秦代洞庭、苍梧两郡悬想

2002年出土里耶秦简中的洞庭与苍梧两郡名,既不见于传世的秦代文献,也为历来考证秦郡学者所不知,动摇了已成定论的秦郡体系。本文根据出土资料与传世文献重新思考,推测原定的长沙与黔中二郡实际上并不存在,应以洞庭、苍梧两郡取代之,并适当调整郡界,维持《中国历史地图集》考定的秦郡基本格局。     

Asymptotic Behaviors of the Lorenz Curve for Censored Data Under Strong Mixing

In this article, we consider a nonparametric estimator of the Lorenz curve under censored dependent model. We show that this estimator is uniformly strongly consistent for the associated Lorenz curve. Also, a strong Gaussian approximation for the associated Lorenz process are established under appropriate assumptions. A law of the iterated logarithm for the Lorenz process is also derived.     

Laws of the Iterated Logarithm and a Moderate Deviation of MLE for the Proportional Hazards Model with Incomplete Information

In this paper, we obtain a law of iterated logarithm, a Chung-type law of iterated logarithm, and a moderate deviation result of the maximum likelihood estimator (MLE) for the unknown regression parameter vector in a proportional hazards model with incomplete information.     

General laws of large numbers under sublinear expectations

ABSTRACT

In this paper, under some weaker conditions, we give three laws of large numbers (LLNs) under sublinear expectations (capacities), which extend the LLN under sublinear expectations in Peng (2008b Peng, S. (2008b). A new central limit theorem under sublinear expectations. arXiv:0803.2656v1 [math.PR], 18 Mar 2008. [Google Scholar]) and the strong LLN for capacities in Chen (2010 Chen, Z. (2010). Strong laws of large numbers for capacities. arXiv:1006.0749v1 [math.PR], 3 Jun 2010. [Google Scholar]). It turns out that these theorems are natural extensions of the classical strong (weak) LLNs to the case where probability measures are no longer additive.

ABSTRACT

We consider the asymptotic properties for the moment estimators in Rayleigh distribution with two parameters. The law of the iterated logarithm for the estimators can be obtained. Moreover, we can give a simple proof of the asymptotic normality which has been obtained by Li and Li (2012) Li, Y.W., Li, M.H. (2012). 论《物权法》的人权底蕴

作为权利启蒙的物权是现代社会人权的物化表达。《物权法》基本精神是对基本人权中财产权的一种平等保护。如何防止公权力对公民基本财产权的侵犯是《物权法》实施中需要着重解决的问题。《物权法》的颁布对于保障和完善我国基本人权体系具有里程碑式的意义。     

改革与突破：推进农村土地规范有序流转

农村土地的规范有序流转,有利于推进城乡经济社会发展一体化进程、促使乡土中国走向现代中国。为此,必须贯彻党的十七届三中全会精神,制定《土地流转法》,加强土地流转法制建设,完善土地流转管理机构职能,发展土地流转服务组织,推进农村土地规范有序流转。     

论外观设计专利的边界——兼评《专利法》第二条第四款

外观设计不仅具有公共产品属性,而且易与发明、作品等其它知识产权客体重叠,这就使其边界难以界定.我国<专利法>第二条第四款对外观设计的界定并不完善,主要体现在对排除对象没有予以规定.应借鉴美国版权法、英国外观设计法的立法技术,确立公共领域保留和功能性排除原则两项原则,对外观设计专利既予以抽象定义,又予以排除规定,以确定外观设计专利合理的边界.     

国际反倾销中公共利益问题研究

反倾销是世贸组织认可的国际贸易救济措施,是国际上通行的制止不正当竞争、规范国际贸易秩序的重要手段。保护国内产业免受倾销损害是反倾销最直接的目的,该措施被世界各国广泛运用。但是,反倾销措施涉及多方利益,它在保护国内相关产业利益的同时,却有可能损害下游企业和消费者等其他群体的利益以及社会的整体利益。实施反倾销措施应权衡公共利益日益受到国际社会的普遍关注,且公共利益的合理性也为多数国家所认可。在反倾销机制中引入公共利益原则、正确理解公共利益的涵义、并在实践中加强其可操作性,从而最大限度地维护社会整体利益,不但可以遏制贸易保护主义的滥用,而且对于完善我国的反倾销制度也具有现实意义。公共利益原则是避免反倾销措施片面保护国内产业而损害国家整体利益的安全阀,该原则将会成为国际反倾销机制中的重要组成部分。     

商谈法律理论视野下中国立法反思

在多元化背景下,如何寻求公平的立法以输出分配正义、建立集体价值共识,成为迫切需要解决的课题。哈贝马斯从交往理性入手,通过商谈法律理论为立法公平找到了正当性基础。因循哈贝马斯的理论,完善我国立法商谈机制,就应当树立主体际的立法观念,保障公民政治参与权,以合理化目标规范商谈程序。
