The Failure of Labor Dispatch Regulation and Its Remedy

In the course of the drafting, enactment and amendment of the Labor Contract Law of the People’s Republic of China, the legal provisions regulating labor dispatch have been tightened up. In practice, however, the labor dispatch system is flourishing in a way that defies market trends. The ultimate reason for this is that much of the system goes under the name of human resource outsourcing to bamboozle the public and evade the law, in effect making the legal provisions a dead letter. The result is that the more the industry is regulated, the more it multiplies and the more chaotic it becomes. Based on comparative law research methodology, this article reviews the legal systems relating to labor dispatch in Germany, the US and other countries. It demonstrates and affirms the institutional value of the labor dispatch system, and categorizes its different types. The fundamental cause of the phenomenon of labor dispatch’s assumption of the guise of human resource outsourcing is the absence of substantive review. We suggest introducing and perfecting such investigation to stem the industry’s deep-seated abuses.     

The effect of supplier development on outsourcing performance: the mediating roles of opportunism and flexibility

Abstract

In this increasingly competitive business environment, firms utilise outsourcing as a strategic tool to leverage globally dispersed resources so that they may focus on their core competencies and improve efficiency. The more firms rely on outsourcing, the more they depend on their suppliers, and the more important it is to manage and develop suppliers in order to achieve and maximise the benefits of outsourcing. This paper explores the impact of supplier development on outsourcing performance. Structural equation modelling was used to analyse data collected from 213 manufacturing firms in China. The results indicate that supplier development has a strong direct positive impact on outsourcing performance, and that supplier development also leads to enhanced outsourcing performance through reducing outsourcing opportunism risk and improving outsourcing flexibility. In addition to making a contribution to current theories of outsourcing, our findings also provide outsourcing managers with practical understanding and insights about the role of supplier development in enhancing outsourcing performance.

针对信息安全外包的业务流程,运用系统理论分析,识别外包服务的关键风险因素,提出基于第三方认证的风险评估框架,构建了评估指标体系,结合我国风险管理政策制定安全服务商服务风险监测规则,更好管理外包风险。     

中国承接IT外包竞争力影响因素实证分析

为了解我国承接国际IT外包竞争力的影响因素及其对我国承接IT外包竞争力的具体影响程度,基于波特的钻石模型理论,借鉴国内外相关研究,选取14个指标作为我国承接IT外包竞争力的影响因子并归为5组,通过主成分分析提取每组的共同因子,通过回归分析认为14个影响因子对我国承接IT外包竞争力有明显影响。由此得出结论：资本和劳动力成本的上升会削弱我国承接IT外包竞争力;完善的基础设施、高素质的人力资源、优惠政策及科技创新能提高我国承接IT外包竞争力;国内相关产业结构和国内外需求对我国承接IT外包竞争力无影响。
