制”的前提下解决内地与香港区际法律冲突,加强司法协助的理想模式和方法。

国际组织中的各类成员及其在组织中的法律地位是国际组织法上的基本问题之一。政府间的国际组织,其成员主要是国家,但也包含其他形态各异的成员主体。这些其他成员主体可以总括为国际组织中的"混合成员"。对国际组织中的混合成员及其在组织中法律地位的研究、界定,有助于更好地认识和发挥国际组织在国际社会中的作用。中国港澳台地区作为国际组织中混合成员的一类,通过研究其参与的政府间国际组织,可为其更好地参与政府间国际组织提供法理依据。     

FIGURES OF HOPE AND THE FILMIC IMAGINARY OF JIANGHU IN CONTEMPORARY HONG KONG CINEMA

Through an extensive allegorical reading of films, this paper attempts to capture a certain cultural form of imagination in Hong Kong during the transitional period leading up to the historical handover of power in 1997. Dwelling on the world of signification conjured up through what I call the jianghu filmic imaginary,the analysis focuses on the ideological and utopian impulses registered in relation to a whole emotional complex of anxiety, bewilderment and despair in the works of some highly creative local filmmakers of the genre: Ching Siu-Tong, Ann Hui, Tsui Hark and Wong KarWai. The study draws theoretically from Castoriadis's notion of the social imaginary and Bloch's aesthetics of hope, to focus on the textual and contextual re-constructions of a number of very unconventional martial arts swordplay (wuxia) films made in Hong Kong in the last two decades: namely, Tsui's Butterfly Murders (1979), Hui's Romance of Book and Sword (1987), Ching/Tsui's Swordsman II (1992), and Wong's Ashes of Time (1994). By identifying the ideological and affective moments in the filmic imaginary,I want to trace what has been left in a ruined culture for utopian longings, and point to the presence/absence of ‘hope’ as the cultural imagination for an unknown and unknowable future (beyond 1997). It is my contention that an understanding of that peculiar form of popular imaginary at the unusual juncture of Hong Kong's history can begin with a critical attempt to cope with this subtle practice of hope, so as to recognize (or reject) it as mediation in the process of our collective cultural crisis, anticipation and identification.     

Demise of the Developmental State? Implications for Social Policy Development in Hong Kong

This paper argues that Hong Kong is now at the crossroads of its journey towards social policy development. While economic development still seems to be the unwavering objective of the Hong Kong government, the demand for democracy and social development can no longer be ignored because of a strong civil society fostered by economic success. The current state of affairs provides a window of opportunity for the Hong Kong government to strengthen its legitimacy through the development of social policy and to promote social harmony through inclusivity in social welfare. The findings from the present empirical survey conducted by the Hong Kong Institute of Asia‐Pacific Studies (HKIAPS) in 2010 demonstrate that Hong Kong people identified social harmony as the main direction for social development, closely followed by economic development, and democracy and freedom. Respondents who chose social harmony as the main goal of social development were more likely to take a step back and find common ground when fighting for their own rights or the rights of society. This paper concludes that these findings reflect the crucial importance of taking social harmony into consideration in the social policy development process.     

港台社会工作发展路径的比较分析

虽然港台社会工作的发展进程较为一致，但由于二者在历史背景、渊源及社会发展情况等方面存在差异，导致二者在发展路径上存在着“自上而下”与“自下而上”的分殊。大陆应注意两种路径的结合，发挥政府与社会工作界的各自优势，共同推进中国社会工作的进程。     

Modernization of Power in Legal and Medical Discourses: The Birth of the (Male) Homosexual in Hong Kong and Its Aftermath

The removal of homosexuality from the list of mental disorders and the repeal of restrictive sexual laws deem that Foucault's argument on the discursive control of homosexuality requires refinement to take into consideration the continual modernization and improvement of power. This article examines the multilayered discursive terrain in Hong Kong where homosexuality is created, regulated, and contested in the contemporary era. With the popularization of human rights discourse, sexual dissidents are not simply treated as criminal or pathological; rather, legal and medical discourses have shifted to an increasing reliance on notions of risk to put mechanisms of social regulation in place.
